HomeMy WebLinkAbout10-23-2001 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING OCTOBER 23, 2001 CALL TO ORDER Chairman Linebarier called the regular meeting of the Ocoee Code Enforcement Board to order at 7:30 p.m. in the Commission Chambers at City Hall. Chairman Linebarier led the Pledge of Allegiance to the Flag and Member Henderson led the Invocation. The roll was called and a quorum declared present. PRESENT: Chairman Linebarier, Vice-Chairman Lenko, Members Chancey, Konicek, Henderson, and Solomon. Also present were Attorney O'Quinn, Code Enforcement Supervisor Simon, Code Enforcement Officer Siegrist, Building Clerk Ramos, and Administrative Assistant II Maxwell. ABSENT: Member Godek and Code Enforcement Officer Loeffler, who were excused. Members Donenfeld and Skiles, who were unexcused. CONSENT AGENDA ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT BOARD AND WILL BE ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS UNLESS DISCUSSION IS DESIRED BY A MEMBER OF THE BOARD,IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE BOARD CLERK TO REMOVE THE ITEM FROM THE CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED (`r SEPARATELY. The consent agenda consisted of approval of Items A, B, & C. A. Minutes of the Code Enforcement Board Regular Meeting held on Tuesday, September 25, 2001. B. Order of Continuance -None C. Order of Dismissal-None Vice-Chairman Lenko, seconded by Member Konicek, moved to approve the Consent Agenda as corrected. Motion carried 6-0. (Motion under the Consent Agenda in September 25, 2001, Minutes should be corrected to read Motion carried 6-0, not 7-0.) COMMENTS FROM CITIZENS None HEARINGS OF STATEMENTS OF VIOLATIONS PURSUANT TO THE HEARING RULES ADOPTED BY THIS BOARD ON JUNE 27,1995,VARIOUS DOCUMENTS ARE USED BY THE CODE ENFORCEMENT OFFICERS IN EACH CASE AND ARE REPORTED IN THE CASE TESTIMONY GIVEN BY THE CODE ENFORCEMENT OFFICER. Vice-Chairman Lenko, seconded by Member Konicek, moved to consider Case Nos. 01-039, 01-048, as the next items on the Agenda. Motion carried 6-0. Building Clerk Ramos administered the oath to Code Enforcement Supervisor Simon and Code Enforcement Officer Siegrist. HEARINGS ON STATEMENT OF VIOLATONS PURSUANT TO NOTICES OF HEARINGS Vice-Chairman Lenko, seconded by Member Henderson moved to re-hear Case No. 01-039 for reduction of fine. Motion carried 6-0. Case No. 01-039 - Karrie L. Owens 2009 Joan Lee Court Officer Loeffler Violation Cited: 165-3 08-17-01 NOCV Re-Inspection Date: 08-16-01 08-17-01 SOV 08-17-01 NOH Meeting Date: 08-28-01 08-17-01 POS Hand Delivery 08-28-01 OIFL $25.00 a day from 08-16-01 09-19-01 RFRROF 09-25-01 RFRDUC 10-02-01 AOC Total due$1200.00 from 8-16-01 thru 10-02-01 Observation: Brown G.M.Cadillac in front yard,no tag;tall weed growth under vehicle. Code Enforcement Supervisor Simon stated there was nothing to add to this case but the total fine is $1,200.00. Respondent, Carrie Owens and her husband, Harry Owens, having been sworn, stated the property is in compliance. Discussion ensued. Member Henderson, seconded by Vice-Chairman Lenko, moved in Case No. 01-039 to reduce the fine to $250.00 if paid by January 22, 2002, or the fine will revert back to the original$1200.00 fine. Motion carried 6-0. Case No. 01-048 - Harold & Cathy Nagel 703 Wurst Road Officer Siegrist Violation Cited: 51-21 A;51-31 09-05-01 NOCV Re-Inspection Date: 09-27-01 10-10-01 SOV 10-10-01 NOH Meeting Date: 10-23-01 10-12-01 POS Hand Delivery Observation: Obtain permit and have inspections completed. Code Enforcement Officer Siegrist,having been sworn, gave a detailed history of the Case and stated the property is in non-compliance. Code Enforcement Board Minutes October 23,2001 L Respondent, Harold Nagel III, having been sworn, stated he had previously applied for a building permit but there has been some confusion and delays on his part and also on the part of the City of Ocoee. Discussion ensued. Vice-Chairman Lenko, seconded by Member Henderson, moved to find the Respondents in Case No. 01-048 in violation of Section 51-21 A and 51-31 as of September 14, 2001, but is given until November 27, 2001, to comply or be fined$250.00 per day. Motion carried 6-0. (11109 Code Enforcement Supervisor Simon ,having been sworn, gave a detailed history of the Case, and stated the City of Ocoee is asking for a demolition order. (Case Nos. 99-111 and 00-117 also involve the property located at 688 Veronica Circle) (The lien from Case No. 99-111 of$11,000.00 continues) Vice-Chairman Lenko, seconded by Member Konicek, moved in Case No. 01-037 to grant the demolition order at the request of the City of Ocoee. Motion carried 6-0. Case No. 01-040 -Edwin & Deborah Colon 2011 Shari Lynn Terrace Supervisor Simon Violation Cited: 51-21; 51-31; 51-34 08-08-01 NOCV Re-Inspection Date: 08-24-01 09-11-01 SOV 09-11-01 NOH Meeting Date: 09-25-01 09-11-01 POS Certified Mail 09-25-01 CO Given until 10-02-01 or $100.00 per day 09-26-01 AOC Observation: Electrical final was denied, re-inspection fee was not paid, and final inspection has not been scheduled. Fence permit was voided due to non-payment and fence was erected without the permit. Final inspection on the fence has not been scheduled. Code Enforcement Supervisor Simon, having been sworn, stated the Homeowners' Association has dissolved. Discussion ensued. Vice-Chairman Lenko, seconded by Member Henderson, moved to find the Respondents in Case No. 01-044 in violation of Section 115-5, to order the City of Ocoee to clean up the property and to return before the Code Enforcement Board for fine and lien for costs of the clean up. Motion carried 6-0. Case No. 01-045 -Denise A. Carr 826 Satin Leaf Circle Officer Siegrist Violation Cited: 165-3 08-08-01 NOCV Re-Inspection Date: 08-28-01 09-11-01 SOV 09-11-01 NOH Meeting Date: 09-25-01 09-11-01 POS Certified Mail 09-17-01 POS Hand Delivery 09-25-01 CO Given until 10-02-01 or$100.00 per day 10-03-01 AONC Observation: One Camero,brown with not tag in driveway;right rear tire almost flat. Code Enforcement Officer Siegrist, having been sworn, gave a brief history of the Case and stated in property is in non-compliance. Vice-Chairman Lenko, seconded by Member Konicek, moved in Case No. 01-045 to enter an order imposing fine and lien of$100.00 per day since October 2, 2001. Motion carried 6-0. Chairman Linebarier announced Case Nos. 99-164, 01-023, and 01-038 are in compliance. COMMENTS Building Clerk Ramos -None Code Enforcement Officer Siegrist—None Code Enforcement Supervisor Simon - Said she spoke with Commissioner Howell regarding the Code Enforcement Review Committee and his concerns were addressed and sees no reason to have any further meetings. Discussion ensued. Attorney O'Quinn -None L Code Enforcement Board Minutes October 23,2001 L Chairman Linebarier - Said he has not had any updates in the Code Book for almost a year. Administrative Assistant II Maxwell advised the Code Enforcement Board that Code Book updates would be processed within the next several weeks. Chairman Linebarier also asked when the City of Ocoee was going to get it's Code Enforcement Department up and running again. Discussion ensued. Vice-Chairman Lenko -None Member Konicek—None Member Chancey-None Member Solomon - Said the Code Enforcement Board handled a lot of cases in a short time span tonight.
