HomeMy WebLinkAbout08-26-1997 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING HELD ON August 26, 1997 CALL TO ORDER Chairman Carlsson called the regular meeting of the Ocoee Code Enforcement Board to order at 7:30 p.m. in the Commission Chambers of City Hall and led in the pledge of allegiance. Vice Chairman Linebarier led in prayer. The roll was called and a quorum declared present. PRESENT: Chairman Carlsson, Vice Chairman Linebarier, Members Godek, Holmes, Lenko, and Skiles. Also present were Attorney Feeney, Commissioner Parker, Code Enforcement Officers Cronnon, Simon, and Smith, Deputy Clerk Harris, Executive Secretary Seaver, and Clerk Stenographer Lewis. ABSENT: Member Shagner, Alternate Members Chancey and Luck (all absences were excused). APPROVALS This item consisted of the Minutes of the July 22, 1997 Code Enforcement Board meeting. VICE CHAIRMAN LINEBARIER, seconded by MEMBER SIULEs, moved to approve the Minutes of the July 22, 1997 Code Enforcement Board meeting as presented. Motion carried 6-0. Ben Griffin, 345 S. Lakeshore Drive, wanted to speak regarding his case at this point during the meeting. Attorney Feeney recommended that the Board hear Mr. Griffin's case at this time, therefore, COMMENTS FROM CITIZENS was heard later in the meeting. VICE CHAIRMAN LINEBARIER, seconded by MEMBER GODEK, moved as only citizens to make comments were those with cases, that the Board move to hear No. 97-070, Base Operations Management Service, Inc., before IV A. Motion carried 6-0. At the request of Chairman Carlsson, Code Enforcement Officers Cronnon, Simon, and Smith were sworn in by Deputy Clerk Harris. Commissioner Anderson arrived to the meeting at 7:35 p.m. PUBLIC HEARINGS OF NEW CASES PURSUANT TO NOTICES OF HEARING - The following cases as written in these minutes will use abbreviations to describe the violation(s) and the dates of inspection(s) at the beginning of each case. Attorney Feeney explained that the Board had heard from Mr. Griffin who had expressed his displeasure, and said that Mr. Griffin's comments would be better directed to City staff or the City Council. In response to Vice Chairman Linebarier, Deputy Clerk Harris confirmed that the case number should read Case No. 96-067 rather than 97-067. VICE CHAIRMAN LINEBARIER, seconded by MEMBER LENKO, moved that the Board re-hear Case No. 96-067, as someone was in attendance to represent the case. Motion carried 6-0. Bruce Chapin, an attorney representing RMN, Inc., said that the Board had reduced the fine that had affected this property, that the fine had been paid and the lien satisfied as to the tenant. He had only represented the tenant that evening, and it was the Board's feeling that until the landlord asked, the Board ought not to follow suit. He was at this meeting (tonight) on behalf of the landlord to ask the Board to conclude the matter since the money has been paid; the lien had been eliminated as to the tenant. In response to Vice Chairman 2 Code Enforcement Board Meeting August 26, 1997 Linebarier, Officer Simon said that the City had not filed a foreclosure against the property. Informal Recess - 8:00 - 8:02 P.M. VICE CHAIRMAN LINEBARIER, seconded by MEMBER LENKO, moved that in Case No. 96-67, RMN. INC., that the fine of $16,800.00 be reduced to $2,300.00. Motion failed 4-2. Chairman Carlsson, Members Godek, Holmes, and Skiles voted "nay." Vice Chairman Linebarier and Member Lenko vote "aye." MEMBER SKILES, seconded by MEMBER GODEK, moved that in Case No. 96-67, RMN, INC., to reduce the fine to zero. Motion carried 4-2. Chairman Carlsson, Members Godek, Holmes, and Skiles vote "aye." Vice Chairman Linebarier and Member Lenko voted "nay." Mayor Vandergrift returned to the meeting at 8:32 p.m. Scott Anderson, 510 Orange Avenue, was sworn in by Deputy Clerk Harris, and made a statement. VICE CHAIRMAN LINEBARIER, seconded by MEMBER LENKO, moved to find A. J. Brienza, Case No. 97-057, 408 Little Spring Hill Drive, in violation of §153-5.5 Restoration, as of July 11, 1997, but in so far as replacement of the sidewalk, be given until September 12, 1997 to comply with City requirements or be fined $150.00 a day thereafter. Mayor Vandergrift: 1) Shared details about an incident where someone's water had been turned off. 2) Thanked everyone for the cards he had received while ill. 3) Commended the Code Enforcement staff and Board on doing a good job. Ms. Simon presented and briefed the Board on the following: • Exhibit "A" - A posting showing that the City had deemed the building unsafe for human occupancy. • Exhibit "B" - A Lawyers Title Insurance Corporation Ownership and Encumbrance Report. • Exhibit "C" - Proof of Notice by Posting. A video of the property in violation was presented for review by the Board. Officer Simon stated that Building Official Flippen had confirmed the condemnation of the property. Motion carried 6-0. In response to Member Godek, Officer Simon said that it would be a decision by the City Commission as to whether the City would "take over" or sell the property. Motion carried 6-0. DISCUSSION ON REVISED HEARING RULES Attorney Feeney explained that the Board had been presented with a clean copy of the Hearing Rules. COMMENTS FROM CITIZENS Commissioner Scott Anderson, 510 Orange Avenue, explained that the City's current ordinance did not provide a concept for inspecting homes before they are rented. Many homes are rented and paid for on a week to week basis, no lease, and the tenant could be asked to leave the place before a protective inspection could take place. The spirit and intent of the law was to check each house. Water is turned on in the name of a person who leaves the area without turning off the water. The water service remains in that individual's name. Mr. Anderson asked that the Board send direction to the City Commission of its support for changing the ordinance to address rental/sublease of residential dwellings. Commission could then direct the City Attorney to look at other models and Cities on how they handle this particular problem, and then work with Staff regarding the issue. Discussion ensued about problems of rental/subleasing property. Attorney Feeney explained that every home that is lived in or leased out, for residential purposes, has to meet the Southern Building Code. The City of Ocoee was fairly progressive. He said, in fact, unlike most other cities and local government that he knew of, the City actually had a catch that at the time a party turns over possession of the property from the owner to the tenant and the City switches the water on. The City makes an affirmative effort to go out and inspect. Attorney Feeney said that in most places that does not occur. Most places if two parties enter a lease, the city moves in and changes the water over, the inspectors do not show up at the door the next day. Here (in Ocoee), the City is fairly aggressive and in the sense that we send inspectors out automatically. It was kind of an aggressive way to try to enforce the City's 6 Code Enforcement Board Meeting August 26, 1997 Code, and that folks have now figured how they can do it and get around the City's efforts to upgrade its enforcement as tenancy takes place. Vice Chairman Linebarier expressed concern about how the City might enforce this or how one was to determine whether someone who was living in a house was a renter or an owner, or if the water or the lights haven't been turned back on. Mr. Anderson explained that it could be enforced in a manner similar to the enforcement of speeding. MEMBER LEvKO, seconded by MEMBER GODEK, moved to ask the City Commission to look in to closing this loop hole in the Chapter 108 of the Minimum Standards Code. Motion carried 6-0. Chairman Carlsson said for the record that when Commissioner Anderson spoke that he was the only Commissioner in the hall at the time. COMMENTS City Manager: Absent Code Enforcement Officer Cronnon: None Code Enforcement Officer Smith: None Code Enforcement Officer Simon presented a set of forms, providing a brief description of each, for review by the Board. Discussion ensued about the forms, and Vice Chairman Linebarier asked that Discussion/Review of Forms be placed on the next meeting agenda, and including a copy of the forms in the next meeting packet. Chairman Linebarier commended Officer Simon on doing an excellent job on the forms. Police Department: None Deputy Clerk Harris: None Executive Secretary Seaver: None BOARD MEMBERS Attorney Feeney: 1) Cautioned the Board about short Notices unless there was an imminent threat to public, health, safety, and welfare. The notice that the City gives is important because it is the first time that the citizen is officially notified that they have violated the City Code. 2) Encouraged the Board about its responsibility for the using the same action with an owner as with a tenant. The ultimate policy and goal of the Board was to try and get compliance for everything in the Code, and not in collecting money. It was fair and reasonable, however, to collect expenses incurred by the City. Some problems were probably contractual matters between the landlord and tenant. Member Holmes: 1) Encouraged broadcasting the Board's meetings on the access channel of the local cable company. He thinks that they need to broadcast all the Boards that have pubic hearings, public meetings, somehow, some way. 2) Wished everyone a safe and happy Labor Day. 7 Code Enforcement Board Meeting August 26, 1997 Member Lenko 1) Pointed out that the City was not using an updated version of the Notice of Code Violation form as previously approved by the Board. Chairman Carlsson asked that Officer Simon check into the matter. 2) Commended the Code Enforcement Officers on doing a great job! Member Skiles wished everyone a happy and safe Labor Day! As per our discussion, you agreed to replace the broken sidewalk as soon as you are financially able. You also agreed to immediately remove the part of the sidewalk that has been damaged by saw cutting at the existing construction joints and filling the open area with clean fill until you pour the concrete. This letter is to request that you complete these necessary repairs and call for an inspection of the finished sidewalk by no Iater than April 10, 1997. If you desire to add a new driveway on Bellini Lane for access to your rear yard, you will be required to obtain a building permit from the Building Department prior to installing the driveway. Driveways including the sidewalk across the driveway are required to be a minimum depth of six (6) inches with 10 x 10 wire mesh.
