OCTOBER 26. 1993
ROLL CALL
PRESENT: Chairman Sills, Vice Chairman Carlsson, Carolyn
Alexander, Larry Chestney, Madeline Shagner, Mark Slaby, Denise
Lenko, Eric Barnett, Scott Glass, Attorney Ike Cool, Code
Enforcement Officer Teresa Braddy, Deputy Clerk Shelly Simon.
ABSENT: No absences.
The meeting was called to order by Chairman Sills at 7:30 pm in the
Ocoee Community Center. Chairman Sills led in the Pledge of
Allegiance to the Flag and Vice Chairman Carlsson led in prayer.
Chairman Sills stated that there was a quorum present.
APPROVALS
Vice Chairman Carlsson made a motion to approve the minutes of
September 28, 1993 meeting as printed and distributed. Ms. Lenko
asked about amending her statement in the minutes where she asked
about shutting water off for liens not paid as that was not her
intention. It was explained by Deputy Clerk Simon that's what the
tape reflected, so it was suggested to Ms. Lenko to simply amend
her statement when she gave her comment as a matter of record if
she wished. Ms. Alexander seconded Vice Chairman Carlsson's motion
to approve the minutes and it was voted on unanimously.

HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARING
93-51 Rex Daughtry
Chairman Sills stated there was no one present to represent Mr.
Daughtry. Code Enforcement Officer Teresa Braddy was sworn in at
this time by Deputy Clerk Shelly Simon and testified that the
property located at 1504 Starfire Lane was not in compliance this
date when she inspected in the morning and again at 3:00 pm, but
had come into compliance when she re-inspected it again after 5:00
pm this date. Ms. Braddy also expressed a concern that she has
cited this property numerous times and they don't comply with the
Notice of Violation, but comply right before the Board meets. She
explained that even though Mr. Daughtry had complied right before
the meeting she felt that the Board should hear the case this time.
The Board and Attorney Ike Cool held a discussion about citing
repeat offenders as such and the details of fines and time elements
of accrual of fines on repeat offenders. Attorney Cool stated that

the Board could not find Mr. Daughtry in non-compliance at this
time, but could find Mr. Daughtry in non-compliance of the
compliance date given him on the Notice of Violation he was sent
which was 10/17/93. From that he could be cited in the future as
a repeat offender. Further discussion was given by Board Members
on how a violator would be notified of the Board's actions and of
being cited in the future as a repeat offender. Vice Chairman
Carlsson asked about details of the violation from Ms. Braddy in
reference to how many trailers and what type of junk. Vice
Chairman Carlsson made a motion to find Mr. Daughtry in violation
since he was not in compliance by the date given on the Notice of
Violation which was 10/17/93, and no fine be issued. Mark Slaby
seconded the motion and it was voted on unanimously.
93-52 Linda Porter
Chairman Sills stated there was no one present to represent Ms.
Porter. Ms. Braddy testified that Ms. Porter is the owner of
record at 1504 Starfire Lane and that she has been cited numerous
times and doesn't comply with the Violation Notices or Statements
until right before the Board meets. Ms Braddy testified that on
this violation, Ms. Porter was not in compliance by 10/17/93 the
compliance date on the Notice of Violation sent to her, but was in
compliance of the violations as of the date of this meeting. Vice
Chairman Carlsson made a motion in reference to case #93-52 to find
in non-compliance as of 10/17/93, but no fine be issued. Larry
Chestney seconded the motion and it was voted on unanimously. Ms.
Braddy stated to issue an Order of Non-Compliance, then an Order of
Compliance as a method for notifying the two Respondents of the
Board's actions. Attorney Ike Cool stated that a form should be
made notifying Respondents of the Board's actions and a cover
letter explaining that they could be cited as a repeat offender and
could be fined as of the date the repeat violation is issued.
OTHER BUSINESS
Mark Slaby asked about the letter Attorney Ike Cool distributed at
last month's meeting as Mr. Slaby was not present during the
discussion. Mr. Slaby wanted to know, instead of issuing a time
parameter on a fine reduction, could they consider an amount for
a reduction, and if the Respondent was willing to pay the amount,
could they table the discussion on the reduction until a future
meeting as a method of insuring that the amount would be paid.
Attorney Cool stated the Board wouldn't include it in the motion
but in the discussion. For instance, state that if there was an
amount paid towards the lien, that the Board would table the
discussion on the case until the next meeting before making any
decision. Denise Lenko wanted to state that her intention at last
month's meeting was to say if there was a way not to turn water on
as opposed to "shutting someone's water off" like with the Minimum

Housing Ordinance.

Board Members - Chairman Sills welcomed Scott Glass the new
alternate member to the Board.
ADJOURNMENT
Frank Carlsson motioned to adjourn the meeting at 8:00 pm. The
motion was seconded by Mark Slaby and voted on unanimously.
