PRESENT: Chairman Carlsson, Vice Chairman Ed Foley, Members
Joe Marbais, Gary Carroll and John Linebarier, Attorney John
Hatcher, Building Inspector Bill Hager and Deputy Clerk Susan
Amesbury.
ABSENT: Members Bob Sorenson, Mary Ellen Frame and Alternate
Donald Barker.
Chairman Carlsson called the meeting to order at 7:29 p. m.
and led everyone in the Pledge of Allegiance to the flag.
Mr. Linebarier led everyone in prayer.

Mr. Linebarier called to the attention of Chairman Carlsson
the fact that Mary Ellen Frame and Bob Sorenson have missed
the last two (2) meetings. He also stated that according to
the by-laws the members must notify the Board Chairman if
there is a problem with attending a meeting. Chairman
Carlsson directed Deputy Clerk Amesbury to write a letter to
Mrs. Frame and Mr. Sorenson asking them to contact him prior
to the meeting if they cannot attend. Mr. Linebarier made a
motion to approve the minutes of the April 14, 1986 meeting
as printed and distributed, seconded by Mr. Marbais and
( approved unanimously.

Case 86-4v Carolind M. Gilpin - Junk Vehicle
Tony Senador was present to represent Carolind M. Gilpin. He
stated that he was her husband and her current name was
Carolind Senador. Mr. Senador and Building Inspector Hager
were sworn in by Deputy Clerk Amesbury. Mr. Senador stated
the car in question was purchased for racing purposes and
that was the reason the car was not tagged. Mr. Senador
objected to the process by the City and stated he would like
to be notified in person instead of by certified mail. He
also stated that the notices came to his wife and the car was
in his name. Building Inspector Hager stated that the car
was currently in the driveway and not tagged. Mr. Senador
questioned what makes a car a "junk vehicle". Mr. Linebarier
answered that in this case the car was classified as a junk
vehicle because it was not driveable since it was not tagged.
Chairman Carlsson read Section 21-36 from the City Code to
Mr. Senador. Mr. Senador stated that he does not like the
phrase "junk vehicle", and he takes it personally. Attorney
Hatcher stated that the City Commission gave the definition
to the phrase and Mr. Senador needed to address his

objections to them. Mr. Linebarier explained that Mr.

Senador could not have the car in the street or the driveway
unless it is tagged and operable; therefore he needed to tag
the car so it would be street operable or get rid of it. Mr.
Linebarier asked Mr. Senador how long he needed to sell the
(low car or to strip it for racing. Mr. Senador could not answer
� this question. Mr. Carroll asked Mr. Senador if he could
sell the car in ten ( 10) days. Mr.• Senador stated that he
was not sure. Attorney Hatcher stated that the Code
Enforcement Board sits in Judgement of the City° s activities
and the Board would consider how much of a time frame is
reasonable if, in fact, there is a violation. Mr. Linebarier
moved to find the respondent/owner Carolind Gilpin in non-
compliance under the provisions of Section 21-36 and 21-40 of
the Ocoee City Code, seconded by Mr. Carroll. Mr. Linebarier
then questioned if Carolind Gilpin could be held responsible
for the car when it was parked in the street (public right-
of-way) . Mr. Linebarier asked Mr. Senador if the car was in
his name only and Mr. Senador answered yes. Mr. Marbais
stated that the car was in violation and asked the Board what
they wanted to do. Mr. Senador stated that he felt 30 days
was a reasonable amount of time to tag or sell the car. At
this time Mr. Linebarier withdrew his motion and Mr. Carroll
withdrew his second. Mr. Carroll moved to dismiss the case,
seconded by Mr. Linebarier and motion passed unanimously.
Attorney Hatcher stated for the record that if the car to be
cited as a junk vehicle was parked on a City Street the
section of the Code violated would be 21-39 instead of 21-36
and 21-40. He further explained that if a car is on private
property the property owner should be cited and if a car is
on a public street the auto owner should be cited.
