HomeMy WebLinkAbout05-27-1997 Minutes (OrMINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING HELD ON May 27, 1997 CALL TO ORDER Chairperson Carlsson called the regular meeting of the Ocoee Code Enforcement Board to order at 7:30 p.m. in the Commission Chambers of City Hall and led in the pledge of allegiance. Member Linebarier led in prayer. The roll was called and a quorum declared present. As Member Holmes had been delayed, Alternate Member Chancey took his place. There were no objections. Chairperson Carlsson welcomed back Attorney Thomas Feeney and welcomed City Manager Shapiro and said that Member Lenko was unable to attend this meeting. PRESENT: Chairperson Carlsson, Vice Chairperson Linebarier, Members Godek, Homes (arrived at 7:35), Shagner, Skiles and Alternate Members Chancey and Luck. Also present were City Manager Shapiro, Attorney Feeney, Code Enforcement Officers Cronnon and Simon, Executive Secretary Seaver, Building Clerk Harris, Building & Zoning Official Flippen and Clerk/Stenographer Rivera. ABSENT: Member Lenko (absence excused). APPROVAL OF APRIL 22, 1997 MEETING MINUTES Member Godek, seconded by Member Shagner, moved to approve the Minutes of the April 22, 1997 Code Enforcement Board meeting as presented. Motion carried 5-0. (Vice Chairman Linebarier and Member Skiles abstained from voting as they had not attended the last meeting). Code Enforcement Officer Cronnon displayed a video of the property in violation for review by the Board and testified that on January 14, 1997, Officer Conyers had observed the skirting which needed repairing or replacing. On March 24,1997, an NOCV was sent to the property owner as identified by Orange County Tax Records, Eugene Tucker Estate and Mary L. French, for violation of 108-23. General requirements for the exterior and interior of structures: (B)Skirting. "Existing skirting shall be maintained free from broken or missing sections, pieces or cross members. Skirting shall be securely attached and sized from the ground to the lower outside perimeter of the structure. All mobile homes moved into the city shall have the undercarriage, piers and tie-down straps protected and hid from view by approved skirting. Existing mobile homes shall have approved skirting installed by no later than six (6) months after the adoption of this chapter." Officer Cronnon stated that on April 10, 1997, a re-inspection revealed that the property remained in non-compliance. Due to non proof of service, this case was continued until May 27, 1997. On May 8, 1997, an NOH was posted, and on May 27, 1997, a re-inspection revealed that the property remained in non-compliance. Member Linebarier, seconded by Member Shagner, moved to find the Eugene Estate and Mary L. French Case 97-028 in violation of Chapter 108-23-B, lack of skirting on the mobile home, and give them until June 10, 1997 to comply or be fined $50.00 per day thereafter. Motion carried 7-0. 97-035,MICHAEL C. PAYMENT -905 Russell Court 03/12/97 NOCV-Re-inspection Date: 04/15/97 05/07/97 SOV 05/07/97 NOH-Board Meeting Date: May 27, 1997 05/07/97 POS-Mail Cert#P882-518-838 Chairperson Carlsson said for the record that no one was present to represent the case. Code Enforcement Officer Cronnon testified that on March 11, 1997, she observed dead tree limbs in the yard, a dilapidated fence and a green pool. She gave a community information notice with a re-inspection date of March 12, 1997, to the tenant, Janice Johnson. On March 12, 1997, a re- inspection revealed the tree limbs were moved, but the fence was still in need of repair and the pool was still green. On March 12, 1997,the clerk sent the property owner, Michael C. Payment, as identified by Orange County Tax Records an NOCV for violation of Chapters 115-3 Creation Prohibited: "No person shall allow to be dumped,placed, accumulated or otherwise located on lands or premises owned by such person within the City any nuisance and menace to public health, safety and welfare, etc. 158-31 Design requirements: (D) Every pool hereafter constructed or repaired shall be equipped with a filtration system designed to filter and re-circulate the entire volume of the pool capacity during a sixteen-hour period. 158-31 Design requirements: (F)All pools shall be completely enclosed by a screen enclosure, a link-type fence or a solid wall as approved by the Building Official of a minimum height of forty-eight(48) inches, the gates of which shall be the self-closing and latching type, with a latch on the inside of the gate or enclosure located at least forty-six (46) inches above the ground. The respondent was given until March 26, 1997, to come into compliance. On March 27, 1997, a re-inspection revealed that the pool was blue, but the pump was still broken. The fence was temporarily secured with nails and the limbs were removed. An extension was given until April 15, 1997 to repair the pump. On April 16, 1997, a re-inspection of the property revealed that the pool was green again and the fence was still in need of repair. On May 7, 1997, an NOH was sent, restricted delivery, for the May 27, 1997, Board meeting by L 2 Code Enforcement Board Meeting May 27, 1997 the Clerk of the Board. On May 13, 1997, a re-inspection was requested by the property owner and the inspection revealed that the property was in compliance. Member Shagner, seconded by Member Luck, moved to find Michael C. Payment, Case No. 97-035, in violation of Chapter 115-3, Creation Prohibited, Chapter 158-31, Design requirements: (D) and Chapter 159-31, Design requirements: (F) as of April 16, 1997, but in compliance as of May 13, 1997, and that no fine be imposed at this time. Motion carried 7-0. 97-037,Asher and Margaret Longrie- 1219 Baranova Road 04/04/97 NOCV-Re-inspection Date:04/15/97 05/07/97 SOV 05/07/97 NOH-Board Meeting Date: May 27, 1997 05/07/97 POS-Mail-Cert#P882-518-534 Chairperson Carlsson said for the record that no one was present to represent the case. Code Enforcement Officer Cronnon testified that on October 1, 1996, Code Enforcement Conyers did a minimum housing inspection, and due to his not getting a re-inspection, it turned into an NOCV, which was sent on April 4, 1997, to Asher and Margaret Longrie, property owners as identified by Orange County Tax Records, for violation of 108-23. General requirements for the exterior and interior of structures: (R)(1)Every floor, interior wall and ceiling shall be substantially rodent proof shall be kept in sound condition and good repair and shall be safe to use and capable of supporting the load which normal use may cause to be placed thereon. Repair ceiling in garage. (M) Exterior doors. (2) Every exterior door shall be provided with properly installed hardware that is maintained to ensure reasonable ease of operation to open, close and secure in an open or closed position as intended by the manufacturer of the door and the attached hardware. Repair sliding glass door (does not lock). 108-22. Minimum requirements for electrical systems. Every electrical outlet and fixture, all wiring and equipment shall be installed, maintained and connected to a source of electric power in accordance with the provisions of the Electrical Code of the authority having jurisdiction. Replace/repair any missing/broken receptacles/switch plates, install interior light fixtures in closets and install exterior light fixtures. 108-24, Sanitation Requirements. (D) Care of premises. It shall be unlawful for the owner or occupant of a residential building, structure or property to utilize the premises of such residential property for the open storage of any abandoned motor vehicle, ice box, refrigerator, stove, glass, building material, building rubbish or similar items. It shall be the duty and responsibility of every such owner and occupant to keep the premises of such residential property clean and to remove from the premises all such abandoned items as listed above, including but not limited to weeds dead trees, trash, garbage, etc., upon notice pursuant to this chapter. Remove all miscellaneous trash/debris in back and side yard(wood,aluminum,swing set). (E) Extermination. Every occupant of a single dwelling and every owner of a building or structure containing two(2) or more dwelling units shall be responsible for the extermination of any insects, rodents or other pests within the building or premises. Exception: Extermination of wood-destroying organisms shall, in all cases, be the sole responsibility of the building owner. Exterminate home. On May 23, 1997, tenant called for re-inspection. Upon re-inspection the property was found to be in non-compliance. Member Shagner, seconded by Member Skiles, moved to find Asher and Margaret Longrie., Case No. 97-037 in violation of 108-23 (R) & (M), Chapter 108-22, minimum requirements for electrical systems, 108-24 (D) & (E), as of May 23, 1997, and be given until June 27, 1997, to correct the violations or be fined$100.00 a day thereafter. Motion carried 7-0. Chairperson Carlsson opened the motion for discussion. L 3 Code Enforcement Board Meeting May 27, 1997 tikor Member Linebarier questioned the violation date being that it should have been April 14, 1997. Code Enforcement Officer Cronnon explained that this was a minimum housing inspection where the tenant had 60 days to come into compliance so they would have had until February 11, 1997 to come into compliance. Mr. Linebarier said that the report stated the tenant was given until April 14th to comply, so as of that date they would be in violation. Member Linebarier, seconded by Member Shagner moved to amend the motion to change the violation date from May 23, 1997,to April 14, 1997. Motion carried 7-0. The motion as amended read as follows: Member Shagner, seconded by Member Skiles, moved to find Asher and Margaret Longrie, Case No. 97-037 in violation of 108-23 (R) & (M), Chapter 108-22, minimum requirements for electrical systems, 108-24 (D) & (E) as of April 14, 1997, and be given until June 10, 1997, to correct the violations or be fined $100.00 a day thereafter. L 4 Code Enforcement Board Meeting May 27, 1997 97-045, Frank D. McCord 97 Sand Dollar Key Drive A Notice of Dismissal was presented to the board for this case. 97-047,Albert F. Berban -202 Spring Lake Circle 05/07/97 NOCV-Re-inspection Date: 05/13/97 05/14/97 SOV 05/14/97 NOH-Board Meeting Date: 05/27/97 05/14/97 POS-Hand Delivery Chairperson Carlsson said for the record that no one was present to represent the case. Code Enforcement Officer Simon testified that on April 21, 1997, while conducting a minimum standards re-inspection for verification of compliance with the Minimum Standards Code, she observed what appeared to be a new AC compressor on the outside of the structure. When she questioned Mr. Albert Berban, who had represented himself as the owner of the property, he acknowledged that he had recently installed central AC and Heating to the house that he had just purchased. When inquiry was made as to the permitting on the work he had done, he stated that he had not pulled a permit. When she inquired as to who had done the wiring, he said a friend had helped him with it. She explained to Mr. Berban that he needed to obtain a mechanical and electrical permit from the City Building Department as soon as possible and have the central AC System inspected to insure that it was installed properly. He was then advised that doing this type of work without a permit was a violation of City Ordinance. Further, he was advised that he would need to speak to Mr. Hendrix, the City Electrical Inspector, in regards to pulling the electrical permit as a homeowner. He said he would take care of this immediately. He was given until April 25, 1997, to comply. No permit was pulled. On May 7, 1997, an NOCV was sent to Mr. Albert Berban, as identified by Orange County tax records for violation of City Ordinance 51- 21,Permit required (A)It shall be a violation of this Article for any person to do any building construction, repair work, alteration or remodeling of any building or to demolish any building within the scope of this Article without first obtaining a permit therefor from the Building Department. (B)Further, each and every construction project of any type, to include initial land clearing, that is to be performed within the corporate limits of the city must be submitted to and approved by the City Building Department prior to the start of construction. This includes utilities such as waterlines in building construction projects as well as projects that are within the state road rights-of-way. The term "construction" is herein defined to include clearing of land, regardless of whether subsequent structures will be build or not. [Added 10-1-1985 by Ord. No. 848] The respondent was given until May 12, 1997, to comply. Since he had already been given notice and allotted a time frame to comply with the City Ordinance, it is deemed that the time frame allotted him in the written notice was a reasonable time frame. On May 12,1997, Mr. Berban did come in and pull a mechanical permit for the system he installed. However, no electrical permit was applied for or issued for the wiring of that system. On May 21, 1997, the Ocoee Police Department hand delivered an NOH to this Board Meeting and an SOV for the existing violation, which stated that the electrical work was done without a permit. To date no electrical permit has been pulled nor has there been any contact with Mr. Berban. Member Shagner moved to find Albert Berban, Case No. 97-047, in Code violation of permit required 51-21 (A) & (B), as of May 12, 1997, and give him until June 9,1997, to come into compliance or be fined $100.00 a day. Motion died for lack of second. L 5 Code Enforcement Board Meeting May 27, 1997 Member Linebarier said that Mr. Berban needed to be found in violation as of a certain date for the mechanical permit, but in compliance as of May 12, 1997, and still not in compliance for the electrical permit. Code Enforcement Officer Simon said pulling one permit for the mechanical still does not bring him into compliance because the job requires both an electrical and mechanical permit. Member Shagner, seconded by Member Linebarier, moved to find Albert Berban, Case No. 97-047, in violation of Code 51-21, permit required, (A) & (B), as of May 12, 1997, and give him until June 9, 1997, or be fined$100 a day thereafter. Motion carried 7-0. 97-048,Rick's Body Works -294 E. Geneva Street 04/24/97 NOCV-Re-inspection Date:05/10/97 05/22/97 SOV 05/22/97 NOH-Board Meeting Date: 05/27/97 05/22/97 POS-Hand Delivery Chairman Carlsson said for the record that Mr. Richard Rozema was present to represent himself. Code Enforcement Officer Cronnon displayed a video of the property and testified that on March 24, 1997, she observed numerous inoperable and untagged vehicles being stored on the property. She spoke with Mr. Rozema, owner of Rick's Body Works, and he identified the vehicles on the property as his and understood they were in violation of the City Code Ordinance regarding junked vehicles. He said he would have them removed and received a two week notice in which to do so. On April 3, 1997, a progress inspection revealed that none of the vehicles had been removed. She spoke again with Mr. Rozema, and his willingness to cooperate had changed. He said, "he did not have time to move the vehicles and that he would fight the City on moving the vehicles that he owned". On April 19, 1997, the property was re-inspected and some improvements to the property had been made. The property, however, was still in noncompliance. On May 22, 1997, both Officers, Simon and Cronnon hand delivered an NOH and SOV to Mr. Rozema for this Board Meeting. Code Enforcement Officer Simon said that on May 22, 1997, after the NOH and SOV were delivered to Mr. Rozema, he and Mr. Wright, the property owner, came into the Building Department later that afternoon with several concerns they thought might relate to them. He asked several questions about the violations, asked for copies of the Ordinance for which he was cited. He felt he should fall under this section of the Ordinance: 165-5 exceptions: (B)On the premises of a business enterprise when necessary to the functioning of such business operated in a lawful place and manner. Officer Simon explained that what she and Officer Cronnon had viewed was not in a lawful place and manner for the operation of an auto body shop, but it would be for a junkyard, which he is not zoned for or licensed to do. Officer Simon then distributed copies of Chapter 165 Code of the City of Ocoee regarding junked vehicles as well as definitions for junk yards, salvage yards and auto repair regarding paint and body shops from the Land Development Regulations to the Code Enforcement Members. Richard Rozema, 294 E Geneva Street, after being sworn in by Executive Secretary Seaver, explained that when his property was first inspected by Officer Cronnon, she said he had to get rid of a lot of the cars he had on the lot. He said he had no problem with doing that, but he needed more than 10 days to do it... needed at least 30. Meanwhile, he has complied by moving 6 Code Enforcement Board Meeting May 27, 1997 (ire 12 cars off the lot. Three cars are still present that belong to him which are being repaired. Mr. Rozema said he was unable to give a time frame as to when those vehicles would be moved because he works on them in his spare time when business is slow. Chairperson Carlsson said the reason he had been cited was because the cars were inoperable, had no tags and therefore the City of Ocoee considers them junked vehicles. Mr. Carlsson recommended that he try to get tags on the vehicles or maybe get a dealer tag. To this Mr. Rozema said he could not afford a dealer tag and to put tags and insurance on the vehicles was too expensive just to let them sit. Member Linebarier said they were willing to give him a reasonable amount of time for him to come into compliance, but that would mean he would have to have the vehicles tagged or off the property by the certain date. Attorney Feeney suggested opening Case No. 97-049, George D. and Pat S. Wright - 294 E. Geneva Street and adopt the testimony already heard and invite the owner of the property in question or their representative to speak in order to dispose both cases at once. Chairperson Carlsson asked if there were any objections from the Board or Mr. Wright or Mr. Rozema and there were none. Member Linebarier, seconded by Member Shagner, moved to open Case 97-049, accept the L testimony that has been already heard in Case No. 97-048 and that it be adopted for Case 97-049. Motion carried 7-0. George D. Wright, 294 E. Geneva Street, after being sworn by Executive Secretary Seaver said he had been present for the prior testimony given by Mr. Rozema in Case No. 97-048 and then offered his own testimony on behalf of Mr. Rozema. Member Skiles, seconded by Member Shagner, moved to find Rick's Body Works, Case No. 97-048, in violation of Chapter 165-3, Prohibited Acts, as of May 10, 1997, and give him until July 31, 1997,to come into compliance or be fined $100.00 a day thereafter. Geneva Street and that they be found in violation of Chapter 165-3, Prohibited Acts, as of May 10, 1997, and be given until July 31, 1997, to come into compliance or be fined$100.00 a day. Chairperson Carlsson said he felt that the fine should be at least $500.00 to cover the City's time and effort. Member Shagner, seconded by Member Godek moved to reduce the fine on Case No. 96-74., Michael A. and Donna R. Keller, from $23,000 to $500.00, and if paid, release the lien. Motion carried 5-2. Chairperson Carlsson suggested letting O'Neill, Chapin, Marks, Liebman, Cooper & Carr speak on behalf of Ocoee Food Mart at the next meeting on reduction of fine and lien. Member Linebarier, seconded by Member Skiles, directed the Code Enforcement Clerk to notify the firm of O'Neill, Chapin, Marks, Liebman, Cooper & Carr in regards to Case No. 96- 66, Ocoee Food Mart, to hear a request for reduction of fine and lien at the June 24, 1997., meeting. Motion carried 7-0. COMMENTS City Manager Shapiro thanked the Code Enforcement Board for inviting him to attend the meeting; said that he learned a lot. Attorney Thomas Feeney said he was happy to be back. Member Skiles: None Member Shagner: None Vice Chairperson Linebarier: Asked that hearing rules for the Code Enforcement Board of the City of Ocoee, wherein Rule 1.16 "Amendment" be added to the rules and Rule 1.12 (a) "Time"be amended from ten to thirty days. Vice Chairperson Linebarier, seconded by Member Skiles, moved to revise the Hearing Rules of the Code Enforcement Board of the City of Ocoee as proposed by Attorney Feeney in his letter dated June 5, 1997, wherein Rule 1.16 "Amendment" is added to the rules and Rule 1.12 (a) "Time" is amended from ten to thirty days. Motion carried 7-0. (Clerks Note: Rule 1.16 AMENDMENT. These rules may be amended by a vote of the majority of the membership (not a mere majority of a quorum) of the Code Enforcement Board. Not less than fifteen days notice must precede any adoption of an amendment, and such notice may be in writing to each of the members of the board with a copy to the clerk and the city manager, or alternatively, may be made at a public meeting of the Code Enforcement Board not less than fifteen days prior to the adoption of the amendment by the Board.
