MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING HELD NOVEMBER 25, 1997 CALL TO ORDER Chairman Carlsson called the regular meeting of the Ocoee Code Enforcement Board to order at 7:30 p.m. in the Commission Chambers of City Hall and led in the pledge of allegiance. Vice Chairman Linebarier led in prayer. The roll was called and a quorum declared present. PRESENT: Chairman Carlsson,Vice Chairman Linebarier, Members Godek, Holmes, Lenko, Luck and Skiles. Also present were Attorney O'Quinn, Code Enforcement Officers Cronnon, Simon, and Smith, Deputy Clerk Harris and Clerk Stenographer Rivera. ABSENT: Member Shagner and Alternate Member Chancey. (Due. /a a lack.art eantac* by 4-U y bo k, abstncas ah. 2sceused,) APPROVALS This item consisted of the Minutes of the October 28, 1997, Code Enforcement Board meeting. Member Linebarier noted that Case No. 97-109, Groundtek of Central FL Inc., should not have been dismissed, but should have been included among cases to be continued. Member Linebarier, seconded by Member Skiles, moved to approve the Minutes of the October 28, 1997, Code Enforcement Board meeting as corrected. Motion carried 7-0. COMMENTS FROM CITIZENS None Member Linebarier asked why Case No. 97-095 had not been included on this agenda. Officer Cronnon explained, for the record, that the case had been dismissed. Member Linebarier instructed Officer Cronnon to get an order of dismissal and present it to the board at the next meeting. Attorney Randall Smith, representing Ray Harper Trust Agreement and Dean Harper, Inc., questioned Officer Cronnon regarding the date and time notice was given to his client and said that since corrections to the property were made immediately u on his receiving notice, felt no monetary fine should be imposed. In response, Attorney�informed the Board Members that since this was a repeat offender, fine could be imposed from the time the violation is noticed by the Code Enforcement Officer. Officer Cronnon provided a Survey for Code Enforcement as Exhibit"A". Member Lenko, seconded by Member Skiles, moved to find Ray Harper Trust Agreement., Case No. 97-116, in noncompliance of Section 119-2, Engaging in business without license, of the City Code as of November 10, 1997, but in compliance as of 11/11/97, and be fined a total of $500 as a repeat offender, and that fine be imposed immediately. C. Roger Freeman, 19544 N. County Road 33, upon being sworn in by Deputy Clerk Harris, gave a brief history of his property ownership in the trailer park community and his dealings with the Board. Said he had received three letters from the City informing him of violations on three of his properties. He advised all three tenants that they were in violation and needed to come into compliance. Two of the tenants have. The tenant living at 207 W. Silver Star Road had been repeatedly advised of the violations and now has been served with an eviction notice. He explained that since Florida was a tenant state, he couldn't do much at the moment. He asked that the Board be patient and allow him some time until the eviction was complete. He provided Exhibits A,B, C, and D showing the Board that the eviction process had begun. Member Linebarier, seconded by Member Lenko, moved to find C. Roger Freeman, Case No. 97-135, in violation of Section 115-3, Prohibited Acts, of the City Code as of October 24, 1997, and that he be given until January 2, 1998, to come into compliance or be fined $100 a day. Mr. Tim Moore, representing Sears, Roebuck and Co., was sworn in by Deputy Clerk Harris. Mr. Moore stated that the reason the storage bins were in the mall parking lot, was because at this time of the year, the store cannot handle the amount of merchandise coming in. He said he had contacted GGP Homart, the parking lot owners, and made full arrangements as to when the storage bins would be removed. He stated that he did not know that the store needed permission from the City to park the storage bins there and asked that the Board allow him two weeks in which to remove the bins. The tenants to whom they were renting had been receiving the notices and throwing them away. They only found out they were in violation because they tried to refinance the property and saw there was a lien on it. Chairman Carlsson said the fine could not be waived simply because the City had spent too much money in labor costs and attorney fees. Member Linebarier, seconded by Member Lenko, moved to reduce the penalty and lien on Case No. 96-045, M. F. Demeran & A. F. Fabian, to $1000. Member Skiles expressed his objections about the amount. Member Holmes, seconded by Member Skiles, moved to amend the motion and reduce the penalty and lien amount on Case No. 96-045, M. F. Demeran & A. F. Fabian, from $1000 to $750. Member Linebarier inquired as to how long it would take them to pay the fine amount and they asked to be given two weeks. Member Skiles withdrew the second and Member Holmes withdrew the motion. ADEQUATE SECURITY: The City of Ocoee is adequately secured inasmuch as BOMS owns eleven(11) parcels of property with a tax assessed value of S5468,552. The tax assessed value is customarily lower Lr.r than the fair market value. INABILITY OF TERRY/TARR TO CORRECT CODE VIOLATION: Terry/Tarr had no ability or right to trespass onto BOMS property to correct the code violation on the 20 E. McKey Street property. CITY HAD ABILITY TO COLLECT OVERBID: The City of Ocoee was advised by certified mail on or about October 16, 1996, of an overbid from the tax foreclosure sale in the amount of$$17,957.18, more than enough to completely satisfy its claim against Base Operations. The City of Ocoee did not respond to the Certified Letter, sent by the Orange County Comptroller's office for reasons unknown to Terry/Tarr. This failure to respond cost the City of Ocoee its ability to collect the lien. This money was eventually paid to BOMS. UNJUST ENRICHMENT TO BOMS: If the City of Ocoee fails to relieve the Terry/Tarr property of this lien, and Terry/Tarr is forced to pay this amount, BOMS will be unjustly enriched and Terry/Tarr will have no recourse against BOMS. POWER OF BOARD TO RELIEVE LIEN: This Board is empowered by Florida Statutes section 162, and by local ordinance to grant such relief to Terry/Tarr. Thank you for your consideration.
