Review of the International Property Maintenance Code to replace existing Chapter 108-
Minimum Standards Ordinance:
Denise Lenko stated she did not like the new code and stated it should not replace the
existing Minimum Standards Ordinance. I asked specifically what she didn't like about
the International Code, and she stated it wasn't direct enough, 108 was clearer to her. I
told her I found the comparison of the 2 codes to be opposite of that, and inquired as to
what part wasn't clear to her. I suggested at this point to go through the new code,
section by section, and discuss any issues that weren't clear.
The first 5 Chapters were reviewed with the following comments:
The first issue was enforcement. Ms. Lenko stated that she did not believe the
International Property Maintenance Code or IPMC, spelled out the Board's authority of
enforcement of the code. I explained to her that all codes adopted by the city were
enforced by the city, and/or its designated employees, and the CEB was the hearing board
for any violations that did not comply. Ms. Lenko stated it should say that somewhere.
Lenko questioned the description of enforcement, and the appeals process. I relayed that
in Ordinance 108, there was a similar appeals process as well, with the exception of the
Board being City staff, however it has never been used. It was suggested that the appeals
section be omitted, CEB process has an appeals process. Lenko wanted to ensure that the
new ordinance stipulated the section was enforceable through the Code Enforcement
Board process. It was suggested that perhaps verbage of some kind could be added to the
new ordinance to include a statement that it was enforceable pursuant to Chapter 7 of the
Ocoee Code of Ordinances. This is something that can be put in the recommendation for
the city attorney to review for appropriateness and language.
Lenko stated that she wanted to see the definition of a family from Chapter 108,
implemented in the new ordinance citing that the existing definition was much thorough.

It was discussed whether the definition weeds would effectively cover all cases of yards
that were not maintained. It was decided in the meeting that it would.
The IPMC does not address the installation of Mobile Homes. I advised the committee
we will use the standards as established by DMV for existing mobile home tie-downs,
and new installations were covered by state guidelines as well as the city's permitting and
inspection process.
It was discussed that somewhere there should be comments on Handicap Parking
requirements. I advised that there were federal and state requirements that address this
area. The junk vehicle ordinance was discussed as it pertained to the new code. There is
much disagreement as to what constitutes a junk vehicle. This section may have to be
omitted, and the existing junk vehicle ordinance reviewed for any possible changes or
amendments. Although a couple members were satisfied with the definition of a junk
vehicle in the IPMC.
At the next meeting, the committee will review section by section, as they did at this
meeting, until the entire review of the International Property Maintenance Code has been
reviewed, then the committee will formulate a recommendation as to what portions
should be excepted, what part of Chapter 108 can be replaced, and forward to the
Building Official and City Manager for their review.

Code Enforcement Supervisor Simon called the meeting to order at 5:28 p.m. in the City
Commission Chambers Conference Room.
PRESENT: Code Enforcement Supervisor Simon, Members Konicek, Skiles and Lenko.
Administrative Assistant II Maxwell was also present.
ABSENT: Commissioner Howell

Review Chapter 108
Member Lenko stated she was against replacing existing Chapter 108-Minimum Standards Ordinance
with the International Property Maintenance Code. Chairman Simon asked Member Lenko to clarify
exactly what she did not like about the I.P.M.C. Member Lenko stated the I.P.M.C. was too simplified
and vague but Chapter 108 is easier to comprehend. Discussion ensued. The committee decided to
review the I.P.M.C. section by section.
Member Lenko stated the I.P.M.C. did not deal with the Code Enforcement Board's authority on any
level. Chairman Simon advised Member Lenko that the I.P.M.C. dealt with building codes not code
enforcement. Discussion ensued. After discussion, it was suggested that the appeals process section be
omitted and some verbage could be added to the new ordinance to include a statement that was
enforceable through the Code Enforcement Board Process pursuant to Chapter 7 of the Ocoee Code of
Ordinances.. Chairman Simon stated that recommendation could be brought before the city attorney to
review for appropriateness and language.
Member Lenko stated she would like to see the definition of"family" in Chapter 108, implemented in
the new ordinance citing that the existing definition of"family"was more through. Discussion ensued.
Chairman Simon stated the I.M.P.C. does not address the installation of Mobile Homes and standards
