HomeMy WebLinkAbout05-28-1996 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING HELD ON May 28, 1996 CALL TO ORDER Acting Chairman Carlsson called the regular meeting of the Ocoee Code Enforcement Board to order at 7:30 p.m. in the Commission Chambers of City Hall and led in the pledge of allegiance. Member Linebarier led in prayer. The roll was called and a quorum declared present. PRESENT: Acting Chairman Carlsson, Members Holmes, Linebarier, Lenko, Shagner, and Alternate Members Godek and Skiles. Also present were Attorney Feeney, Code Enforcement Officer Simon, Deputy Clerks Seaver and Cronnon, and Clerk/Stenographer Lewis. ABSENT: Members Chestney and Santo (both absences were excused). Chairman Carlsson welcomed Alternate Member Godek to the Board. Former Chairman Sills had resigned and the City Commission, in formal action during the May 21, 1996 meeting, had appointed Member Holmes to complete Mr. Sill's term which will expire January, 1999. APPROVALS This item consisted of the Minutes of the April 23, 1996 Code Enforcement Board meeting. Member Linebarier, seconded by Member Shagner, moved to approve the Minutes of the April 23, 1996 Code Enforcement Board meeting as presented. Motion carried 6-0. Alternate Member Godek did not vote. COMMENTS FROM CITIZENS None In response to Member Linebarier, Chairman Carlsson said that Alternate Member Godek could vote on the cases heard during this meeting. Code representation: NOCV - Notice of Code Violation; NOH - Notice of Hearing; SOV - Statement of Violation(s); and POS - Proof of Service. 96-45, MAURICIA FABIAN DEMERAN AND ANA HERNANDEZ FABIAN 2/10/96 NOCV - Re-inspection Date:4/15/96 4/17/96 NOH - Board Meeting Date:4/23/96 4/17/96 SOV 4/17/96 POS - Mail Cert#P150-535-562 4/23/96 Order of Continuance: 5/28/96 5/6/96 NOH - No Proof of Service For the record, no one was present to represent the case. At the request of Chairman Carlsson, Code Enforcement Officer Simon was sworn in by Deputy Clerk Cronnon. Code Enforcement Officer Simon said that Case No. 96-45 referred to the property at 1006 Sal Street, and that the case could not be heard due to Non-Proof of Service. Member Linebarier, Code Enforcement Board Meeting 1461., May 28, 1996 seconded by Member Shagner, moved to table Case No. 96-45, Mauricia Fabian DeMeran and Ana Hernandez Fabian, until the June meeting. Motion carried 7-0. 96-46, ARMANDO AND MARIA MUNGIA 3/25/96 NOCV - Re-inspection Date:5/01/96 5/03/96 NOH - Board Meeting Date:5/28/96 5/03/96 SOV 5/03/96 POS - Mail Cert#P882-518-774 Chairman Carlsson said for the record that no one was present to represent the case. Code Enforcement Officer Simon said that Case No. 96-46 referred to the property at 212 Security Circle. Officer Simon testified that, on March 13, 1996 while performing a Minimum Standard Inspection, she had observed a partially erected but incomplete shed. Upon further investigation and conversation with the tenant, she ascertained that there was no building permit for this construction, and she advised the tenant that a permit must be obtained or the structure removed. Officer Simon said that the tenant advised that the property owner had erected the shed. As ten days had been allotted and no permit had been pulled, Code Enforcement proceedings began against the property owner. On March 25, 1996, an NOCV was sent to the property owner as identified by Orange County Tax Records, Armando and Maria Mungia, for violation of City Code, Chapter 51-21;Permit Required: "It shall be a violation of this Article for any person to do any building construction, repair work, alteration or remodeling of any building within the scope of this Article without first obtaining a permit therefore from the Building Department." The property owner was given until April 5, 1996 to bring the property into compliance. After this date, Mr. Mungia came into the building department to advise them that he was in the process of trying to get the paper work needed to complete the permit process. He was not in possession of a plot plan or a boundary survey of the property. Upon his request, an extension was given to allow time for him to collect the appropriate paper work that he needed. The respondent returned several times to the City but was unable to obtain the building permit. On May 3, 1996, an SOV and NOH to this Board meeting were sent to the property owners, Armando and Maria Mungia, restricted delivery, by Board Clerk Seaver. A re-inspection of the property on May 28, 1996 produced a status of compliance. The property owner had removed the structure. Member Lenko, seconded by Member Linebarier, moved to find Armando and Maria Mungia, Case No. 96-46, 212 Security Circle, in non-compliance of Chapter 51-21, Permit Required, as of April 19, 1996, but in compliance as of May 28, 1996, and that no fine be imposed at this time. Motion carried 7-0. 96-48, SONNY NGUYEN 5/07/96 NOCV - Re-inspection Date:5/20/96 5/21/96 NOH - Board Meeting Date:5/28/96 5/21/96 SOV 5/21/96 POS - Mail Cert#P150-535-583 Code Enforcement Officer Simon testified that Case No. 96-48 referred to the property located at 2883 Cullen's Court. Officer Simon said that Hallmark Builders had been building in the Waterside Subdivision with two (2) houses where construction had stopped entirely. When the construction ceased, the construction material on the lot from the building had been left in an pile. Numerous contacts were made with Joe Morin, a representative with Hallmark Builders, about the problems the debris was incurring to the neighborhood. Mr. Moore advised her that the company was dealing with bankruptcy and it would be cleaned. After no compliance was 2 Code Enforcement Board Meeting May 28, 1996 gained, and Hallmark had completed the bankruptcy process, Officer Simon again advised Mr. Morin that Code Enforcement action would commence against the property if Hallmark did not come into compliance. On May 7, 1996, an NOCV was sent to the property owner as identified by Orange County Tax Records, Sonny Nguyen, for violation of Chapter 115-2. Creation Prohibited: "No person shall allow to be dumped,placed, accumulated or otherwise located on lands or premises owned by such person within the City any nuisance and menace to public health." The observation had been that of large piles of metal, cinder block, and truss construction debris left on the property. The respondent was given until May 10, 1996 to bring the property into compliance. A re-inspection of the property on May 20, 1996 produced a status of non-compliance. On May 21, 1996, an SOV and NOH for this Board meeting were sent to the property owner via restricted delivery by Deputy Clerk Seaver. A re-inspection on May 28, 1996, produced a status of non-compliance with the violations. Sonny Nguyen, 7049 Aloma Avenue, Apt. C, Winter Park 32792, was sworn in by Deputy Clerk Cronnon, and apologized for the "mess" at the property. Mr. Nguyen said that Hallmark had promised to clean (the lot), and he had been given the name of a company that had been hired to remove the debris. The respondent also said that the representative had not understood why the contracted company had not done it. Mr. Nguyen presented a letter from Sun Bank for review by Attorney Feeney, and asked that the Board give him time to talk with Hallmark about the problem. William Simon, Waterside Subdivision, was sworn in by Deputy Clerk Cronnon, and expressed concern about the continuation of neglect by Hallmark Builders Inc. Discussion ensued about ownership of the lot and whether the building supplies that remained at the property were salvageable. Member Lenko, seconded by Member Holmes, moved to find Sonny Nguyen, Case No. 96-48, in non-compliance as of May 28, 1996 of Chapter 115-2. Creation Prohibited, and give him until June 24, 1996 to come into compliance or be fined $100 a day thereafter. Motion carried 7-0. The Board directed Attorney Feeney to look into the title of the lot. 96-49, HALLMARK BUILDERS INC. 5/07/96 NOCV - Re-inspection Date:5/20/96 5/21/96 NOH - Board Meeting Date:5/28/96 5/21/96 SOV 5/21/96 POS - Mail Cert#P150-535-584 For the record, no one was present to represent the case. Code Enforcement Officer Simon testified that Case No. 96-49 referred to the property located at 2886 Cullen's Court. Officer Simon said that Hallmark Builders had been building in the Waterside Subdivision where construction had been stopped on two (2) houses. Officer Simon advised Mr. Morin that Code Enforcement action would commence against the properties if Hallmark did not clean the debris. On May 21, 1996, an SOV and NOH for this Board meeting were sent to property owner, via restricted delivery, by the Board Clerk. A re-inspection on May 20, 1996 and May 28, 1996, produced a status of non-compliance. Officer Simon said that no one from Hallmark had made any attempts to contact her to resolve this issue. Member Linebarier moved to find Hallmark Builders Inc., Case No. 96-49, in violation of Chapter 115-2, as cited, and give them until June 24, 1996 to come into compliance or be fined $250 a day thereafter. Motion died for the lack of a second. Member Shagner, seconded by Member Lenko, moved to find Hallmark Builders Inc., Case No. 96-49, in violation of Chapter 115-2. Creation Prohibited, and table the case to the June 25, 1996 meeting. Motion carried 6-1. Member Linebarier expressed objection and voted "nay." At the direction of the Board, Attorney Feeney said that he will investigate the title of the lot. 96-50, GOSNELL NELSON ROBIN, SR AND HELEN ELIZABETH GOSNELL 5/07/96 NOCV - Re-inspection Date:5/20/96 5/21/96 NOH - Board Meeting Date:5/28/96 5/21/96 SOV 5/21/96 POS - Mail Cert#P150-535-585 Code Enforcement Officer Simon said that Case No. 96-50 referred to the property at 613 Sherwood Oaks Circle. Officer Simon said that Case No. 96-50 could not be heard due to Non-Proof of Service. Member Lenko, seconded by Member Shagner, moved to table Case No. 96-50, Nelson Robin Gosnell, Sr and Helen Elizabeth Gosnell, until the June 25, 1996 meeting. Motion carried 7-0. OTHER BUSINESS Deputy Clerk Seaver submitted an Order Imposing Fine and Lien on Case No. 96-42, Shirley A. Allen, and Case No. 96-10, Meer, Inc. COMMENTS City Manager: Absent Code Enforcement Officer Simon announced that the City had hired Randy Conyers as a Code Enforcement Officer. Police Department: No one present. iolow4 Code Enforcement Board Meeting Cir May 28, 1996 Deputy Clerk Seaver announced that: 1) The election for Chairman and Vice-Chairman will be on the next meeting agenda, and 2) Thea Cronnon will soon be taking over duties as Deputy Clerk. BOARD MEMBERS Member Holmes said that it was a privilege being elected to full member status on the Board, and welcomed Alternate Member Godek. Member Linebarier: None Alternate Member Godek thanked the Board for the welcome. Chairman Carlsson: 1) Directed on behalf of the Code Enforcement Board, that the Clerk write a letter of appreciation to Jim Sills for his time, consideration, and dedication to the Board. 2) Thanked Attorney Feeney for input given to the Board.
