HomeMy WebLinkAbout03-26-1991 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING HELD Cre MARCH 26, 1991 ROLL CALL PRESENT: Chairman John Linebarier, Vice Chairman Pitt Varnes, Members Gary Carroll, Robert Imes, Ray Wood, Frank Carlsson, Phillip Rowe, Attorney Ike Cool, Code Enforcement Officers Steve Ross, Rod McDougal and Deputy Clerk Sherry Seaver. ABSENT: None Chairman Linebarier called the meeting to order at 7 :30 p.m. in the Ocoee Community Center. Chairman Linebarier led in the Pledge of Allegiance and Mr. Carroll led in prayer. Chairman Linebarier stated for the record that there was a quorum present. APPROVAL OF MINUTES Mr. Imes made a motion to approve the minutes of the February 26, 1991 meeting as distributed. Motion seconded by Mr. Carlsson and approved unanimously. HEARINGS ON STATEMENTS OF VIOLATION PURSUANT TO NOTICES OF HEARINGS Case 91-052, C. Roger Freeman �r At this time, Code Enforcement Officer McDougal, further known as Mr. McDougal, and Mr. Roger Freeman were sworn in by Deputy Clerk Seaver. Mr. McDougal stated the Nuisance and Menace charge on the property owned by Mr. Freeman and the inspections up to date which left the property still in non-compliance. He stated that a copy of the violation was sent to the owner of the trailer which did not have a tenant. Mr. McDougal presented pictures of the property for the Board to review. Chairman Linebarier asked Mr. McDougal why he had not cited the owner of the trailer. Mr. McDougal stated that this case had already started processing before he had been instructed to cite the tenant. Mr. Freeman stated his name and address for the record. He stated that he tried his best to get the property cleaned up but the owner of the trailer, Jack Carr located in Orlando, did not want him to remove the junk. Mr. Freeman stated that he would like to see the tenant cited also because it is hard for him to take care of the problem when he can not legally enter the property. Chairman Linebarier asked how long he would need to evict the owner of the trailer. Mr. Freeman stated approximately 30 days. Mr. Carlsson made a motion to continue this case until the April 23, 1991 meeting and to cite the tenant and bring him to the next meeting. Motion seconded by Mr. Rowe and approved unanimously. L (rimw Page 2 Code Enforcement Board Meeting March 26, 1991 91-045, Jart Properties, Ltd. At this time, Code Enforcement Officer Ross, further known as Mr. Ross, was sworn in by Deputy Clerk Seaver. Mr. Ross stated that this company was leasing and renting warehouse and office space in the City without a City Occupational license. Mr. Ross stated that he had made many attempts to contact someone with no response. He stated that no one has made any effort to even turn in an application. Chairman Linebarier stated for the record that there was no one present to represent this case. Mr. Ross presented pictures to the Board for review. Mr. Imes made a motion to find the Respondent in non-compliance and to give them until April 1, 1991 to obtain a license or be fined $150.00 a day thereafter. Motion seconded by Vice Chairman Varnes and approved unanimously. 91-049, Robert M. &/or Dreama J. Varnes Mr. Carlsson made a motion to continue this case until the April 23, 1991 meeting. Motion seconded by Mr. Imes and approved unanimously. OTHER BUSINESS 90-105, General Service Repair, Inc. Chairman Linebarier stated that this case had complied a few days after the judgement made last meeting. Mr. Imes made a motion to reduce the fines to $00.00. Motion seconded by Vice Chairman Varnes. Mr. Carlsson stated that he thought the Board was setting a bad example. Motion was approved unanimously. COMMENTS City Manager - Not Present Code Enforcement Officers - No Comments Police Department - Not Present Board Attorney - Mr. Cool explained the citation system that could possibly be used as a form of code enforcement.
