MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD
MEETING HELD MAY 24, 1994
ROLL CALL
PRESENT: Chairman Jim Sills, Larry Chestney, Carolyn Alexander,
Denise Lenko, Scott Glass, Board Attorney Ike Cool, Code
Enforcement Officer Teresa Braddy, Deputy Clerk Shelly Simon.
ABSENT: Vice Chairman Frank Carlsson, Madeline Shagner, Eric
Barnett. (Excused)
The meeting was called to order by Chairman Sills at 7 :30 pm in the
Ocoee Commission Chambers, at the Ocoee Community Center. Chairman
Sills led in the Pledge of Allegiance to the Flag, and Carolyn
Alexander led in prayer. Chairman Sills stated that there was a
quorum present.
APPROVALS
Carolyn Alexander made a motion to approve the February 22, 1994
(Ww and March 22, 1994 minutes of the Code Enforcement Board Meeting as
written. The motion was seconded by Denise Lenko. Denise Lenko
then made a motion to approve the minutes providing for a change,
she motioned to change the word from stink to stunk. Carolyn
Alexander seconded the motion and it was voted on unanimously.
COMMENTS FROM CITIZENS

HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARING
94-17 - Chairman Sills stated that there was no one present to
represent this case. At this time Code Enforcement Officer Teresa
Braddy was sworn in by Deputy Clerk Shelly Simon. She testified
that the Statement of Violations was sent to the wrong address and
that she had attempted to hand deliver the letter without success
and requested that the case be continued. Denise Lenko made a
motion to continue case number 94-17 until the next meeting. Larry
Chestney seconded the motion and it was voted on unanimously.
94-18 - Chairman Sills stated that there was no one present to
represent this case. Ms. Braddy stated that this case ties into
case number 94-21. She testified that Ms. Pedrick has not been in
town to receive the mail and asked if the case could be continued
until the next meeting. Ms. Lenko made a motion that case number
(mw 94-18 be tabled until the next meeting. Larry Chestney seconded
the motion and it was voted on unanimously.

94-19 - Chairman Sills stated to let the record show no one was
present to represent this case. Ms. Braddy testified delivery was
not achieved on this case and requested it to be continued until
the next meeting. Carolyn Alexander made a motion to table case
number 94-19 until the June 1994 meeting. The motion was seconded
by Larry Chestney and voted on unanimously.
94-21 - Chairman Sills stated no one was present to represent this
case. Ms. Braddy stated due to hardship surrounding this case she
recommended to give them two weeks to come into compliance. Ms.
Braddy explained the Minimum Housing Procedure and how the original
inspection was done. She testified that the original Code
Violation was sent 04/20/94, reinspected 05/10/94, found in non-
compliance and was reinspected again on 05/24/94 and was found to
be in partial compliance with some of the repairs they had been
cited to fix under the Minimum Housing Ordinance. Ms. Braddy also
stated other circumstances that had occurred. She testified that
a tree had fallen on the power pole causing several electrical
problems requiring a master electrician to repair. She testified
that the tenants had made arrangements with Amber Electric and
contacted Florida Power in an attempt to fix the electrical
problems. Ms. Braddy stated that she had confirmed that they had
contacted Florida Power. Carolyn Alexander asked if the case could
be tabled until the next meeting. Attorney Cool advised to find
the case in non-compliance and give four weeks to comply. Mr.
Chestney expressed a concern about causing more of a hardship but
also was very concerned about the electrical problems. Mr.
Chestney made a motion to table case number 94-21, Kenneth Chisolm
to the June 28, 1994 meeting. Ms. Lenko seconded the motion and it
was voted on unanimously.
94-22 - Chairman Sills stated for the record that there was no one
in the audience to represent this case. Ms. Braddy testified the
owner of record on this property was originally sent a Minimum
Housing Standards letter after being inspected. Ms. Braddy
explained the Minimum Housing Process in this case and the paper
work procedure. Ms. Braddy testified that the letter was sent to
the owner on 12/23/93 and it specified each code violation to be
taken care of and that some of the violations were hazardous enough
that she could not approve water on this house and allow the
renter to remain in the house. Ms. Braddy stated that the
residents remained in the house for two weeks and then moved after
receiving a court order to do so. Ms. Braddy testified that to
date the property is not in compliance with the Minimum Housing
Standard letter sent. The letter gave the property owner 10 days
to repair electrical violations and 60 days for all other
violations. Due to the repairs not being done within the 60 day
time frame the property owner was sent a Notice of Code Violations
on 4/20/94.

Ms. Braddy testified that she has made numerous inspections on the
property due to complaints of the hazard with children playing in
the unsecured vacant building. The violations were numerous to
include but not limited to no doors, no windows etc. Ms. Braddy
stated that the Building Official has made contact with the
property owner to secure the house or remove it. Ms. Lenko asked
if the Code Enforcement Board could condemn the building. Attorney
Cool answered that the Board could address what the City has
requested.
Ms. Braddy stated that what the City was requesting is to find the
property in non-compliance for being in violation of Ordinances.
Ms. Lenko stated that the Board had the right to condemn the
building and Attorney Cool requested to know what section was being
referenced. There was discussion between Attorney Cool and the
Board Members on condemning the building, lot size, procedures,
Section 108-39 and Section 108.9 of the City Ordinances. Ms. Lenko
made a motion to find in non-compliance and give a compliance date
of May 31, 1994 or be fine $250.00 a day thereafter that the
violating exists. The motion was seconded by Scott Glass. Further
discussion was given by the Board Attorney and Board Members as to
the 7 day time period given, condemnation of the building and the
fact that the house has continued to deteriorate. The motion was
carried unanimously.
94-23 - Chairman Sills stated for the record that there was no one
present to represent this case. Ms. Braddy stated that a note
needed to be made that 94-23 and 94-24 are the same address. That
94-24 was cited to the wrong owner by error of reading of the tax
roles. In reference to 94-23 he is the renter and she has been
unable to deliver the Violation by mail or hand delivery. Ms.
Braddy asked if this case could be tabled. Scott Glass made a
motion to table case number 94-23 until the next meeting. Ms.
Lenko seconded the motion and it was voted on unanimously.
94-24 - Ms. Braddy testified that this case was dismissed prior to
the Board Meeting.
94-25 - Ms. Braddy testified that this case was dismissed prior to
the Board Meeting.
94-26 - Ms. Braddy testified that this case was dismissed prior to
the Board Meeting.
94-27 - Ms. Braddy testified that this case was dismissed prior to
the Board Meeting.
94-28 - Ms. Braddy testified that this case was dismissed prior to
the Board Meeting.
94-29 - Ms. Braddy testified that she has been unable to deliver

the violation on this case and asked if the case could be tabled.
Ms. Lenko made a motion to table case number 94-29 until the next
meeting. Scott Glass seconded the motion and it was voted on
unanimously.
94-30 - Ms. Braddy stated this case has not yet been delivered.
Ms. Lenko made a motion to table case number 94-30 until the next
meeting. Carolyn Alexander seconded the motion and it was voted on
unanimously.
OTHER BUSINESS
93-64 - Ms. Braddy stated that this case was dismissed. The
property had been foreclosed on and was currently being fixed by
the bank.
93-74 - Ms. Braddy stated that this case was dismissed, that the
property owner had complied.
94-06 - This case had been sent an Affidavit of Compliance.
94-12 - This case has received an Affidavit of Compliance.
Chapter 115, Nuisance Ordinance #94-09: Discussion was given on
the contents of the new Ordinance by Board Members, Board Attorney
and the Code Enforcement Officer.
93-46 - Ms. Braddy stated that she was starting over with this case
to cite the property on the new Ordinance for Grass and Weeds.
93-67 - Ms. Braddy stated that this case was at the same stage
meaning that delivery of the Violation has been unsuccessful.
COMMENTS

Code Enforcement - Ms. Braddy advised that the building department
would be getting a new Code Enforcement Officer.

Chairman Sills made a motion to adjourn at 8:40. The motion was
seconded by Larry Chestney and voted on unanimously.
