ROLL CALL
PRESENT: Chairman Phillip Rowe, Vice Chairman Ray Wood, Robert
Imes, Frank Carlsson, Attorney Cool, Code Enforcement Officer Rod
McDougal, Sergeant Steve Goclon, Jim Sills, and Deputy Clerk Sherry
Seaver.
ABSENT: Steve Ross, Gary Carroll and Madeline Shagner (excused)
Chairman Rowe called the meeting to order at 7 :30 p.m. in the Ocoee
Community Center. Chairman Rowe led in the Pledge of Allegiance to
the Flag. Mr. Carlsson led in a word of prayer. Chairman Rowe
stated for the record that there was a quorum present.
APPROVALS
Mr. Imes made a motion to approve the minutes of the July 23, 1991
Code Enforcement Board Meeting as printed and distributed. Motion
seconded by Mr. Carlsson and approved unanimously.
HEARINGS ON STATEMENTS OF VIOLATION PURSUANT TO NOTICES OF HEARING
91-81, Alex G. Kawa
This case complied prior to the Hearing and was dismissed.
91-082, Wilma T. Terry
This case complied prior to the Hearing and was dismissed.
91-086, Robert E. Miller, Esquire
Chairman Rowe stated for the record that there was no one present
to represent this case. At this time Code Enforcement Officer
McDougal was sworn in by Deputy Clerk Seaver. Mr. McDougal stated
the inspection dates in this case. He stated that the property was
overgrown and that the unfinished pool was stagnant. He also stated
that there was no fencing around the pool. Mr. McDougal stated that
he has had no contact with Mr. Miller. Mr. Carlsson asked why Mr.
Miller was being cited as the registered agent for Galante
Development Group instead of Galante Development Group in care of
Mr. Robert E. Miller, Esquire? Mr. Carlsson made a motion to table
this case until the September 24, 1991 meeting. Motion seconded by
Mr. Wood. Mr. Carlsson withdrew his motion. Mr. Wood withdrew his
second. Mr. Carlsson made a motion to dismiss the case as cited.
Motion seconded by Mr. Wood and approved unanimously.

OTHER BUSINESS
90-15, Silver Ark Limited, Inc.
Mr. Bill Riske was sworn in by Deputy Clerk Seaver. Mr. Riske
approached the podium and began with stating that Silver Ark
Limited, Inc. made every effort to clean this property at the time
of citation. He stated that it took longer to complete than he
thought. Mr. Riske explained that he has always made every effort
to work with the City. Mr. Riske asked that the fine and lien be
released. Mr. Don Flippen, Building and Zoning Official, was sworn
in by Deputy Clerk Seaver. He stated that Mr. Ross followed the
proper procedures and the fine was recorded correctly. He stated
that Mr. Ross hand delivered the hearing notice for March and if
Mr. Riske had attended this meeting this might have been taken care
of then. Mr. Flippen stated that this case cost the City time and
money and that he had no recommendation for or against. Mr.
Carlsson asked Mr. Flippen for an estimated cost of labor and
materials. Mr. Flippen stated approximately one thousand dollars
($1,000.00) . Mr. Carlsson made a motion to reduce the fine against
Silver Ark Limited, Inc. from $3750.00 to $1500.00 to cover the
City's Cost. Motion seconded by Mr. Imes. At this time, Mr. Riske
reapproached the podium and stated that he wanted the Board to know
that they were working on the problem and not just sitting there.
Mr. Carlsson stated that he could not see reducing it to $0.00. The
vote went as follows: Chairman Rowe "AYE" , Vice Chairman Wood
"NAY" , Jim Sills "Nay" , Robert Imes "AYE" , Frank Carlsson "AYE" .
The motion passed by a 3-2 vote.
91-079, Fantastic Sams
Mr. McDougal asked the Board for a continuance on this case because
Mr. Ross was not present. Mr. Carlsson made a motion to continue
this case until the September 24, 1991 meeting. Motion seconded by
Mr. Imes and approved unanimously.
