HomeMy WebLinkAbout07-19-1993 Minutes L MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING HELD ON JULY 19, 1993 ROLL CALL PRESENT: Jim Sills, Frank Carlsson, Larry Chestney, Denise Lenko, Eric Barnett, Madeline Shagner, Attorney Cool ABSENT: Carolyn Alexander (excused) , Mark Slaby (unexcused) Chairman Sills called the meeting to order at 7 :30 p.m. in the Ocoee Community Center. Chairman Sills led in the Pledge of Allegiance to the Flag and Vice Chairman Carlsson led in prayer. For the record, Chairman Sills noted there was a quorum present. APPROVALS Vice Chairman Carlsson made a motion that the minutes from the June 22 meeting be amended to read Chairman Sills stated "we have a motion on the floor. .etc. as opposed to Carlsson stated "we have a motion on the floor. . . etc. This amendment is located on the first page of the minutes, under Approvals fifth line from the bottom of the page. Mr. Carlsson made another motion to amend the minutes in reference to case 93-08, under OTHER BUSINESS where it read Mr. Conrad was told to come into compliance. . .etc, to read Mr. Conrad had been previously told by the board to come into compliance. Both motions were seconded by Ms. Shagner, and voted on unanimously. COMMENTS FROM CITIZENS No citizens HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARING 93-37, Rex Daughtry The property was brought into compliance prior to the Code Enforcement Board meeting and the case was dismissed. 93-38, Linda Porter The property was brought into compliance prior to the Code Enforcement Board meeting and the case was dismissed. 93-36, Daniella Johnson The property was brought into compliance prior to the Code Enforcement Board meeting and the case was dismissed. Page 2 (6, Code Enforcement Board Meeting July 19, 1993 OTHER BUSINESS 91-113, Bellemar Investments Kenneth Hoffman, an attorney was present to represent his client, Charmer Corporation, and was sworn in by Deputy Clerk Simon. Mr. Hoffman explained the history of the property located at 903 Doreen Ave. with Bellemar Investments as the owner of record, and how Charmer obtained a quick claim deed for the property May of this year. He also explained when Greg Millin purchased the property, that he had trimmed the grass and obtained a new roof, and that his intentions are to invest $10,000.00 into the aforementioned property for improvements. Mr. Hoffman requested a reduction in fine since his client had no control of the property until May of this year, and that he has worked on the property since. At this time, Code Enforcement Officer Teresa Braddy was sworn in by Deputy Clerk Simon and Ms. Braddy gave testimony that she had inspected the property approximately four weeks ago and it was very overgrown and not in compliance. She then testified that she had re-inspected the property Thursday, July 15, and the property had been brought into compliance. Mr. Hoffman then stated that his client would be willing to settle the lien for a $1,000.00 and made reference to a letter that he had sent to the Board stating the same. After discussion about the history of the lien from year 91 to date, the approximate accumulation of the lien had been stated by Vice Chairman Carlsson to be over $17,000.00. Ms. Shagner made motion for a reduction in lien to be $1,700.00 which would approximately 10 percent of the accumulated lien. Eric Barnett seconded the motion and it was voted on unanimously. 93-08, Roy Lamar Conrad Frank Carlsson made a motion to impose fine and lien against Mr. Conrad for $100.00 a day effective June 23, 1993. Madeline Shagner seconded the motion and it was voted on unanimously. COMMENTS City Manager - Not Present Code Enforcement - No Comments Police Department - Not Present Board Attorney - No Comments Board Members - Frank Carlsson said he had no comments if Chairman Sills was going to mention the letter. Chairman Sills stated that the letter received from Attorney Hoffman gave him the impression that Ms. Seaver had pre-determined the actions of the board since the letter had included a dollar amount of $1,000.00. Deputy Clerk Page 3 Code Enforcement Board Meeting July 19, 1993 Simon explained that when asked if the Board had reduced fines in the past, and about previous reductions that the Board had made, that Ms. Seaver was only answering Mr. Hoffman's questions. Vice Chairman Carlsson commented to the Clerk not to mention money in the future, that we could acknowledge a possibility of fine reduction but not to get into figures. ADJOURNMENT Vice Chairman Carlsson made a motion to adjourn the meeting at 8:05 p.m. The motion was seconded by Mr. Barnett and voted on unanimously.
