HomeMy WebLinkAbout09-23-1997 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING HELD ON September 23, 1997 CALL TO ORDER Chairman Carlsson called the regular meeting of the Ocoee Code Enforcement Board to order at 7:30 p.m. in the Commission Chambers of City Hall and led in the pledge of allegiance. Vice Chairman Linebarier led in prayer. The roll was called and a quorum declared present. PRESENT: Chairman Carlsson, Vice Chairman Linebarier, Members Holmes, Shagner, Skiles, Alternate Members Chancey and Luck. Also present were Attorney Feeney, Code Enforcement Officers Cronnon and Simon, Deputy Clerk Harris, and Clerk Stenographer Lewis. ABSENT: Member Godek and Lenko (both absences were excused). APPROVALS This item consisted of the Minutes of the August 26, 1997 Code Enforcement Board meeting. Member Holmes asked for a correction on page 3, and said that the third motion should read "Vice Chairman Linebarier..." rather than "Vice Chairpman..." MEMBER HOLMES, seconded by VICE CHAIRMAN LINEBARIER, moved to approve the Minutes of the August 26, 1997 Code Enforcement Board meeting as amended. Motion carried 7-0. COMMENTS FROM CITIZENS None VICE CHAIRMAN LINEBARIER, seconded by MEMBER SHAGNER, moved to take Case No. 96-90 under Other Business, and Case Nos. 97-078, 97-079, 97-081, 97-091, and 97-093, to the top of the list; and continue at the request of the City, Case No. 97-082, until the October meeting. In response to Vice Chairman Linebarier, Officer Simon said if the concrete gave way that the sign could fall over. It was creating a hazard. Pat Sirois, 3200 Old Winter Garden Road, Apt. 2530, was sworn in by Deputy Clerk Harris, and stated that the violation had happened on July 17. The reason it was taking so long to respond to the initial NOCV was that he had received a letter on July 30th from his insurance company that it (damage) was not covered. On August 5th, he had contracted the company to do (repair) it. Flip Norman, 1406 Glenmore Drive, Apopka, was sworn in by Deputy Clerk Harris, and provided details about All Signs & Graphics contracting to do the repair work. MEMBER HOLMES , seconded by MEMBER SHAGNER, moved to find Siroc Incorp., Case No. 97-079, in violation of §108-33 (A-1), as of August 12, 1997, and be given until end of the business day, September 26, 1997 to correct the violation or be fined $150 a day thereafter. Robert Pennypacker, 1784 Sparkling Water Circle, upon being sworn in by Deputy Clerk Harris, presented and described Exhibits "A through H" and Exhibit "K" that consisted of pictures of the wall and landscape area, as well as correspondence. Mr. Pennypacker requested (Exhibit "A") an extension of 60 days in order for the City to have a second look at the situation. Officer Cronnon presented photographs of the wall, labeled as Exhibit "I" and "J." A video of the property in violation was presented to the Board in this case. Two (2) videos of the property in violation were presented for the Board in this case. Edward J. Williams, 496 Delaney Avenue, Suite 402, Orlando 32801, was sworn in by Deputy Clerk Harris, and said that at the suggestion of staff, they had posted the property again. Mr. Williams had presented the City with Exhibit "A" - an affidavit authorizing him to represent the corporation that owned the property. The respondent was requesting up to 120 days to repair or demolish the structures. In the meantime, the company was willing to authorize for the property to be patrolled at least twice a day, every day of the week, to keep people off the property. The property had no legal access. In response to Vice Chairman Linebarier, Deputy Clerk Harris said that due to a clerical error, Case No. 97-072, Michael Lewandowski, would be continued to the October meeting. FORM REVIEW The Board had been provided with two sample Request for Re-Hearing/Reduction of Fine forms, and discussion ensued about the pros/cons of each example. Attorney Feeney will prepare a form for approval at the next meeting. DISCUSSION OF HEARING DATES OF NOVEMBER 25, 1997 AND DECEMBER 23, 1997. The consensus was reached by the Board to hold the November 25th Board meeting. However, the Board canceled the December 23' meeting unless there was an emergency case. COMMENTS No Comments. BOARD MEMBERS Chairman Carlsson congratulated Commissioner Anderson on his new baby, Scott Christopher. Vice Chairman Linebarier asked Commissioner Anderson whether any progress had been made with the City Commission about owner/tenant moving in/out issue. Commissioner Anderson said that it would be (on a meeting agenda) in December. Lakeshore Drive Ocoee, FL. 34761 Dear Ms. Cronnon: I have received your notice and would like to request a sixty day extension for achieving City compliance on this matter. The reasons for this are that I am only able to perform the work on weekends and I will be out of town until September 2. I would hope that the City would not have a problem with this since this is not a situation which creates a hazard to the public. In addition, I am requesting the sixty days in order for the City to have a second look at the situation. I would appreciate your help both to fully understand what the problem is, and, also, possibly finding a way of interpreting the code whereby both of our interests would be served. I have raised the issue with the homeowners. Before our association meeting on Monday evening, I asked neighbors to please take a look at the work. The overwhelming response was that if they had not been told to look for it, they would never have noticed the improvement. As a result, there was not one objection raised. I have two proposals of possible interpretations of the work that would make this legal, and would appreciate your response: 1. Walls six feet and under do not require engineering. My improvement raises the height to only 5'-10". I have not increased in any way the liability of the City,Morrison Homes or the Homeowners Association. 2. My understanding is that permits are required for work valued at fifty dollars or more. I have spent less than that on this. Any other ideas you might have to make this acceptable to the City would be greatly appreciated. If there is no reason for disallowing this improvement other than the apprehension that allowing it will set a precedent, I maintain that the precedent is already established. The example is fifty feet west of the wall behind my property, as well as the entire Reflections wall along Clarke Road, the new development across Clarke, Silver Glen, Waterside, and so on. The City and developers have established six feet as a standard for subdivision walls for the purpose of maintaining a minimal level of security, noise abatement, and privacy. •t I enjoy my house, my neighborhood and•Ocoee, and am more than willing to serve the common interest. I ask you, however, to see it from my perspective. With the addition of those few inches to the wall, I can sit in my lanai and know that joggers and bicyclists can't see what I'm having for breakfast. Those few inches have even made for a reduction in the noise level. Traffic on A. D. Mims has increased since I've lived here, and will only get worse with the completion of the new Fire and Police Stations. Again, I hope we can resolve this issue in a way that allows an interpretation of the code which serves the City's interests as well as that of a private citizen. Even though it still needs it final cleaning, I have not built an eyesore (see enclosed photo). I look forward to your response. In the worst case (for me) I badly need the extension in order comply with the notice, and, again, hope there is no problem with-that. Pennypacker 1784 Sparkling Water Circle Ocoee, Florida 34761 Dear Mr. Pennypacker, In regards to your letter dated September 5, 1997 requesting more information about codes pertaining to case 497-081, it is my opinion that the code I cited in the Notice of Code Violation is the code that pertains directly to the case in which you are named in. However, there are several issues that may be of interest to you as far as building and zoning. restrictions on sub- division walls. Some of these issues are height restrictions, engineering of plans and building requirements.
