MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING HELD
SEPTEMBER 28, 1993
ROLL CALL
PRESENT: Chairman Sills, Vice Chairman Carlsson, Carolyn
Alexander, Madeline Shagner, Larry Chestney, Denise Lenko, Eric
Barnett, Attorney Dwight Cool, Code Enforcement Officer Teresa
Braddy, Deputy Clerk Shelly Simon.
ABSENT: Mark Slaby (excused)
The meeting was called to order by Chairman Sills at 7 :30 pm in the
Ocoee Community Center, Commission Chambers. Chairman Sills led in
the Pledge of Allegiance to the Flag and Vice Chairman Carlsson led
in prayer. Chairman Sills stated for the record there was a quorum
present.
APPROVALS
Vice Chairman Carlsson questioned in reference to case 93-45 if the
word "fine" in violation should read "find" in violation. Carlsson
also asked if he had changed the amount of fine and lien when the
motion had to be re-stated from $50.00 to $25.00 in reference to
case number 93-41. He stated he thought it had been re-stated to
be $50.00 and day; he was advised that he did not change his motion
and he requested the minutes to reflect the $50.00 a day as stated.
Vice Chairman Carlsson motioned for the minutes to be accepted as
amended. The motion was seconded by Madeline Shagner and voted on
unanimously.

HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARING

OTHER BUSINESS
93-41, Joel and/or Jesse Rodriguez
Code Enforcement Officer Teresa Braddy was sworn in at this time by
Deputy Clerk Shelly Simon and testified as of Monday 09/27/93, the
case was still in non-compliance. Vice Chairman Carlsson requested
if the Compliance Order was given to Mr. Rodriguez, and Ms. Braddy
testified a copy was mailed to him. Vice Chairman Carlsson made a
motion to impose fine and lien on case #93-41 as of August 30, 1993
in the amount of $50.00 per day. The motion was seconded by Denise

Lenko and voted on unanimously.
93-45, Linda Klechka
An Affidavit of Compliance was issued regarding this case.
Memorandum from Attorney Ike Cool
Attorney Cool explained to the Board Members that although they had
the right to reduce fines, the law views there responsibilities
very narrow and strictly and he didn't believe they would be able
to impose time limits with fine reductions. Vice Chairman Carlsson
requested to know if a fine was reduced, would it start going up
again if it wasn't paid. Attorney Cool explained once a reduction
was imposed it was a set amount and did not accrue any further
fines. Ms. Lenko wanted to know if there could be an ordinance
passed that would shut someone's water off for not paying a lien.
Attorney Cool explained that was something that would have to be
addressed by the City Commissioners.
89-40, Aubrey Collier
err Thomas Karr was sworn in by Deputy Clerk Simon and testified that
his client, Mrs. Dumas did not own the property when it was cited.
He further testified that it took her a year and a half of
foreclosure proceedings to repossess the property and that the lien
had not shown up during these proceedings. Mr. Karr also stated
that the property was under contract to sell for $12,000.00. Ms.
Braddy then testified that the property was in compliance at this
time. Larry Chestney made a motion to reduce the fine to $1,000.00
for said property in reference to case #89-40. The motion was
seconded by Madeline Shagner and voted on unanimously.

Larry Chestney motioned to adjourn; motion seconded by Vice
Chairman Carlsson and voted on unanimously. The meeting adjourned
at 8:23 pm.
