HomeMy WebLinkAbout08-24-1993 Minutes L MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING HELD AUGUST 24, 1993 ROLL CALL PRESENT: Chairman Sills, Vice Chairman Carlsson, Carolyn Alexander, Madeline Shagner, Denise Lenko, Mark Slaby, Eric Barnett, Attorney Ike Cool, Code Enforcement Officer Teresa Braddy, Deputy Clerk Shelly Simon. ABSENT: Larry Chestney, (excused) The meeting was called to order by Chairman Sills at 7 :30 pm in the Ocoee Community Center. Chairman Sills led in the Pledge of Allegiance to the Flag, Vice Chairman Carlsson led in prayer. Chairman Sills stated for the record that there was a quorum present. APPROVALS Chairman Sills noted that when the minutes referenced to a "quick claim deed" that the appropiate word should be "quit claim deed" . The appropiate word was noted and Mark Slaby made a motion to approve the minutes as adjusted. The motion was seconded by Vice Chairman Carlsson and approved unaimously. COMMENTS FROM CITIZENS No Citizens HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARING 93-40, John and/or Colanton Poland The property was brought into compliance prior to the Code Enforcement Board Meeting and the case was dismissed. 93-43, Mary Ryan The property was brought into compliance prior to the Code Enforcement Board Meeting and the case was dismissed. 93-44, Brian Westphal The property was brought into compliance prior to the Code Enforcement Board Meeting and the case was dismissed. 93-41, Joel and/or Jesse Rodriquez fir►, Code Enforcement Officer Teresa Braddy was sworn in at this time Page 2 (hr Code Enforcement Board Meeting August 24, 1993 and presented pictures and testified that the violation was not in compliance. Ms. Braddy testified that some work had been done on the property since being citied; however, it was not brought into compliance. Ms. Braddy testified that she had spoken with the property owner on August 23rd who assured her that the work would be completed by 12 :00 noon on August 24, 1993. Ms. Braddy testified that she had re-inspected the address prior to the meeting and the property still had not been brought into compliance. Vice Chairman Carlsson made a motion to give Mr. Rodriquez until August 30, 1993, to bring the violation into compliance or be fined $50.00 a day thereafter. Eric Barnett seconded the motion and it was approved unanimously. 93-45, Linda Klechka Ms. Braddy testified and presented pictures that the rear yard of the property at 1904 Lauren Beth was overgrown. Ms. Braddy testified she had re-inspected it prior to the meeting on August 24, 1993 and the property was not in compliance. Ms. Klechka was sworn in and testified that due to medical reasons she has been unable to do the work herself, and due to financial and employment problems she had been unable to afford to hire someone to do the work. She stated she would be satisfied with the same extension and conditions as imposed on the prior case (93-41) . Mark Slaby recommended to give Ms. Klechka an extra week to come into compliance. Vice Chairman Carlsson made a motion to find in violation for the rear yard and give Ms. Klechka until August 30th to come into compliance or be fined $25.00. The motion was seconded by Carolyn Alexander and approved unaimously. OTHER BUSINESS No other business. COMMENTS City Manager - Not present Code Enforcement Officer - No comments Police Department - Not present Board Attorney - Attorney Cool announced that five attorneys from his present firm would be leaving and forming a new firm called Pole & Brown P.A. Board Members - Vice Chairman Carlsson inquired if there was a way for the City to go in and mow someone's property when it wasn't in compliance. Attorney Cool replied that there was a new ordinance that addressed this, but it had nothing to do with this Code Enforcement Board. Board members also discussed a concern and interest in knowing if there was anyway to impose a time limit on Page 3 Code Enforcement Board Meeting August 24, 1993 fines when they reduced the amount to insure payment. Attorney Cool advised that although they could reduce fines he didn't think by State Statues that they could enforce a time limit. Chairman Sills requested Attorney Cool to research the subject to see if there was anything that they could do. Chairman Sills advised that Eric Barnett couldn't second a motion since he was an alternate and they had a quorum present. Eric Barnett had seconded the motion for case 93-41/Rodriquez where a Order Of Complaince was imposed. Vice Chairman Carlsson re-stated his motion to give Mr. Rodriquez until August 30, 1993 to come into compliance or be fined $50.00. Marilyn Shagner seconded the motion and it was approved unaimously. ADJOURNMENT Vice Chairman Carlsson made a motion to adjourn the meeting at 8:25 pm.
