HomeMy WebLinkAbout06-22-1993 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING HELD JUNE 22, 1993 ROLL CALL PRESENT: Vice Chairman Jim Sills, Frank Carlsson, Larry Chestney, Robert Imes, Carolyn Alexander, Attorney Ike Cool, Mark Slaby (late) , Deputy Clerk Seaver and Simon. ABSENT: Madeline Shagner, Denise Lenko, David Rich (excused) The meeting was called to order by Vice Chairman Sills at 7:30 pm in the Ocoee Community Center. Vice Chairman Sills led in the Pledge of Allegiance to the Flag and Mr. Carlsson led in prayer. Vice Chairman Sills stated for the record that there was a quorum present. APPROVALS Mr. Carlsson questioned last meeting's minutes on page 2, case number 93-09 in which Mr. Slaby motioned for Mr. Jones to "remove the obstruction by July 20 or be fined $25.00 a day thereafter. Mr. Carlsson stated "my contention, my understanding is that we cannot force anybody to remove anything, we can only say we can find them non-compliance I think that should say non-compliance. Attorney Cool stated "I believe his motion was for the respondent to come into compliance by July 20" . Deputy Clerk Seaver stated "that was not what the tape said" . Mr. Carlsson stated he wasn't saying that the minutes were typed wrong but that he didn't think it was correct and it needed to be corrected. He asked if it would have any bearing on the case, and Attorney Cool replied that yes possibly it could, and he thinks it would be in order for someone to amend the minutes to show that his (Slaby's) motion was to order the respondent to come into compliance by that date not to quote "remove the obstruction" that's the way Attorney Cool stated he remembered it. Carlsson made a motion that the minutes be amended on case number 93-09 where it says to remove the obstruction by July 30 to read to come into compliance by July 20. The motion was seconded by Carolyn Alexander. Vice Chairman Sills stated "we have a motion" . Deputy Clerk Seaver questioned how Slaby's motion could be amended and was told by Carlsson and Attorney Cool that the motion was to amend the minutes, or to correct the minutes. Attorney cool stated he thought a motion to correct the minutes was still in order. Attorney Cool also stated that the majority of the Board remembers that the intent of Slaby's motion was to order Mr. Jones to come into compliance by that date then this motion would be in order as far as he was concerned. Vice Chairman Sills stated "we have a motion on the floor and a second any discussion? The motion was voted on unanimously. Carlsson made a motion to approve the minutes as amended and it was seconded by Carolyn Alexander. Motion was voted on unanimously. Page 2 Code Enforcement Board Meeting June 22, 1993 COMMENTS FROM CITIZENS No Citizens HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARING No cases scheduled. OTHER BUSINESS 93-08 Roy Lamar Conrad No one was present to represent Mr. Conrad. Mr. Conrad had been told at a previous meeting to come into compliance by May 5 or be fined $100.00 a day. Code Enforcement Officer Teresa Braddy was sworn in at this time by Deputy Clerk Shelly Simon. Ms. Braddy gave testimony Mr. Conrad was not in compliance to date and has moved more trash in. The compliance order had been extended from May 5 to June 22, the date of this meeting. Frank Carlsson made a motion to fine Mr. Conrad $100.00 a day effective June 23, 1993 and was seconded by Larry Chestney. Motion was voted on unanimously. 93-23, Sharon S. Owen Sharon S. Owen was sent an Affidavit of Compliance. Elections Vice Chairman Sills opened the nominations for 93-94 Chairman. Frank Carlsson made a motion to nominate Vice Chairman Sills for Chairman. Motion was seconded by Larry Chestney and voted on unanimously. Frank Carlsson made a motion to close nominations for Chairman. Motion seconded by Larry Chestney, and voted on unanimously. Vice Chairman Sills opened the floor for nominations for Vice Chairman for 93-94 year. Larry Chestney motioned to nominate Frank Carlsson for Vice Chairman. Motion was seconded by Carolyn Alexander and voted on unanimously. Page 3 Code Enforcement Board Meeting June 22, 1993 COMMENTS City Manager - Not Present Code Enforcement Officer - No Comments Police Department - Not Present Board Attorney - No Comments Board Members - The Code Enforcement Officer advised the Board that she would be on vacation the week of July 27 during the next meeting. Carlsson made a motion to move the meeting to July 19, motion seconded by Larry Chestney and approved unanimously. ADJOURNMENT Mark Slaby made a motion to adjourn the meeting.
