HomeMy WebLinkAbout02-25-1997 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING HELD ON FEBRUARY 25, 1997 CALL TO ORDER Chairperson Carlsson called the regular meeting of the Ocoee Code Enforcement Board to order at 7:32 p.m. in the Commission Chambers of City Hall and led in the pledge of allegiance. Code Enforcement Officer Conyers led in prayer. The roll was called and a quorum declared present. PRESENT: Chairperson Carlsson, Members Holmes (arrived late), Lenko, Shagner, and Skiles. Also present were Attorney O'Quinn, Code Enforcement Officer Conyers, Deputy Clerk Cronnon, Executive Secretary Seaver, and Clerk/Stenographer Lewis. ABSENT: Vice Chairperson Linebarier, Member Chestney, and Alternate Member Godek (all absences were excused). APPROVALS This item consisted of the Minutes of the January 28, 1997 Code Enforcement Board meeting. Member Shagner, seconded by Member Lenko, moved to approve the Minutes of the January 28, 1997 Code Enforcement Board meeting as presented. Motion carried 4-0. Clerk Stenographer Lewis reported for the record that a note had been distributed to the Board Members tonight regarding a written list of cases that had been dismissed during the meeting of November 26, 1996. The list of dismissals had been presented to the Board prior to the November meeting and there had been no discussion regarding those cases. Ms. Lewis said that for the sake of research, the note was being attached to the minutes of the November Board meeting. Member Shagner, seconded by Member Lenko, moved to approve the attachment from Clerk Stenographer Lewis dated February 25, 1997 regarding the dismissal of cases during the November meeting, to the minutes of November 26, 1996 Code Enforcement Board meeting. Motion carried 4-0. COMMENTS FROM CITIZENS None PUBLIC HEARINGS OF NEW CASES PURSUANT TO NOTICES OF HEARING - The following cases as written in these minutes will use abbreviations to describe the violation(s) and the dates of inspection(s) at the beginning of each case. Code representation: NOCV - Notice of Code Violation; NOH - Notice of Hearing; SOV - Statement of Violation(s); and POS -Proof of Service. Mc/dock SNA6eVe r, seconded by Alternate Member Skiles, moved that Case No. 96-115, Geneva Walls, 97-010, Ryland Homes, and 97-011, Pizzuti Development, be stricken from the agenda as they had been dismissed by the City. Also, that Case No. 96-117, Katherine Code Enforcement Board Meeting February 25, 1997 Burns, 96-128, Sonja Green, and 97-004, Sumac Partners, be continued at the request of the City to the next meeting. Motion carried 4-0. Member Holmes arrived to the meeting at 7:38 p.m. At the request of Chairperson Carlsson, Code Enforcement Officer Conyers was sworn in by Deputy Clerk Cronnon. 97-002, BETTY PEDRICK - 104 Mobile Lane 01/10/97 NOCV - Re-inspection Date:01/28/97 02/06/97 NOH - Board Meeting Date:02/25/97 02/06/97 SOV 02/06/97 POS - Mail Cert#P150-529-095 Chairperson Carlsson said for the record that no one was present to represent the case. Code Enforcement Officer Conyers said due to Non-Proof of Service, that the City was asking the Board to continue this case. Member Shagner, seconded by Member Skiles, moved to continue Case No. 97-002, Betty Pedrick, to the next meeting. Motion carried 5-0. 97-003, HERNANDEZ, GERTRUDIS - 104 Mobile Lane 01/10/97 NOCV - Re-inspection Date:01/28/97 02/06/97 NOH - Board Meeting Date:02/25/97 02/06/97 SOV 02/06/97 POS - Mail Cert#P150-529-096 Chairperson Carlsson said for the record that no one was present to represent the case. Code Enforcement Officer Conyers testified that on December 4, 1996, he had observed missing skirting, missing 3" numbers for the address, and miscellaneous trash and debris in the yard. A community information notice had been left on the door advising the resident to install the missing skirting, attach the numbers to the home where they would be clearly visible from the street, and to remove the miscellaneous trash and debris from the yard. This notice gave the respondent five (5) days to correct these violations. A re-inspection on December 12, 1996 revealed that the property remained in non-compliance. On January 10, 1997, an NOCV was sent to the tenant as identified by City water records, Gertrudis Hernandez, for violation of 108- 23. General requirements for the exterior and interior of structures: "(C) Skirting." Also, 54-3 display required: responsibility for posting:desixn requirements: "All buildings shall have the assigned building number properly displayed, whether or not mail is delivered to the building. The posting of the building number shall be the responsibility of both the owner and the occupant of the building;" Also, Chapter 115-2 Creation Prohibited: "No person shall dump or cause to be dumped or place or cause to be placed on any lands or premises within the city any nuisance and menace to public health." The respondent was given until January 24, 1997 to come into compliance with these Codes. On January 28, 1997, a re-inspection revealed that the property remained in non-compliance, and the case file was given to the Clerk to process for Board action. Re-inspections on February 19, 24, and 25, 1997, found the property was still in non-compliance. Officer Conyers said that one (1) inch numbers (not 3") had been placed on the home, a section of the skirting was not attached properly, and trash and debris remained in the rear yard. Attorney O'Quinn asked that the Board disregard remarks made by Member Shagner about the property in question. Member Skiles moved to find Hernandez Gertrudis, Case No. 97-003, in violation of 108-23 (C): Skirting, 54-3 Display Required, Chapter 115-2, 2 Code Enforcement Board Meeting February 25, 1997 Creation Prohibited, as of January 24, 1997, and be given until March 17, 1997, to correct the violations or be fined $50 a day thereafter. Motion died for the lack of a second. Discussion ensued about the dates involved with the violations, and Member Lenko, seconded by Member Shagner, moved to find Hernandez Gertrudis, Case No. 97-003, in violation of 108-23 (C): Skirting, 54-3 Display Required, Chapter 115-2, Creation Prohibited, as of January 24, 1997, and be given until March 7, 1997 to correct the violations or be fined $50 a day thereafter. Motion carried 5-0. 97-007, BETTY PEDRICK - 45 Shell Key Court 01/08/97 NOCV - Re-inspection Date:01/21/97 02/05/97 NOH - Board Meeting Date:02/25/97 02/05/97 SOV 02/05/97 POS - Mail Cert#P882-518-692 Chairperson Carlsson said for the record that no one was present to represent the case. Code Enforcement Officer Conyers testified that on October 10, 1996, he had observed skirting which needed replacing or repair. On January 7, 1997, an NOCV was sent to the property owner as identified by Orange County Tax Records, Betty Pedrick, for violation of 108-23. General requirements for the exterior and interior of structures: (B) Skirting. "Existing skirting shall be maintained free from broken or missing section(s),pieces or cross members. Skirting shall be securely attached and sized from the ground to the lower outside perimeter of the structure. All mobile homes moved into the city shall have the undercarriage,piers and tie-down straps protected and hid from view by approved skirting. Existing mobile homes shall have approved skirting installed by no later than six (6) months after the adoption of this chapter." Also, (C)Replacement skirting. "Replacement or new skirting shall be approved skirting and shall be constructed of materials intended for exterior use and properly sized and mounted to prevent free access to the crawl space of the structure. Crawl space access grille or door and ventilation grilles shall be sized according to local code requirements. All approved skirting shall be installed according to the manufacturer's specifications and/or applicable provisions of the Ocoee City Code." The respondent was given until January 16, 1997, to come into compliance. On January 21, 1997, a re-inspection revealed that the property remained in non-compliance. On January 22, 1997, the case file was given to the Clerk to process for Board action. A re-inspection on February 10, 1997, found the property was still in non- compliance. On February 19, 1997, a re-inspection revealed that the violations had been brought into compliance. Member Lenko, seconded by Member Holmes, moved to find Betty Pedrick, Case No. 97-007, in violation of 108-23 (B) Skirting, (C): Replacement skirting, as of Janua 16 1997 but in corn.liance as of Februa 19 1997 and that no fine be assessed. Motion carried 5-0. 97-008, FAIR, CLYDE R. ESTATE OF (C/O LOIS L. LOPEZ) - 36 Coquina Key Drive 01/08/97 NOCV - Re-inspection Date:01/23/97 02/05/97 NOH - Board Meeting Date:02/25/97 02/05/97 SOV 02/05/97 POS - Mail Cert#P150-529-091 Chairperson Carlsson said for the record that no one was present to represent the case. Code Enforcement Officer Conyers testified that on November 19, 1996, he had observed the grass by the fence and trailer to be too high. Also, the skirting needed to be repaired or replaced. On January 8, 1997, an NOCV was sent to the property owner as identified by Orange County Tax Records, the Estate of Clyde R. Fair, % Lois Lopez, for violation of 108-23. The grass had been mowed but the skirting was not properly attached to the (trailer). On January 22, 1997, the case file was given to the Clerk to process for Board action. On February 10, 1997, a re-inspection found the north side but not the south side skirting had been installed. A re-inspection on February 24, 1997, revealed that the property had been brought into compliance with the violation. Member Shagner, seconded by Member Lenko, moved to find Betty Pedrick, Case No. 97-007, in violation of 108-23 (B) Skirting, (C): Replacement skirting, as of January 20, 1997, but in compliance as of February 24, 1997, and that no fine be imposed at this time. Motion carried 5-0. Chairperson Carlsson said that a letter had been presented to the Board from Attorney Winter requesting a re-hearing in this case. Attorney O'Quinn said that the letter would become a part of the record. Deputy Clerk Cronnon was sworn in by Clerk Stenographer Lewis, and testified that the City had received the letter from Mr. Winters, and that the fine was $7,000 with a continual running. Lengthy discussion ensued about the time for requesting a re-hearing and the date of the petition which appeared as January 28, 1996 rather than 1997. Attorney O'Quinn said that they could go by the City's clock-in date of February 5, 1997. In response to Attorney O'Quinn, Deputy Clerk Cronnon said that the Board had taken action on June 25, 1996, to issue an Order Imposing Fine and Lien. Attorney O'Quinn said that he thought that it would be appropriate for the Board to table this request until the next meeting to make sure that it was properly done. Member Lenko, seconded by Member Shagner, moved to table the decision to re-hear Case No. 96-45, Mauricia Fabian DeMeran & Ana Hernandez Fabian, until the March meeting pending the attorney's opinion of the timeliness of the application for re-hearing. COMMENTS City Manager: Absent Code Enforcement Officer Conyers: None Deputy Clerk Cronnon announced that this would be her last meeting as the Deputy Clerk as she would be appearing as a Code Enforcement Officer at the next meeting. Sherry Seaver will return as Deputy Clerk to the Board. Police Department: None BOARD MEMBERS Member Holmes announced that he was wearing his Cub Scout uniform this evening in observance of the 87th Anniversary of Boys Scout this month. He congratulated Mayor Vandergrift for his apparent victory in the election (for Mayor), and extended best wishes and good luck to Mr. Linebarier in the upcoming runoff for Commissioner. Member Shagner encouraged staff to use more photographs or videos of properties in violation. ,,, 6 Code Enforcement Board Meeting February 25, 1997 Member Lenko congratulated Commissioner Glass, a former Code Enforcement Board member, on winning the District 3 race again for Commissioner. Member Skiles said that he would second Member Holmes' comments. Attorney O'Ouinn said that he would have a ruling on Case No. 96-45 for the next meeting. Chairman Carlsson thanked everyone for coming to the meeting. ADJOURNMENT At 8:23 p.m., the meeting was adjourned.
