HomeMy WebLinkAbout07-25-2000 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING JULY 25, 2000 CALL TO ORDER Chairman Linebarier called the regular meeting of the Ocoee Code Enforcement Board to order at 7:33 p.m. in the Commission Chambers of City Hall. Chairman Linebarier led the Pledge of Allegiance to the Flag and Vice-Chairman Lenko led the invocation. The roll was called and a quorum declared present. PRESENT: Chairman Linebarier, Vice-Chairman Lenko, Members Chancey, Ellison (arrived 7:57 p.m.), Holmes, Konicek, Skiles and Alternate Member Solomon. Also present were Attorney O'Quinn, Code Enforcement Supervisor Shelly Simon, Code Enforcement Officers Ed Loeffler and Bob Siegrist, Building Clerk Robin S. Harris, and Administrative Secretary Brenda Maxwell. ABSENT: Alternate Member Godek (excused). CONSENT AGENDA ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT BOARD AND WILL BE ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS UNLESS DISCUSSION IS DESIRED BY A MEMBER OF THE BOARD, IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE BOARD CLERK TO REMOVE THE CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED SEPARATELY. APPROVAL OF CONSENT AGENDA; ITEMS A, B (1 ), & C (1), & D (1) Vice-Chairman Lenko removed Item II A, Minutes of June 27, 2000, Meeting from Consent Agenda. Chairman Linebarier added the following Cases to Item C, Order of Continuance to the Consent Agenda, be considered at the August 22, 2000, Code Enforcement Meeting: Cases 00-081, 00-083, 00-084, 00-086, & 00-088. B. Dismissals 1. Case 00-078, Jennifer Patterson, 698 S. Bluford Avenue One dilapidated storage building with overgrown weeds/grass surrounding same. Compliance Date June 10, 2000. C. Order of Continuance (August 22, 2000, Meeting) 1. Case 00-077- Winifred L. Whitehead & Lora M. Whitehead, 698 S. Bluford Avenue Dilapidated storage building with overgrown weeds/grass surrounding same. 2. Case 00-081- Maria Rocha & Elisabet Cuellar, 19 Sundial Key Court Disassembled, untagged white&blue Ford pick-up truck. 3. Case 00-083- Anthony Madonia & Margaret C. Madonia, 465 New Meadows Court Lly Miscellaneous junk/debris/auto parts littering property; one junk/untagged white Hyundai with flat tires; one junk/untagged white Ford Bronco. Case 00-086- Luis M. Rivera d/b/a/ Caribbean Motors, 399-A Enterprise St. Occupational license inspection revealed and required the corrections of an light-fixture on rear wall not wired to code, a loose electrical light switch and fixture box and the removal of a un-permitted temporary carport canopy. 6. Case No. 00-088- Lyell Hintz- 427 Sterling Lake Drive Failure to schedule a Minimum Housing Standards/Compliance re-inspection. D. Order of Continuance (September 26, 2000) 1. Case 00-087- Pleasant G. Dobbs & Peggy A. Dobbs, 1804 Adair Street Failure to schedule a Minimum Housing Standards/Compliance re-inspection. Vice-Chairman Lenko, seconded by Member Skiles, moved to adopt Items II B, II C, and IID of the Consent Agenda. Motion carried 7-0. Vice-Chairman Lenko noted that the Minutes of June 27, 2000, should be corrected to read Members Ellison, Konicek, Skiles, and Alternate Member Solomon were excused. Vice-Chairman Lenko, seconded by Member Konicek, moved to adopt the Minutes of June 27, 2000, as amended. Motion carried 7-0. COMMENTS FROM CITIZENS None HEARINGS OF STATEMENTS OF VIOLATIONS PURSUANT TO THE HEARING RULES ADOPTED BY THIS BOARD ON JUNE 27, 1995, VARIOUS DOCUMENTS ARE USED BY THE CODE ENFORCEMENT OFFICERS IN EACH CASE AND ARE REPORTED IN THE CASE TESTIMONY GIVEN BY THE CODE ENFORCEMENT OFFICER. IN THESE MINUTES THE TITLES TO THOSE DOCUMENTS WILL BE ABBREVIATED AS FOLLOWS: NOCV-NOTICE OF CODE VIOLATION;NOH-NOTICE OF HEARING;SOV-STATEMENT OF VIOLATION(S);OOC-ORDER OF CONTINUANCE;AND POS-PROOF OF SERVICE. Building Clerk Harris administered the oath to Code Enforcement Supervisor Simon and Code Enforcement Officers Loeffler and Siegrist. HEARINGS ON STATEMENT OF VIOLATONS PURSUANT TO NOTICES OF HEARINGS Case 00-079 -Michael Gary Moody Estate, 44 Shell Key Court, Officer Loeffler Violation cited: 115-3 06-09-00 - NOCV Re-inspection Date: 06-20-00 06-26-00 - SOV 06-26-00 - NOH Meeting Date: 07-25-00 06-26-00 POS Mail (Z 203 423 364 & Regular - Moody Observation: Trash and debris, including battery, including Whirlpool stove. 2 Code Enforcement Board Minutes July 25, 2000 L Code Enforcement Officer Siegrist, having been sworn, gave a brief history of the Case and reported as of July 5, 2000, the property was in full compliance. Gia Lucas, having been sworn, stated that she is the representative of the Michael Gary Moody Estate. Mr. Moody passed away in December. Ms. Lucas asked if she could have clarification of "repeat offender". Chairman Linebarier advised the respondent if another offense occurs, even at a different address, the respondent will be considered a repeat offender. Vice-Chairman Lenko, seconded by Member Skiles, moved to find the respondents in Case 00- 079 in violation of Section 115-3 as of June 19, 2000, but in compliance as of July 5, 2000, and no fine or penalty be imposed. Motion carried 7-0. Case 00-080 - Francisco Lopez, 44 Shell Key Court Officer Siegrist Violation cited: 115-3 06-09-00 - NOCV Re-inspection Date: 06-20-00 06-26-00 - SOV 06-26-00 - NOH Meeting Date: 07-25-00 06-26-00 POS Mail Z 203 423 363 & Regular Mail- Lopez Observation: Trash and debris, including battery, including Whirlpool stove. Chairman Linebarier announced that there was no "proof of service" in Case 00-80 and asked for a motion to continue the case. Member Holmes, seconded by Vice-Chairman Lenko, moved to continue Case 00-080 until August 22, 2000, Code Enforcement Board Meeting. Motion carried 7-0. Case 00-082 - Charlene M. McCrea & David A. Code Enforcement Officer Loeffler, having been sworn, gave a brief history of the Case and stated as of June 29, 2000, the property was in full compliance. Respondent, Charlene M. Vice-Chairman Lenko, seconded by Member Skiles, moved to find the respondents in Case 00- 082 in violation of Sections 115-3 & 165-3, as of June 27, 2000, but in compliance as of June 29, 2000, second violation, and no fine or penalty to be imposed. Motion carried 7-0. Case 00-085 - Matrix Development Inc., 399-A Enterprise Street Officer Loeffler Violation cited: 51-21 A; 108-33 A(11) 06-13-00 - NOCV Re-inspection Date: 06-30-00 07-05-00 - SOV 07-05-00 - NOR Meeting Date: 7-25-00 07-05-00 - POS Mail Z 203 423 382 & Regular Mail- Matrix 07-05-00 - POS Mail - Dianne P. Code Enforcement Officer Loeffler, having been sworn, gave a brief history of the Case, and stated as of July 24, 2000, the property was in full compliance. Vice-Chairman Lenko, seconded by Alternate Member Solomon, moved to find the respondent in Case 00-085, in violation of Sections 51-21 A & 108-33 A(11), as of June 23, 2000, but in full compliance as of July 24, 2000, and no fine or penalty be imposed. Motion carried 7-0. OTHER BUSINESS Chairman Linebarier asked if the fine was paid by June 22, 2000, in Case 99-108. Building Clerk Harris stated the fine was paid and the Building Department is waiting on the return of the recorded copy. Chairman Linebarier announced that Cases 00-069 & 00-071 are in compliance. 1. Case 00-069- Michael A. What happened to that? Mrs. Simon said it is not August yet. Chairman Linebarier - None Member Chancey -None Alternate Member Solomon - None Member Skiles - None Member Konicek - None Member Holmes - Announced he will be resigning next month, is moving out of state.
