HomeMy WebLinkAbout04-28-1998 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING HELD ON APRIL 28, 1998 CALL TO ORDER Chairman Carlsson called the regular meeting of the Ocoee Code Enforcement Board to order at 7:30 p.m. in the Commission Chambers of City Hall and led in the pledge of allegiance. Vice Chairman Linebarier led in prayer. The roll was called and a quorum declared present. PRESENT: Chairman Carlsson, Vice Chairman Linebarier, Members Holmes, Lenko, Luck, Skiles, Alternate Members Chancey and Ellison. Also present were Attorney O'Quinn, Code Enforcement Officers Cronnon, Smith, and Code Enforcement Supervisor Simon, Executive Secretary Seaver, and Administrative Secretary Lewis. ABSENT: Member Godek (excused). APPROVALS This item consisted of the Minutes of the March 24, 1998 Code Enforcement Board meeting. Member Skiles said that his absence should have been "excused" rather than unexcused, and under APPROVALS he could not have voted when being absent from the meeting. In response to Secretary Lewis, Member Lenko said that she had seconded the motion to thiw approve the Minutes of the February 24, 1998 Code Enforcement Board meeting while she had been absent and should not have voted. VICE CHAIRMAN LINEBARIER, seconded by MEMBER SIULEs moved to a.'rove the Minutes o the March 24 1998 Code En orcement Board meeting as corrected. Motion carried 6-0._ As they had been absent from the meeting, Member Skiles and Alternate Member Ellison did not vote. COMMENTS FROM CITIZENS None CHAIRMAN CARLSSON said if there was no objection, the chair proposes at this time to proceed to Case No. 98-064, David A. and Kathryn O. Boyer, and Case No. 98-065, Elena V. Davis. Without objections, CHAIRMAN CARLSSON proposed to first hear Case Nos. 98-064 and 98- 065. PUBLIC HEARINGS OF NEW CASES PURSUANT TO NOTICES OF HEARING -The following cases as written in these minutes will use abbreviations to describe the violation(s) and the dates of inspection(s) at the beginning of each case. Code representation: NOCV - Notice of Code Violation; NOH - Notice of Hearing; SOV - Statement of Violation(s); and POS - Proof of Service. At the request of Chairman Carlsson, Code Enforcement Officers Cronnon, Smith, and Supervisor Simon were sworn in by Executive Secretary Seaver. Code Enforcement Board Meeting April 28, 1998 Vice Chairman Linebarier said on item G and H, that he needed to qualify his position in Case Nos. 98-064 and 98-065. He knew both parties personally, has had personal conversation, and the respondents had discussed the cases with him. In some cases they had asked for possible guidance and he had suggested they contact the Code Enforcement Officers involved in the case. Both respondents were his friends. Attorney O'Quinn said that he felt confident that Mr. Linebarier would be able to make a decision tonight based upon what he hears during the meeting, and not on terms of conversation. He did not believe that the City would have any objection. 98-064, DAVID A. AND KATHRYN O. Kathryn O. Boyer, 611 Palomas Avenue, was sworn in by Executive Secretary Seaver, and stated that she had applied with the City to do business at that address. Ms. Boyer expressed her frustration about not getting the issue resolved, and said that she believed she was not getting any cooperation (from Protective Inspections). Officer Smith presented the following: • Exhibit "N" - Florida Statute §482.071 Licenses. Lengthy discussion ensued about this case. At the request of Chairman Carlsson who announced that a citizen wished to speak, Attorney 6 Code Enforcement Board Meeting April 28, 1998 O'Quinn cautioned the Board by saying that he did not think it was appropriate for them to permit this at this time but it was at the discretion of the Board. He also said that the Board should make their decision based upon the evidence presented before them. Several members of the Board wanted to hear from Scott Anderson. Scott Anderson, 510 Orange Avenue, expressed his objections, and said that Protective Inspections had spent a lot of time, effort, man hours, and attorney fees to condemn the property. He said as it was not a token charge, that the Board was putting the fines there to place some "bite" for remaining in violation. The respondent was making money even though it had been an inferior structure. As a citizen of Ocoee, he could not see having taxpayers paying for all this with nothing returning to the City. Several motions were made that failed but the motion made by Member Holmes was carried with approval by the Board. Member Holmes seconded b Vice Chairman Linebarier moved to reduce the fine from $5,800 to $2,900 in Case No. 95-147, Mid-State Apartments, to be paid by May 12, 1998, 5:00 p.m. or the fine will revert back to $5,800. On roll call, Members Holmes, Lenko, Luck, Chairman Carlsson, and Vice Chairman Linebarier voted "aye," and Member Skiles and Alternate Member Chancey voted "nay." Motion carried 5-2. Bill Simon, Waterside Subdivision, asked to speak, and Attorney O'Quinn said that this was outside the scope of jurisdiction at this particular time in hearing testimony from the public. The time for the public hearing had passed on this case, and Mr. O'Quinn said that he wanted it on the record should it come up later. The Board wanted to hear from Mr. Simon who explained that as a Police Officer employed by the City, that nearly a full force was at the property in violation when the City was enforcing the law by removing people from the condemned building. Vice Chairman Linebarier said for the record, that if the fine was not paid by May 12, 1998, it will revert to $5,800. Vice Chairman Linebarier asked for a copy of the Order Imposing Fine and Lien in Cases No. 98-037 and Case No. 98-049. In response to Mr. Linebarier, Executive Secretary Seaver said that the fine had been paid in Case No. 98-056. COMMENTS Commissioner Anderson thanked the Board for listening to him. He said that the City was not in a position of making money on fines like this. Commissioner Parker said that the Board was doing a fine job. Police Officer Simon said that the Board was doing a great job even though they had a lot on them. Executive Secretary Seaver: None Member Holmes: 1. Thanked the City for having Attorney Hamilton present the seminar on Code Enforcement. 2. Thanked the recording secretary for hanging in there. 3. Announced that the next meeting date would fall next to Memorial Day. 4. Wished everyone a `Happy Memorial Day"! Member Lenko asked that the POS form include: 1) Description of the violation. 2) Repeat violation. 3) Proof of Service will be provided by the Inspector at each case. Supervisor Simon explained the Code Enforcement Officers would provide the POS during their statement for a case such as whether the card was mailed, the date of receipt if received or whether it had been hand delivered. iby Member Luck said that the Board packet could be placed at the dais rather than delivering it. Member Skiles commended Code Enforcement on the cover sheet, and Officer Smith on presentation of case during meeting. Alternate Member Chancey: None Alternate Member Ellison: None Vice Chairman Linebarier announced that he liked the new docket sheet. Chairman Carlsson thanked everyone for coming to the meeting. It is unlawful for any person to operate a pest L` control business that is not licensed by the department. (a) Before entering business or upon transfer of business ownership. and also annually thereafter. on or before an anniversary date set bv the department for each licensed business location, each person. partnership. firm. corporation. or other business entity engaged in pest control must apply to the department for a license, or a renewal thereof. for each of its business locations. Applications must be made on Corms prescribed and furnished by the department. (b) The department shall establish a fee for the issuance of a license. which fee may not be more than 5300 or less than S75. and a fee for the renewal of a license. which fee may not be more than S300 or less than S75: however, until rules setting these fees are adopted by the department. the issuance fee and renewal fee shall each be S75. After a grace period not exceeding 30 calendar days following the anniversary renewal date. the department shall assess a late renewal charge of$50. which must be paid in addition to the renewal fee. The aggregate of the fees assessed pursuant to this paragraph may not exceed 105 percent of the direct costs for administering this chapter. (c) Unless timely renewed. a license automatically expires 60 calendar days after the anniversary renewal date. Subsequent to such expiration. a license may be reinstated only upon reapplication and payment of the issuance fee and the late renewal fee. (d) A license automatically expires when a licensee changes its business location address or its business name as registered with the department. The department shall issue a new license for the remainder of the term upon payment of a fee of S25. (e) The department may not issue or renew a license to engage in the pest control business unless the applicant's pest control activities are under a certified operator or operators in charge who are certified in the categories of the licensee. (0 The department by rule may establish a procedure for expediting the processing of an application for license upon payment by the applicant of a special fee in an amount sufficient to cover the cost of such expedited process. but not exceeding S50. (g) The department may deny the issuance of a pest control business license to any applicant. or refuse to renew the license of any licensee. if the department finds that the applicant or licensee or any of its directors. officers. owners. or general partners are or were directors. officers. owners. or general partners of a pest control business which has gone out of business or sold the business to another party within 5 years immediately preceding the date of application or renewal and failed to reimburse the prorated value of its customers' remaining contract periods or failed to provide for another licensed pest control operator to assume its existing contract responsibility. ♦r (3) A licensee shall display its current license at each of its business locations.
