HomeMy WebLinkAbout08-25-1998 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING August 25, 1998 CALL TO ORDER Chairman Carlsson called the regular meeting of the Ocoee Code Enforcement Board to order at 7:30 p.m. in the Commission Chambers of City Hall and led in the pledge of allegiance. Vice Chairman Linebarier led in prayer. The roll was called and a quorum declared present. PRESENT: Chairman Carlsson, Vice Chairman Linebarier, Members Holmes, Lenko, Skiles, Alternate Ellison. Also present were Attorney Feeney, Code Enforcement Supervisor Simon, Executive Secretary Seaver, and Administrative Secretary Weatherly. ABSENT: Member Godek--Nei Excused, Alternate Member Chancey - Excused, Member Luck- Excused/Resigned APPROVAL OF MINUTES Chairman Carlsson stated that on Page 1 Member Ellison should be included as present; and on Page 3 Case No. 98-085 states AObservation: engine lift installed,@ and should read Acar lift installed.@ Also, on Page 7 states Amodular homes no more than 5 years,@ and should state Amodular homes no more than 5 years old.@ Member Lenko, seconded by Member Ellison, moved to approve the Minutes of the July 28, 1998 Code Enforcement Board meeting as corrected. Motion carried 6-9-5-0. COMMENTS FROM CITIZENS Commissioner Howell addressed the board on the subject of the minimum standards codes for the mobile home parks, stating that some of these homes are a hazard and are unsafe. Commissioner Howell asked the the board to consider recommending a solution to the Commission. Chairman Carlsson asked Commissioner Howell if he received the letter in reference to the manufactured homes. Commissioner Howell stated that he did receive it. During a discussion regarding limiting the age of mobile homes, Vice Chairman Linebarier stated that trying to set rules on how old a mobile home should be would be treading on dangerous ground with the residents of mobile homes. He said that, as long as a mobile home is not in a condemnable state, the board may not have the right to do this. Chairman Carlsson stated that this had nothing to do with any existing mobile homes, but rather when a mobile home is moved from the lot and another one put in, then the new mobile home should be five years or under. Code Enforcement Board August 25, 1998 err Code Enforcement Supervisor Simon stated that a requirement that the utilities be in the tenant's name would allow the City to inspect more often. Vice Chairman Linebarier stated that such a requirement would have to apply for all rental properties in the City of Ocoee. Member Ellison stated that in Section 8 the new tenant has to have the utilities turned on in the tenant's name. After lengthy discussion, the board agreed that tenants of mobile homes should be required to turn on utilities in their name instead of the landlord's name, which would allow the City to have more inspections. There was no action taken. CASES CONTINUED AND DISMISSED Vice Chairman Linebarier, seconded by Member Lenko, stated that Case 98-073, Rene and Viviane Mestdagh will be continued to the September 22, 1998 meeting, and Case 97-108, Robert Reid; Case 97-109, Groundtek of Central Florida; Case 97-110, Patrick Freeman; and 97-111, Groundtek of Central Florida will be continued to the January 26, 1999 meeting at the request of the City. Under Item II; Case 98-099, Mahendra N. Samaroo will be dismissed at the request of the City. Motion Carried 6-0. Member Holmes arrived at 7:45 p.m. PURSUANT TO THE HEARING RULES ADOPTED BY THIS BOARD ON JUNE 27, 1995, VARIOUS DOCUMENTS ARE USED BY THE CODE ENFORCEMENT OFFICERS IN EACH CASE AND ARE REPORTED IN THE CASE TESTIMONY GIVEN BY THE CODE ENFORCEMENT OFFICER. IN THESE MINUTES THE TITLES TO THOSE DOCUMENTS WILL BE ABBREVIATED AS FOLLOWS: NOCV-NOTICE OF CODE VIOLATION;NOH-NOTICE OF HEARING;SOV-STATEMENT OF VIOLATION(S);AND POS-PROOF OF SERVICE. Case 98-100, Metropolis Homes Company - 1501 Prairie Lake Boulevard Siegrest Section 115-3 08/07/98-NOCV-Re-Inspection Date: 08/17/98 08/17/98 NOH Board Meeting Date: 08/25/98 08/12/98-Compliance Date 08/17/98-SOV 08/18/98-POS POS-Delivery-MAIL CERT#Z057-385-000 Observation: Wood trusses stored on vacant lot. Exhibit "A" - Photo of Wood trusses on vacant lot at 1501 Prairie Lake Blvd. Officer Siegrest, representing the Code Enforcement, having been sworn and stating qualifications, made a statement. Chairman Carlsson stated that no one was here to represent the case. Vice Chairman Linebarier, seconded by Member Lenko, moved to find Case No. 98- 100, Metropolis Homes Company, in violation of Section 115-3, wood trusses stored on vacant lot as of August 12, 1998 but in compliance as of August 24, 1998 and no penalty imposed. Motion carried 6-0. Code Enforcement Board August 25, 1998 OTHER BUSINESS Case 98-085, Mahmoud Y. Chatila; and Case 98-086, One Stop Car Care; are Affidavits in Compliance. Chairman Carlsson stated that Member Luck has turned in his letter of resignation from the Code Enforcement Board. He accepted this with deepest feelings and said the letter will be turned in to the City Commission. Chairman Carlsson, seconded by Vice Chairman Linebarier, moved to recommend that Alternate Member Chancey replace Member Luck. Motion Carried 6-0. COMMENTS Member Lenko -No Comments Member Holmes announced that he went to Tampa to see the Orlando Predators game this weekend and the Orlando Predators won. He wished everyone a happy Labor Day. Member Skiles -No Comments Member Ellison -No Comments Vice Chairman Linebarier asked Attorney Feeney what he thought of the proposal made to Commissioner Howell about requiring all the tenants or residents of rental property to have utilities in their name instead of the landlord's name. Attorney Feeney stated that this is a very complicated legal area, as the issue is 4th Amendment rights, rather than just dealing with peoples' homes and property rights. Mr. Feeney stated that Member Ellison pointed out that there are some federal programs that require the resident to be the actual applicant under section 8 government. He added that the board has done the right thing by advising the City Commission of the problem. ADJOURNED At 8:05 p.m. the meeting was adjourned.
