NOVEMBER 27, 1990
ROLL CALL
PRESENT: Chairman John Linebarier, Vice Chairman Pitt Varnes, Members
Gary Carroll, Phillip Rowe, Frank Carlsson, Attorney Ike Cool , Police
Sergeant Chuck Seaver, Code Enforcement Officers Ross and McDougal and
Deputy Clerk Sherry Seaver.
ABSENT: Ray Wood and Robert Imes
APPROVAL OF MINUTES
Mr. Carlsson made a motion to approve the minutes of the October 23,
1990 meeting as printed and distributed. Motion seconded by Mr. Rowe
and approved unanimously.
HEARINGS ON STATEMENTS OF VIOLATION PURSUANT TO NOTICES OF
HEARING
Case 90-130, Lake Lotta Ltd.
At this time, Code Enforcement Officers Ross and McDougal were sworn in
by Deputy Clerk Seaver. Code Enforcement Officer McDougal stated that
this property was undeveloped and the violations were prompted by
complaints from the residents from Rose Hill Subdivision. Mr. Carroll
asked Code Enforcement Officer McDougal if this property was between
the shopping center and the subdivision. Code Enforcement Officer
McDougal stated that the property was located between White Road and
Highway 50. He also stated that he made many attempts to contact
someone in reference to this case but he was unsuccessful. Chairman
Linebarier stated for the record that there was no one present to
represent this case. Code Enforcement Officer McDougal presented
pictures to the Board. Mr. Carlsson made a motion to find the
Respondent in non-compliance and to give them until December 4, 1990 to
comply or to be fined $150. 00 a day thereafter. Motion seconded by Mr.
Rowe and approved unanimously.
Case 90-131, Domenic A. Macaione C/O Whitehill Group Ltd.
Code Enforcement Officer McDougal stated the inspections in this case.
He stated that as of November 27, 1990 there was no change in the
condition of the property. He also stated that he made many attempts to
contact someone in reference to this case but no one responded. He
presented pictures to the Board to review. Chairman Linebarier stated
for the record that there was no one present to represent this case.
Attorney Cool asked Code Enforcement Officer McDougal for confirmation
on the owner of the property. Code Enforcement Officer McDougal stated
that according to Orange County Tax Records he was the correct owner.
lime Mr. Carroll made a motion to find the Respondent in non-compliance and
to give them until December 4, 1990 to comply or to be fined $150.00 a
day thereafter. Motion seconded by Mr. Varnes and approved unanimously.

Case 90-132, Linda Marlene Vandergrift
Code Enforcement Officer Ross stated the inspections in this case. He
also stated that the pool was still stagnated therefore remained in
non-compliance. At this time, Linda Marlene Vandergrift was sworn in by
Deputy Clerk Seaver. Ms. Vandergrift stated that she realized she was
in non-compliance but she could not afford to correct the problem. She
also stated that the pool had problems that she could not fix. Mr.
Carroll asked Ms. Vandergrift if she used his pool pump could she clean
up the pool and bring it into compliance. She stated yes. Mr. Carlsson
made a motion to find the Respondent in non-compliance and to give her
until December 17 , 1990 to comply or to be fined $50. 00 a day
thereafter. Motion seconded by Mr. Varnes and approved unanimously.
Case 90-137 , Nelson H. &/or Neva M. Boehm
This case complied before the hearing and was dismissed by the City.
Case 90-139, Juan A. Torres &/or Lillian Rubin
This case complied before the hearing and was dismissed by the City.
Case 90-140, Edgardo &/or Natalie A. Caruso
This case complied before the hearing and was dismissed by the City.
Case 90-141, Edward E. &/or Betty A. Swann
This case complied before the hearing and was dismissed by the City.
OTHER BUSINESS
Case 90-122, Ernest G. &/or Ivonna P. Hataway
Code Enforcement Officer Ross updated the Board that the violation of
the nuisance and menace to public health was still in non-compliance as
of November 27 , 1990. At this time, Mr. Ernest G. Hataway was sworn in
by Deputy Clerk Seaver. Mr. Hataway asked the Board to give him an
extension so that he could build him a shed and put all of his stuff in
to get it out of the yard. He also asked the Board about how he went
about getting a permit. Chairman Linebarier stated that he would have
to see the Building Department for that. Mr. Hataway explained that the
reason it was taking so long was because his wife was sick. Mr. Carroll
made a motion to waive the fines and to give them until December 11 ,
1990 to compliance with the Compliance Order or for the fines to be
retroactive back to November 15, 1990 as the intial date set in the
Compliance Order. Motion seconded by Mr. Carlsson and approved
NIOIF unanimously.

C. Police Department - Sgt. Seaver stated that the Code Enforcement
Staff has been a big help to the Police Department.

E. Board Members - Mr. Carlsson wished everyone Happy Holidays.
F. Citizens - No Comments
ADJOURNMENT
Mr. Carroll made a motion to adjourn the meeting. Meeting adjourned at
9:20 p.m. .
