ABSENT: Board Members Bourdo, James and Barker, with excuse
CALL TO ORDER: Chairman Linebarrier called the meeting to order at 7:30 pm.
He then led those present in the Pledge of Allegiance to the Flag.
APPROVAL TO THE MINUTES OF THE AUGUST 13, 1984 MEETING: Mr. Sorrenson
moved to approve the August 13, 1984 minutes as typed and distributed. Mr.
Carlsson seconded the motion and the vote was carried unanimously.
CHAIRMAN LINEBARRIER: Before going over the Hearings on Statements of
Violations Pursuant to Notices of Hearing, Mr. Linebarrier asked that the
Board go over the Notices from the August 13, 1984 meeting that were not
on the agenda for the evening.

Ken Griffin, Code Enforcement Officer gave the above information on the
cases in question.
HEARINGS ON STATEMENTS OF VIOLATIONS PURSUANT TO NOTICES OF HEARING:
84-7 Billy Battes - The Code Enforcement Officer, Ken Griffin stated that
Mr. Battes called him and said that this is not his property. After some
discussion Mr. Colborn made a motion to extend this case to the next
scheduled meeting, giving the Code Enforcement Officer time to confirm the
ownership of the property. The motion was seconded by Gary Carroll and the
vote was carried unanimously.
84-15 Hal Cundiff - Mr. Cundiff was not present at the meeting. The Clerk
has Proof of Service for the Notice of Hearing. The Code Enforcement Officer
stated that he had inspected the property that very evening and Mr. Cundiff
was still in violation. Grass is 15 to 16 inches high. This case has been
going on since June of 1984. Mr. Sorrenson moved to find Mr. Cundiff in
Violation. Notice will be served on Tuesday the 9th of October. Mr. Cundiff
has until Friday the 12th of October to comply. A penalty of $15.00 a day
will be imposed on Mr. Cundiff for each day thereafter until compliance.
84-4900 Rosi Handley - The Code Enforcement Officer stated that he inspected
this property that evening and Ms. Handley was still in violation. The back
yard is unmowed and the weeds exceed the code limits. This case has been
going on since June of 1984. Mr. Carlsson moved to find Ms. Handley in
Violation. Notice will be served on Tuesday the 9th of October. Ms. Handley
has until Friday the 12th of October to comply. A penalty of $15.00 a day
will be imposed on Ms. Handley for each day thereafter until compliance.
84-4848 Rex Gann - The Code Enforcement Officer request the the case be con-
tinued until the next meeting. Mr. Gann has moved to Orlando. Before making
a decission on this case Mr. Griffin needs to make sure that this abandoned
vehicle is in deed Mr. Ganns. Mr. Colborn moved to continue the case until
the next meeting, giving the Code Enforcement Officer time to determine own-
ership of the vehicle. Mr. Sorrenson seconded the motion and the vote was
carried unanimously.

OTHER BUSINESS:
CITY BUILDING OFFICIAL: The Code Enforcement Officer, Ken Griffin spoke for
Mr. Cohen the Building Official. Case #84-5, Frank Griffis, 109 E. Silver-
star Road has been condemned by the City Building Official. The Attorney
is proceeding with condemnation. The City currently has a lien against the
property. Property on Franklins Street belonging to Ruby Reeves has also
been condemned by the Building Official, the Attorney is proceeding with
condemnation.
ATTORNEY, J. HATCHER: Mr. Hatcher asked that the Code Enforcement Officer
distribute to the Board members as soon as possible a Memo concerning new
legislation requiring declaration of voting abstantions. Purpose of this
memo is to explain voting duty and limited right to abstain and the proce-
dured for both and introduction of CE FORM 4.
There was question about last sentence in paragraph 2.4G in the Proposed Ad-
ministrative Rules, Quorum. After some discussion regarding this rule a
• motion was made by Mr. Sorrrenson to delete the last sentence of paragraph
2.4G of the Code Enforcement Proposed Administrative Rules. The motion was
seconded by Mr. Colborn and the vote was carried unanimously. The reason
for deletion of this sentence is so that the rules will read that a majority
vote will carry, that four of four is not required to pass any motion.
COMMENTS FROM THE PUBLIC/CITIZENS: The Code Enforcement Officer presented
to the Board a request from Joe Marbais regarding Pioneer Key Park I. After
reviewing the request, the Chairman requested the Code Enforcement Officer
to investigate the alligations. He stated that the Board cannot act upon
citizen complaint directly, the complaints must first go through Code Enfor-
cement Officials, dealt with accordingly and then brought before the Board.
The Chairman then requested the Code Enforcement Officer, Ken Griffin to
write a letter to Mr. Marbais explaining these regulations to him and making
him aware that the board acknowledged his complaints.
John Linbarrier motioned to refer the letter to Mr. Griffin with cover letter,
requesting Ken to reply to Mr. Marbais, RE: Items not covered by City Code,
such as mobile home zoning and skirting. Frank Carlsson seconded the motion
and the vote was carried unanimously.
COMMENTS FROM THE BOARD MEMBERS: Chairman John Linbarrier asked the Attorney
if he must resign his seat on the Code Enforcement Board in order to run
for the City Commissionor could he wait until after the elections. The
Attorney said he would investigate and advise Mr. Linebarrier accordingly.
ADJOUNMENT: Gary Carroll motioned to adjourn the meeting at 9:03pm. The
motion was seconded by Mr. Sorrenson and the vote was carried unanimously.
