CODE ENFORCEMENT BOARD MEETING
February 23, 1999
CALL TO ORDER
Chairman Linebarier called the regular meeting of the Ocoee Code Enforcement Board to
order at 7:32 p.m. in the Commission Chambers of City Hall. He led in the pledge of
allegiance and in the prayer. The roll was called and a quorum declared present.
PRESENT: Chairman Linebarier, Vice Chairman Lenko, Members; Chancey, Holmes
(arrived at 9:09 p.m.), Konicek, Skiles, and Alternate Member Hall. Also
present were Attorney O'Quinn, Administrative Supervisor Seaver, Code
Enforcement Supervisor Simon, Code Enforcement Officers Loeffler and
Siegrist, and Administrative Secretary Cornell.
ABSENT: Member Ellison, who was excused and Alternate Member Tice resigned.
APPROVAL OF MINUTES OF JANUARY 28, 1998 MEETING
Chairman Linebarier noted that in the Minutes of the January 28, 1999, meeting should reflect
that the motion to move cases to the top of the agenda was made by Member Lenko and
seconded by Member Skiles.
thr Vice Chairman Lenko, seconded by Member Skiles, moved to approve the Minutes of the
January 28, 1999, Code Enforcement Board meeting as amended. Motion carried 6-0.
COMMENTS FROM CITIZENS

HEARINGS ON STATEMENTS OF VIOLATIONS PURSUANT TO NOTICES OF
HEARINGS
Vice Chairman Lenko, seconded by Member Skiles, moved, at the request of the City,
to have Case 99-054 continued to the March 23, 1999, and Cases 99-048, and 99-049 be
dismissed and to move Case 99-021 up to third on the agenda. Motion carried 6-0.
Chairman Linebarier requested a motion that the testimony for Cases 97-108 and 97-109 be
applied to both Cases.
Member Konicek, seconded by Member Skiles, moved to apply the testimony in Case 97-108
and Case 97-109 to both Cases. Motion carried 6-0

Observation: Dredging of Wetlands. No other history was provided.
Code Enforcement Supervisor Simon, having been sworn, gave a brief history of the above Cases
and presented pictures. A discussion ensued.
Leah Proffit, having been sworn, gave a brief history of the property and the investigation by the
Department of Environmental Protection. She stated that no restoration has been done on this
property. The berm and swale are fine, however there has been some displacement of water due to
the fill dirt used at this property. Irreparable damage can not be determined as the lake is still too
high to evaluate the damage. A discussion ensued.
Attorney O'Quinn inquired if Department of Environmental Protection would be resolving the "Fine
Order" with the homeowners.
Leah Proffit stated that a "Consent Order" would be issued through the Department of Environmental
Protection. This is a document which outlines restoration requirements, and it is an enforcement
document. It will be issued to the Contractor, George Bori, Groundtek (brother of Albert Bori). A
discussion ensued.
Attorney O'Quinn stated that the Florida Statutes, 162.09(2), provides for a one time fine of
$5,000.00 provided that the damage is irreparable or irreversible. Based upon the testimony tonight,
he did not feel that the Board can levy such a fine at this meeting.
Mr. Robert C. Reid, having been sworn, stated that the reason that the "fill" was put into that area
was to prevent damage to his retaining wall and swimming pool. He was unaware that a permit was
required to do this type of work. He also stated that he is willing to comply with the Board's
decision. He assured the Board that all of the aquatic vegetation has grown back just as it was before.
A discussion ensued.
Mr. Albert Bori, Groundtek, having been sworn, stated that he was willing to accept total
responsibility for this problem and that the person who had agreed to perform this work was no longer
with his business.
Member Skiles, seconded by Vice Chairman Lenko, moved in Case 97-108 and 97-109 to find the
respondents in violation of LDR Article VII, Section 7-4B, 51-21A,B and to issue a six month
extension which would run concurrently with the Department of Environmental Protection's
extensions. At the end of this period of time, that the Board be apprised of the results by the
Department of Environmental Protection. A discussion ensued. Motion carried 6-0.

Observation: Trailer with broken windows, dilapidated porch; debris; damaged and
missing interior floor and walls; roof and kitchen gutted; electric box missing.
Chairman Linebarier stated for the record that Ms. Wiggins had called him and asked him
what she should do about her property. He informed her that she should contact the Code
Enforcement office and request to be placed on tonight's agenda to explain her situation. He
stated that neither the merits of her Case nor the findings of the Board were discussed during
that telephone conversation.
Code Enforcement Supervisor Simon, having been sworn, gave a brief history of the Case.
Ms. Nancy Wiggins, 16770 Sand Hill Road, Winter Garden, Florida, was sworn in by Administrative
Supervisor Seaver and stated that she did not understand the notice that she received on her trailer.
She was also unaware that she needed to obtain a permit for the electrical work. She also indicated
that she had been in contact with Officer Siegrist in this matter and he had told her to continue to
work. A discussion ensued.
Member Lenko, seconded by Member Konicek moved to find the respondent in Case 99-021 in
violation of Section 108-35, but in compliance as of February 9, 1999, and to abate the
$200.00 per day fine from February 2, 1999, through February 9, 1999. Motion carried 6-0.
Chairman Linebarier reminded Ms. Wiggins that she still needs to have a Final Inspection and
should any if these violations listed on the original form come up again, any penalty from that citation
could be imposed from the day that they are first seen. The penalty would be imposed as of the day
of the violation.

discussion ensued.
Vice Chairman Lenko, seconded by Alternate Member Hall, moved to find the respondents in

26, 1998, and that they be given until March 2, 1999, to come into compliance or be fined

Code Enforcement Officer Siegrist, having been sworn, gave a brief history of the Case. A
discussion ensued.
Chairman Linebarier requested the Final Compliance date in this Case. As he was unable to provide
the information without getting the file, Officer Siegrist left the room to get the file and verify the
dates. Upon his return, he submitted photographs. Officer Siegrist had a lengthy discussion with
Supervisor Simon, and it was determined that he was still unsure of the exact date of Final
Compliance.
Vice Chairman Lenko, seconded by Alternate Member Hall, moved to continue Case 99-016 until the
March 23, 1999, meeting at the request of the City. Motion carried 7-0.

respondent until March 9, 1999, to come into compliance or impose an Order to Impose Fine and Lien
for$150.00 per day. A brief discussion ensued. Motion carried 7-0.

Observation: Weeds, grass over ten (10) inches high
Code Enforcement Officer Siegrist, having been sworn, gave a brief history of the Case. A
discussion ensued.
Vice Chairman Lenko, seconded by Member Skiles, moved that the respondents in Case 99-
027 be found in violation of Section 115-5 and to impose an Order Imposing Fine and Lien
effective February 3, 1999. Motion carried 7-0.
Chairman Linebarier stated that in Case 95-115, Martha Medina, 602 Melva Avenue, the
respondents paid the penalty of$2,000.00 which was reduced from $91,000 provided it was
paid within a 90-day period. Case 99-102, 701 Butterfly Creek Drive, paid a fine of
$2,700.00. A discussion ensued.
COMMENTS:
Administrative Supervisor Seaver - None
Attorney O'Quinn - Introduced a suggestion by the Mayor in which the City may want to look
at "ticket" type system, essentially like a traffic ticket. This may assist citizens in
providing them with additional incentives to keep their property in compliance with the City of
Ocoee's Codes. A discussion ensued.
Supervisor Simon - commented on the Mayor's suggestion of a "ticket" type system and she
stated that she felt she would like to stay consistent with the City of Ocoee's current methods

which is also the same method that is used by the City of Orlando. A discussion ensued.

Member Skiles - Inquired about the shirts for the Board. A brief discussion ensued.
Vice Chairman Lenko - Wanted to know when the Board would receive their Land
Development Regulation Books. Administrative Supervisor Seaver stated that the City
Clerk's office was looking into providing copies. Chairman Linebarier stated that if it was
not possible to get the entire book to at least copy those sections that pertain to the Code
Enforcement Board issues. A discussion ensued.
Alternate Member Hall - Thanked the Board for the opportunity to sit on the Code
Enforcement Board and he expressed appreciation for the Code Enforcement Officers. A brief
discussion ensued regarding Member Hall's experience.

Member Holmes - Thanked the City of Ocoee for the Volunteer Dinner.
