HomeMy WebLinkAbout03-26-1996 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING HELD ON March 26, 1996 CALL TO ORDER Chairman Sills called the regular meeting of the Ocoee Board of Code Enforcement to order at 7:30 p.m. in the Commission Chambers of City Hall and led in the pledge of allegiance. Member Linebarier led in prayer. The roll was called and a quorum declared present. PRESENT: Chairman Sills, Vice Chairman Carlsson, Members Chestney, Linebarier, Lenko, Santo, Shagner, and Alternate Members Holmes and Skiles. Also present were Attorney Feeney, Plans Examiner Washington, Code Enforcement Officers Braddy and Simon, Acting Deputy Clerk Cronnon and Clerk/Stenographer Lewis. ABSENT: None • APPROVALS This item consisted of the Minutes of the February 27, 1996 Code Enforcement Board meeting. Member Linebarier, seconded by Vice Chairman Carlsson, moved to approve the Minutes of the February 27, 1996 Code Enforcement Board meeting as presented. Motion carried 7-0. At the request of Chairman Sills, Code Enforcement Officers Braddy and Simon were sworn in by Acting Deputy Clerk Cronnon. Code Enforcement Officer Simon said that Case No. 96-10 referred to the property at 121 Olympus Drive. The City had received numerous complaints about the accumulation of materials and field dirt on an un-built lot. They was also a Port-o-let in the right-of-way. On January 9, 1996, an NOCV had been sent to the property owner as identified by Orange County Tax Records, Meer Inc., for violation of City Code, Chapter 115-3 Prohibited Acts: "No person shall allow to be dumped,placed, accumulated or otherwise located on lands or premises owned by such person within the city any nuisance and menace to public health, safety and welfare, etc..." Chapter 153-4 Prohibitions: (A)"... substantial structures within city rights-of-way or easements are prohibited unless approved by the City Commission." Upon contact, the owner removed the port-o-let. The property owner had been given until January 16, 1996 to bring the property into compliance. On January 16, 1996, Code Enforcement Board Meeting Loy March 26, 1996 Officer Simon had received a letter from an attorney representing Meer Inc., acknowledging the violation, and requesting indulgence of the City for time for the builder to remove it. On February 9, 1996, after no further contact from the attorney or Meer Inc., an SOV and NOH for the February Board meeting were sent to the property owner. Due to Non-Proof of Service, the case was continued to this meeting. The restricted letter that was sent to the same address as the original NOCV, was returned after the Board meeting and marked "unclaimed." On March 16, 1996, the property was Posted for notification with the SOV and NOH to this Board meeting, and was also posted in City Hall, pursuant to Chapter 7. In response to Vice Chairman Carlsson, Officer Simon explained that there had been no contact regarding this case. The City let two weeks elapse but there had been no contact from the company or the attorney, and they began processing it for the February meeting. Vice Chairman Carlsson presented the NOCV on this case as evidence to verify the date given the respondent to comply had been January 16, 1996. A re-inspection on March 26, 1996 revealed the property remained in non-compliance. Vice Chairman Carlsson, seconded by Member Shagner, moved to find Meer Inc., 238 N. Westmont Drive, Altamonte Springs, in non-compliance reference 121 Olympus Drive, Case No. 96-10, as of 1/16/96 and give them until April 2, 1996 to come into compliance or be fined $50 a day thereafter. Member Linebarier, seconded by Member Lenko, moved to amend the motion to $100 a day. Motion carried 7-0. Vote was taken on the original motion, as amended. Motion carried 7-0. Member Shager suggested that the City send a copy of the Order to the attorney in Case No. 96-10 as there had been no contact with the respondent. 96-11, DEAN HARPER INC. 2/14/96 NOCV - Re-inspection Date:1/26/96 2/19/96 NOH - Board Meeting Date:2/27/96 2/19/96 SOV 2/20/96 POS - Mail Cert#P882-518-632 2/27/96 Order of Continuance:3/26/96 3/9/96 NOH Chairman Sills said for the record that no one was present to represent the case. Code Enforcement Officer Simon said that Mr. Sluder, attorney for the respondent, had telephoned that he was not feeling well, and asked that Case No. 96-11 be continued. Discussion ensued about Mr. Sluder's request, and Chairman Sills said for the record that the Board had denied the verbal request. Officer Simon said that Case No. 96-11 referred to the property at 118 Sandy Key Court. On January 26, 1996, Ms. Simon testified that she had responded to the area of 36 and 37 Eagle Key Court, and also, 58 and 59 W. Circle Key at the request of the Water Department in regards to a complaint of several trailers accessing water by being tied into each other. This 2 Code Enforcement Board Meeting w March 26, 1996 prompted an investigation of operating a business out of 118 Sandy Key Court without a City of Ocoee occupational license. In response to Vice Chairman Carlsson, Officer Simon said that the respondent had not applied for an occupational license, and that Mr. Harper could not get a license to operate a business at this address because it was residential. Code Enforcement Officer Simon presented xerox copies of evidence(statements, rent receipts, etc.), labeled as Exhibits 1 - 14, and briefed the Board as they reviewed each exhibit. (The original copies were not entered as evidence.) A statement from Mr. Cockrell, Supervisor of the Water Department, was also submitted to the Board. In response to Member Chestney, Officer Simon confirmed that the respondent could be cited as a repeat offender as of January 26, 1996. On February 14, 1996, an NOCV as a repeat offender had been sent to the property owner as identified by Orange County Tax Records, Dean Harper Inc., for violation of City Code, Chapter 119-2 EniSaRinji in business without license: "It shall be unlawful for any person to engage in any business, occupation or profession within the City without a license issued hereunder or upon a license issued upon false statements made by any person or on behalf of such person. In any prosecution under this section, the fact that such person is conducting such business shall be prima facia evidence of a violation hereof." On February 19, 1996, an SOV and NOH to the February Board meeting were was sent via restricted delivery. Officer Simon said that on February 27, 1996, Mr. Harper had brought for his file an Orange County Occupational License, obtained on February 20, 1996. On February 27, 1996, the Board had met and this case was continued due to Non-Proof of Service, and to date the POS has not been returned to the City. The evidence presented will show the beginning and end date in this case. On March 22, 1996, Officer Simon hand delivered an SOV and NOH to Mr. Harper for this Board meeting. At the request of Mr. Harper, a copy of his Orange County Occupational License was entered as evidence. Vice Chairman Carlsson said that he believed that there was enough evidence to indicate that Dean Harper, Inc. was running a management company out of the 118 Sandy Key Court address. Vice Chairman Carlsson moved to find Dean Harper, Inc. as a repeat offender, reference Case No. 96-11, find him in violation as of January 26, 1996 and be fined $250 a day. Motion died for lack of a second. Vice Chairman Carlsson, seconded by Member Chestney, moved to find Dean Harper, Inc., Case No. 96-11, in repeat violation of Chapter 119-2 , Engaging in a business without a license, as of January 26, 1996, and be fined $250 a day thereafter until he comes into compliance. Member Shagner seconded b Member Lenko, moved to amend the fine to $500 a day. Motion carried 5-2. Vice Chairman Carlsson and Member Chestney objected and voted "nay." 3 Code Enforcement Board Meeting March 26, 1996 Attorney Feeney explained that, for the record, in establishing the reasonableness of the fine that the Board can consider a lot of things but must consider the gravity of the violation; any actions taken by the violator to correct any previous violations committed by the violator. Vote on the original motion as amended was taken at this time. Motion carried 7-0. Member Linebarier moved to enter a lien on the property ASAP. Motion died for lack of a second. Officer Simon said that Dean Harper was not the owner, that it was a property management business owned by Dean Harper, and also, that Case No. 96-12, The Ray Harper Trust Agreement was the property owner. Discussion ensued about lien and judgment against the respondent. Member Linebarier, seconded by Member Lenko, moved (to file an Order Imposing Fine and Lien) that the City file a lien within five (5) working days against Ray Harper Inc. (sic) for $500 a day, and accumulating since January 26, 1996. Code Enforcement Officer Simon said that Case No. 96-12 referred to the property at 118 Sandy Key Court, and that the case history and evidence was the same as Case No. 96-11. In response to Member Lenko, Attorney Feeney said that it was unnecessary to run the evidence again but the Board should adopt all of the exhibits and testimony of Case No. 96-11. Member Lenko, seconded by Member Linebarier, moved to adopt all of the exhibits and all of the oral testimony in Case No. 96-11 by the City as its evidence for Case No. 96-12, The Ray Harper Trust Agreement, as presented. Motion carried 7-0. Member Santo, seconded by Member Chestney, moved to find the Ray Harper Trust Agreement, Case No. 96-12, in repeat violation of Chapter 119-2, Engaging in a business without a license, as of January 26, 1996, and be fined $500 a day thereafter until he comes into compliance. Motion carried 7-0. Member Linebarier, seconded by Member Shagner, moved to file an Order Imposing Fine and Lien against The Ray Harper Trust Agreement, Case No. 96-12, within five (5) working days for $500 a day since January 26, 1996. Code Enforcement Officer Braddy said that Case No. 96-15 referred to the property at 651 LF 4 Code Enforcement Board Meeting March 26, 1996 Roper Parkway. On February 12, 1996, an NOCV had been sent to Deacon Jones for violation of City Code, Chapter 119-2 Engaging. in business without license: "It shall be unlawful for any person to engage in any business, occupation or profession within the City without a license issued hereunder or upon a license issued upon false statements made by any person or on behalf of such person. In any prosecution under this section, the fact that such person is conducting such business shall be prima facia evidence of a violation hereof. Failure to renew License#85-00067 by September 30, 1995. Total Due$545.31." The respondent had been given until February 16, 1996 to come into compliance. A re-inspection on February 19, 1996 revealed that no license had been obtained as of that date, therefore, an SOV and NOH were sent to the respondent for the February Board meeting. Due to non-Proof of Service, an Order of Continuance was issued for this Board meeting. An SOV and NOH were sent to the respondent on March 11, 1996 via certified mail, and the return receipt had been signed on March 12, 1996 by Deacon Jones. A re-inspection on March 26, 1996 revealed that there had been no change in the license. In response to Member Linebarier, Officer Braddy said that a license would not be issued until the penalty had been paid. Member Lenko, seconded by Vice Chairman Carlsson, moved to find Deacon Jones, Case No. 96-15, 651 LF Roper Parkway, in non-compliance of City Code, Chapter 119-2, as of March 26, 1996, and be given until April 2, 1996 to come into compliance or be fined $50 per day thereafter. On February 12, 1996, an NOCV had been sent to Cakes And Catering & Bar- B-Que, Inc. for violation of City Code, Chapter 119-2 Engaging in business without license: "It shall be unlawful for any person to engage in any business, occupation or profession within the City without a license issued hereunder or upon a license issued upon false statements made by any person or on behalf of such person. In any prosecution under this section, the fact that such person is conducting such business shall be prima facia evidence of a violation hereof. Failure to renew License #88-00703 by September 30, 1995. Total Due $406.25." The respondent had been given until February 16, 1996 to come into compliance. A re-inspection on February 19, 1996 revealed that no license had been obtained as of that date, therefore, an SOV and NOH were sent to the respondent for the February Board meeting. Due to non-Proof of Service, an Order of Continuance was issued for this Board meeting, and was sent to the property owner on March 11, 1996 via certified mail; a receipt was signed on March 20, 1996. Payment, plus the penalty, was received on March 26, 1996, and the City has issued the respondent an Occupational License. Member Linebarier, seconded by Member Lenko, moved to find Cakes And Catering & Bar-B-Que, Inc., Case No. 96-16, 14 W. McKey Street, in non-compliance of City Code, Chapter 119-2, as of February 16, 1996 but in compliance as of March 26, 1996, and that no penalty imposed at this time. Motion carried 7-0. Code Enforcement Officer Braddy said that Case No. 96-32 referred to the property at 1002 Ruth Jordana Court. On February 12, 1996, an NOCV had been sent to Air-Con for violation of City Code, Chapter 119-2 ErmaRinR in business without license: "It shall be unlawful for any person to engage in any business, occupation or profession within the City without a license issued hereunder or upon a license issued upon false statements made by any person or on behalf of such person. In any prosecution under this section, the fact that such person is conducting such business shall be prima facia evidence of a violation hereof. Failure to renew License #88-01646 by September 30, 1995. Total Due $593.75." The respondent had been given until February 16, 1996 to come into compliance. A re-inspection on February 19, 1996, revealed that no license had been obtained as of that date, therefore, an SOV and NOH were sent to the respondent for the February Board meeting. Due to non-Proof of Service, an Order of Continuance was issued. On March 11, 1996, an NOH was sent to Air-Con, and the receipt had been signed on March 15, 1996. The City, after receiving payment, did issue the respondent an Occupational License on March 21, 1996. Vice Chairman Carlsson, seconded by Member Santo , moved to find Air-Con, Case No. 96-32, 1002 Ruth Jordana Court, in violation of City Code, Chapter 119-2, as of February 16, 1996, but in compliance as of March 21, 1996, and that no fine be imposed at this time. Motion carried 7-0. 96-40, ELIZABETH SANDOVAL 3/06/96 NOCV - Re-inspection Date:3/11/96 3/15/96 NOH - Board Meeting Date:3/26/96 3/15/96 SOV 3/15/96 POS - Mail Cert#P882-518-621 Code Enforcement Officer Braddy said that Case No. 96-40 referred to the property at 142 Mobile Lane. Officer Braddy said that the City had received six separate complaints, and on March 6, 1996, an NOCV was sent to Elizabeth Sandoval, the renter as verified by City Water Records, for violation of City Code, Chapter 43-8 Animals and maintenance prohibited:A): "No person shall keep or maintain or cause to be kept or maintained on any lands or premises within the city any fowl or animals whose keeping or maintenance constitutes a nuisance to the public health, safety and welfare as set forth in 43-7. B)No person shall allow to be kept or maintained or otherwise located on lands or premises owned by him within the City any fowl or barnyard animals whose keeping or maintenance constitutes a nuisance as set forth in 43-7; nor shall any person after notice as hereinafter provided in 43-9 that a nuisance to public health, safety and welfare exists on lands or premises owned by him within the City of Ocoee, keep, maintain or fail to remove such nuisance to public health, safety and welfare. Keeping of roosters on the property." The respondent was given until March 6, 1996 to come into compliance. A re-inspection on March 11, 1996 revealed that the property remained in violation, therefore, on March 15, 1996, an SOV and NOH for this Board meeting were sent to the respondent via restricted delivery. A receipt had been signed on March 20, 1996. A re-inspection on March 25, 1996 revealed the roosters had been removed from the property. 6 Code Enforcement Board Meeting Lar March 26, 1996 Elizabeth Sandoval, 142 Mobile Lane, was sworn in by Acting Deputy Clerk Cronnon, and said that after receiving the letter (from the City) on March 7, 1996 that her husband had removed the roosters on March 8, 1996. Member Lenko, seconded by Member Shagner, moved to find Elizabeth Sandoval, Case No. 96-40, in non-compliance of City Code, Chapter 43-8, animals and maintenance prohibited:A and B, as of March 8, 1996, but in compliance as of March 25, 1996, and that no fine be assessed. Motion carried 7-0. 96-41, BETTY PEDRICK 3/06/96 NOCV - Re-inspection Date:3/11/96 3/15/96 NOH - Board Meeting Date:3/26/96 3/15/96 SOV 3/15/96 POS - Mail Cert#P882-518-622 Chairman Sills said for the record that no one was present to represent the case. Code Enforcement Officer Braddy said that Case No. 96-41 referred to the property at 142 Mobile Lane. Officer Braddy said that Case No. 96-41 was the same as Case No. 96-40, and that Betty Pedrick was the property owner. Vice Chairman Carlsson, seconded by Member Chestney, moved to find Betty Pedrick, Case No. 96-41, in non-compliance of City Code, Chapter 43-8, animals and maintenance prohibited:A and B, as of March 8, 1996, but in compliance as of March 25, 1996, and that no fine be imposed at this time. Code Enforcement Officer Simon said that Case No. 96-42 referred to the property at 1002 Ursula Street. On January 18, 1996, an NOCV had been sent to Shirley A. Allen, the tenant, for violation of City Code, Chapter 165-3 Prohibited Acts: "No person shall keep junk/abandoned vehicles within the City of Ocoee." The observation was that of a maroon vehicle and a red Camaro in the driveway that had no tag and was inoperable. A re-inspection on March 13, 1996 produced a status of non-compliance. The maroon vehicle was gone but the red Camaro without a current tag was in the same location but was covered with a tarp. On March 18, 1996, an SOV and NOH for this Board meeting were sent to the property owner via restricted delivery by Deputy Clerk Seaver. A re-inspection on March 26, 1996 revealed that the red Camaro was still there. Also, another Camaro, without a tag, had been brought to the property. The respondent received and signed for the POS on March 19, 1996. Member Lenko, seconded by Member Santo, moved to find Shirley A. Allen, Case No. 96-42, in non-compliance of City Code, Chapter 165-3 Prohibited Acts, as of March 26, 1996, and be given until April 2, 1996 to come into compliance or be fined $50 per day thereafter. Motion carried 7-0. Code Enforcement Officer Simon said that the City would like to see this case resolved, that no one was caring for the trailer which was vacant and open. Officer Simon expressed concern about risks of fire or destruction. ,,,,, Sandra Crane, 89 Buck Key Court, Pioneer Key Park I, was sworn in by Acting Deputy Clerk Cronnon, and presented a Power of Attorney for Garfield Holmes (Exhibit 1). She requested a re-hearing and asked that the fine be lowered in Case No. 95-58. Ms. Crane also presented a photograph (Exhibit 2) of the property, and said that she was interested in buying the property. Mr. Holmes had wanted to rent (the trailer) until it is ready for sale. Discussion ensued about lowering the fine and whether the Board should re-hear the case. Several Board members expressed objection to this request, and Vice Chairman Carlsson said that the City already had at least $1300 involved in labor on this case. Member Linebarier said that the Board needed to see some improvement in this property, and must have a firm commitment before they could take any steps toward reducing the fine any further. Member Lenko said that if the property was going to be used as a rental property than there was no problem with the lien sitting on it as is. The only time the owner had to worry about the lien was when the property was being sold. Vice Chairman Carlsson agreed with Member Linebarier, and said that if the Board reduced the fine, there was nothing stopping Mr. Holmes from selling the property to Ms. Crane with no lien. Mr. Holmes should show the City that he could maintain the property, and come back to the Board in 6-12 months to request a reduction in the lien. Vice Chairman Carlsson, seconded by Member Lenko, moved that the request for a re-hearing for Barbra Ball, Case No. 95-58, be denied but Ms. Crane had the opportuni to come back before the Board in 6 to 12 months for a re-hearing. Code Enforcement Officer Braddy stated that the Board had found the respondent in non-compliance at the last meeting for a smoke detector. She said that Mr. Tawari had hired Amber Electric but they had been denied access to the property. The renters had moved out, and Officer Braddy requested that the Board table or continue Case No. 96-04. Discussion ensued about the fine, and Vice Chairman Carlsson, seconded by Member Lenko, moved at the request of the City to table Case No. 96-04, Dartha Tawari, until the City brings it back to the Board. In response to Member Linebarier, Code Enforcement Officer Simon explained that the lien in Case No. 95-143, regarding 605 Jay Street, had been paid, and that the property had been brought into compliance by emptying the pool. Chairman Sills said that Building and Zoning Official Flippen had asked to be present when the Board discussed Attorney Feeney's memorandum of February 14, 1996, regarding "Inspections and Grace Period To Remedy Violations of Minimum Standard Codes," and that item.will appear on the Board agenda for April. COMMENTS City Manager: None Code Enforcement Officer Braddy: None Code Enforcement Officer Simon presented, at the request of Mr. Linebarier, several case histories in Florida that dealt with Code Enforcement liens, and the City Attorney's position fikay about the liens involving the foreclosure proceedings. 10 Code Enforcement Board Meeting L . March 26, 1996 Police Department: None Acting Deputy Clerk Cronnon thanked the Board for giving her the opportunity and experience of sitting in during the meeting. BOARD MEMBERS Member Santo wished "good luck" to Mr. Feeney. Member Chestney said that he agreed with Member Santo. Vice Chairman Carlsson expressed concern to the Code Enforcement Officers about viewing copies of the evidence regarding the Dean Harper case, and explained that he believed that the Court could throw it out because of the receipts. He also said that he had taken the Officers' word because they were under oath. Officer Simon said that the City had all of the originals. Mr. Carlsson commended the Officers for doing a good job. Member Shagner expressed concern about comments being made about the Board taking or not taking action in a particular case. Member Lenko: None Member Linebarer inquired about Attorney Feeney's memorandum with regards to input from Building Official Flippen and Code Enforcement Officer Simon. Alternate Member Holmes: None Alternate Member Skiles described the condition of a property that had an abandoned vehicle in the Ocoee area but was in the County rather than the City. He said that this household was privy to the services provided by the City to include the new garbage trash cans. In response to Alternate Member Skiles, Plans Examiner Washington said that they were paying the City for the services as a rate payer. Attorney Feeney explained that he looked forward to working for the Board. He also said that should he win the House seat, that he would be unable to attend maybe two or three meetings in the average year. There were good, capable people in the firm and they would fill in during those times. Commissioner Anderson: None Chairman Sills thanked Ms. Cronnon for filling in during the absence of Deputy Clerk Seaver.
