OCTOBER 23, 1990
ROLL CALL
PRESENT: Chairman John Linebarier, Vice Chairman Pitt Varnes , Members
Gary Carroll , Frank Carlsson, Phillip Rowe, Ray Wood, Robert Imes ,
Attorney Ike Cool , Code Enforcement Officers Rod McDougal and Steve
Ross , and Deputy Clerk Sherry Seaver.
Chairman Linebarier called the meeting to order at 8 :16 p.m. in the
Ocoee Community Center. Chairman Linebarier led in the Pledge of
Allegiance to the Flag. Mr. Carlsson led in prayer. Chairman Linebarier
stated for the record that there was a quorum present.
APPROVAL OF MINUTES
Mr. Imes moved to approve the minutes of the September 25, 1990 meeting
as printed and distributed. Motion seconded by Mr. Rowe and approved
unanimously.
HEARINGS ON STATEMENTS OF VIOLATION PURSUANT TO NOTICES OF HEARINGS
Case 90-105, General Service Repair, Inc.
At this time, Code Enforcement Officer Ross was sworn in by Deputy
Clerk Seaver. Code Enforcement Officer Ross stated that the property
was located in C-2 zone and the business could not display merchandise
outside of the store unless so screened. He stated the inspections in
this case, which all were in non-compliance. Code Enforcement Officer
Ross presented pictures to the Board that were taken on October 22 ,
1990 . Chairman Linebarier asked if there was any screening. Code
Enforcement Officer Ross stated that there was a chain link fence. At
this time, Mr. Neil McKenzie was sworn in by Deputy Clerk Seaver. Mr.
McKenzie tried to present pictures to the Board, however, the Board
would not look at them because it did not pertain to this particular
case. Chairman Linebarier read Chapter IV Section 9 . 2 of the Code of
Ordinances for the City of Ocoee. Mr. McKenzie discussed the Code in
reference to C-i zoning. Mr. McKenzie stated that the City granted him
an Occupational License knowing about his business . Mr. McKenzie asked
Chairman Linebarier for a recommendation. Mr. Carroll stated that the
Board could only recommend what the Code states . Mr. McKenzie stated
that Mr. Julian Harper of the City of Ocoee Planning Department told
him it would cost him $750. 00 for a variance application fee and that
did not mean he could get one. Mr. Carroll made a motion to find the
Respondent in non-compliance and to give the Respondent 120 days to
apply and obtain a variance or to be brought back before the Board and
to be fined $50. 00 a day thereafter. Motion seconded by Mr. Carlsson
and approved unanimously.
L. Case 90-121 , Ernest G. &/or Ivonna P. Hataway
The location of this case is 147 Lyle Street, Ocoee , Florida. The

violations were Junk Vehicles and Nuisance and Menace to Public Health.
Code Enforcement Officer Ross stated that he had received a letter from
Mr. Hataway on September 10 , 1990 . On October 17 , 1990 Mr . Hataway
called City Hall and spoke with Mr. Ross in reference to this property.
Chairman Linebarier asked when the letters were received. Code
Enforcement Officer Ross stated that one was received in September and
one in October. He also stated that he told Mr . Hataway on the phone
that these cases would be going before the Board and he needed to be
there . Code Enforcement Officer Ross stated that the junk vehicle
violation had been complied with. Code Enforcement Officer Ross
presented the letters and pictures to the Board. Mr. Hataway is located
in Arkansas. Mr. Wood made a motion to find the Respondents in non-
compliance and to give them until November 7 , 1990 to comply or to be
fined $100 . 00 a day thereafter. Motion seconded by Mr. Imes . Mr. Wood
made a motion to amend his motion to read: to find the Respondents in
non-compliance and to give them until November 15, 1990 to comply or to
be fined $100 . 00 a day thereafter. Motion seconded by Mr. Imes for the
amendment and approved unanimously. At this time all motions and
amendments were withdrawn by Mr. Wood and Mr . Imes . Mr. Wood made a new
motion to find the Respondents in non-compliance and to give them until
November 15 , 1990 to comply or to be fined $100 . 00 a day thereafter .
Motion seconded by Mr. Imes and approved unanimously.
Case 90-122 , Ernest G. &/or Ivonna P . Hataway
This case is located at 141 Lyle Street, Ocoee , Florida. The violations
for this case were Junk Vehicles and Nuisance and Menace to Public
Health. These vehicles had not been moved in years . Code Enforcement
Officer Ross stated that this was the worst property that he has seen.
Mr. Wood asked what the barrels contained. Code Enforcement Officer
Ross stated that there was water and possibly hydraulic fluid. Mr. Rowe
asked if they were covered. Code Enforcement Officer Ross stated yes.
Mr. Carlsson made a motion to find the Respondent in non-compliance and
to give them until November 15, 1990 to comply or to be fined $100. 00 a
day thereafter for the Junk Vehicle violation and $100 .00 a day
thereafter for the Nuisance and Menace to Public Health violation.
Motion seconded by Mr. Imes . Mr. Carlsson stated for the record that
there was no one present to represent this case and the Board was
working from the letter sent to Code Enforcement Officer Ross . Motion
passed the Board with a unanimous vote.

Mr. Imes made a motion to adjourn. Motion seconded by Mr. Carlsson and
approved unanimo ly. Meeting adjourned at 9:20 p.m. .
