MAY 25, 1993
ROLL CALL
PRESENT: Vice Chairman Jim Sills, Robert Imes, Frank Carlsson,
Carolyn Alexander, David Rich (late) , Mark Slaby, Attorney Ike
Cool, Code Enforcement Officer Teresa Braddy, Deputy Clerk Sherry
Seaver.
ABSENT: Larry Chestney, Unexcused
The meeting was called to order by Vice Chairman Sills at 7:30 pm
in the Ocoee Community Center. Vice Chairman Sills led in the
Pledge of Allegiance to the Flag and Mr. Carlsson led in prayer.
Vice Chairman Sills stated for the record that there was a quorum
present.
APPROVALS
Mr. Carlsson made a motion to approve the minutes of the April 27,
1993 meeting as printed and distributed. Motion seconded by Mr.
Imes and approved unanimously.
COMMENTS FROM CITIZENS
No Citizens
At this time, Ms. Braddy was sworn in by Deputy Clerk Seaver.
HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARING
93-13, Jeffrey Wayne Dusek
Ms. Braddy stated the violation for this case and presented
pictures to the Board for review. Case reviewed at this time by
Board Members. Jeffrey Wayne Dusek was sworn in by Deputy Clerk
Seaver. Mr. Dusek stated that he was the second owner of this
property and that the fence was erected when he purchased the
house. He stated that he sent a letter to the City without any
response. Mr. Dusek stated that Montgomery Avenue was not annexed
into the City until 1987 . Attorney Cool stated that the road was
not the issue. Mr. Carlsson suggested that he try to obtain a
variance. Mr. Don Flippen was sworn in by Deputy Clerk Seaver. Mr.
Flippen explained the section of the code cited. Mr. Flippen stated
that if a permit had been applied for it would have been denied.
Mr. Carlsson asked how long it would take to obtain a variance. Mr.
Flippen stated $250.00 and about 60 days. Mr. Dusek stated that it
would only prolong him moving the fence. He also stated that if he
had to move the fence, he would lose part of his yard. Mr. Carlsson
made a motion to give the Respondent until July 30, 1993 to come
into compliance or to be fined $25.00 a day thereafter. Motion
seconded by Mr. Imes and approved unanimously.

93-09, Jerry L. Jones
At this time, Mr. Jerry L. Jones was sworn in by Deputy Clerk
Seaver. Mr. McShane, Respondents Attorney, was also present. Mr.
McShane requested from the Board to grant Mr. Jones a 60-day
continuance to possibly obtain a variance from the City. Mr. Jones
presented pictures for the Board to review. Mr. Flippen discussed
future development in the area of Mr. Jones' residence and the
effect it would have on the area. Mr. McShane discussed his views
on Sec H of the Land Development Regulations. At this time, Mr.
Jones played his video and explained his points to the Board. Mr.
Flippen, Mr. Jones and Mr. McShane discussed the site triangle. Mr.
Jones countered that moving this fence does not effect the site
triangle. Mr. Slaby made a motion for him to move his fence by July
20, 1993 or be fined $25.00 a day thereafter. Mr. Slaby amended his
motion to read to remove the obstruction by July 20, 1993 or to be
fined $25.00 a day thereafter. Mr. Carlsson made a motion to amend
Mr. Slaby's motion until July 30, 1993. Motion seconded by Mr.
Imes. Attorney Cool instructed Mr. Carlsson that Mr. Slaby had to
amend his own motion. Mr. Slaby amended his motion to read July 30,
1993. Motion seconded by Ms. Shagner and approved unanimously.
From 8:50 to 9:00, the Board took a short break.
93-18, Roger Freeman
This case complied prior to the hearing and was complied.
93-21, Patrick L. Julian Jr. &/or Paula L. Julian
This case complied prior to the hearing and was complied.
93-23, Sharon S. Owen
Ms. Braddy described the violation on this property. She stated
that the trailer was vacant and still in non-compliance. Mr.
Carlsson made a motion to give the Respondent until June 4, 1993 to
comply or to be fined $25.00 a day thereafter. Motion seconded by
Mr. Imes and approved unanimously.
93-24, Abel &/or Teresa Aguitar
Ms. Braddy explained to the Board that proper notification could
not be obtained. Mr. Carlsson made a motion to continue this case
until the meeting to be held on June 22, 1993. Motion seconded by
(10, Mr. Imes and approved unanimously.

93-25, Garfield Holmes
This case complied prior to the Hearing and was dismissed.
93-30, Betty Pedrick
This case complied prior to the Hearing and was dismissed.
93-31, Betty Pedrick
This case complied prior to the Hearing and was dismissed.
93-32, Paul Newbury &/or Suzanne D. Latimer
This case complied prior to the Hearing and was dismissed.
OTHER BUSINESS
93-08, Roy Lamar Conrad
Mr. Conrad was sworn in at this time by Deputy Clerk Seaver. Mr.
Conrad stated that he needs more time to remove the junk. He stated
that his health and the break down of his vehicle has hindered him
from removing the items. Mr. Sills asked Ms. Braddy if there was an
immediate danger. Ms. Braddy stated no. Mr. Carlsson asked Mr.
Conrad if he could do it in 30 days. Mr. Carlsson made a motion to
extend the date on the original motion still in non-compliance
until June 22, 1993 and get a recommendation. Motion seconded by
Ms. Alexander and approved unanimously.
91-045, Jart Properties, Ltd.
Mr. Raymond Poplar was sworn in by Deputy Clerk Seaver. Mr. Poplar
asked the Board for a reduction of the fines on the property
because it was for sale. Attorney for the company asked for a
reasonable reduction of the fines to proceed with the sale of the
property. James W. Richardson and Ed Newman was sworn in. Mr.
Richardson testimony as to the sale of the property and that it
would go into foreclosure if the sale did not go through. Mr.
Newman stated that he would clean up the property. Mr. Carlsson
made a motion to reduce the fine and lien to $1,000.00. Motion
seconded by Mr. Rich. The vote went as follows: Mr. Sills - yes,
Mr. Rich - yes, Mr. Carlsson - yes, Ms. Shagner - yes, Mr. Slaby -
no, Ms. Alexander - no, Mr. Imes - no. The vote passed 4-3.
91-093, Danny W. &/or Sherry L. Noble
Linda at First American Title was sworn in by Deputy Clerk Seaver.
She asked the Board for a reduction of the fines so they could

proceed with the sale of the house. Mr. Carlsson made a motion to
reduce the fine and lien to $1,000.00. Motion seconded by Mr. Rich.
The vote went: Mr. Sills - yes, Ms. Alexander - yes, Mr. Imes -
yes, Mr. Carlsson - yes, Mr. Rich - yes, Ms. Shagner - no, Mr.
Slaby - no. The vote passed 5-2.

Code Enforcement Officer - No Comments
Police Department - No Comments
Board Attorney - No Comments
Board Members - Robert Imes announced he was resigning from the
Board. Ms. Shagner was sorry Robert was leaving. Mr. Sills said to
keep up the good work.
ADJOURNMENT
Mr. Slaby made a motion to adjourn. Motion seconded by Mr. Imes and
approved unanimously. The meeting adjourned at 9:50 pm.
