Department Director: Chart S .,,j • 4-,- :; Contact Number: (407) 905-3159 City Manager: Robert Fra;�,� / ' or " Subject: City of Winter Garden constructing 780' of 8" water main from the outhwest Development Utility Improvements Phase II; District 1 Commissioner Firstner Background Summary: The Southwest Development Area (SWDA) is comprised of five (5) parcels of land located in the southwest corner of the City of Ocoee, more specifically adjacent to Tomyn Boulevard/Windermere Road and Roberson Road between Patriots Point Drive and Wesmere Parkway. Each parcel on its own would not be large enough (developmental density) to extend utilities to support the parcels' development. Therefore, the City initiated a "Southwest Development Utility Project" causing the needed utilities to be designed and permitted; and the construction of Phase 1 and the North Phase of the project (see attached Diagram 1: Southwest Development Utilities Improvements.) Phase II of the project is planned to be constructed by the first of the developing parcels along Roberson Road. To cover the construction cost of the project, each of the parcels upon development shall reimburse the City their fair share. Legacy Lifestyle of Ocoee, that appears to be the first developing parcel, has agreed to construct Phase II. Legacy will be allowed to use their fair share obligation and their water/sewer capital fees to offset construction cost. Legacy must provide needed funds over their fair share and capital fees if construction cost are more than the combined share and fee; and reimburse the difference if the construction cost if less than their total obligation. At the time of this action, Legacy has not begun any work on the needed utilities. The City of Winter Garden has scheduled within the next sixty (60) days the reconstruction of the Roberson Road &Windermere Road intersection utilizing a roundabout configuration. There is seven hundred eighty (780) feet of 8" of the Phase II water main in the construction limits of the Winter Garden's roundabout project and both Cities' staff agrees the water main should be constructed by Winter Garden. Winter Garden has publicly bid the work and proposes to construct the 8" water main (see attached letter from Winter Garden) based on Ocoee's reimbursement of the cost in the amount of $56,884.40 (construction cost plus 15% contingency.) The remaining portion of the Phase II project will remain the responsibility of the first development on Roberson Road. The City Attorney has reviewed Winter Garden's proposal letter and had no exception to accepting the letter's conditions. Issue: Should the City Commission approve the City of Winter Garden constructing 780' of 8" water main from the Southwest Development Utility Improvements Phase II? Recommendations: Motion to authorize City Manager to accept the City of Winter Garden's proposal to construct 780' of 8" Water Main in the amount of$56,884.40. Attachments: 1. Legacy of Life Letter of Understanding Financial Impact: The total Southwest Project construction cost was estimated at $636,266.50 in October of 2014, but was increase by $126,117.64 to $762,390.00. The increase, by change order to the phase I project, was needed for upsizing lines serving Inspired Living @ Ocoee (reimbursed by Inspired Living.) The original Engineer's Estimate of the Probable Cost for Phase II construction in 2014 was $386,515.50, with a present day adjusted amount of $440,000. Legacy's total commitment to the City for its fair share and capacity fees is $597,358.44, requiring Legacy to make an estimated cash payment to the City of $157,360.00. In addition, any offset expenses incurred by Winter Garden's work will increase the amount owed by Legacy to the City. Finally, funding for the Winter Garden construction will come from the Carry Over Project Funding (408-531-00-6302) and shall be replaced upon receipt from Legacy or other developers along Roberson Rd. The attached tabulation of bids represents a summary of unit prices for the received bid from Atlantic Civil Constructors Corporation. The bid received appears to be in proper form and is complete and properly executed. The bidder has acknowledged receipt of all addenda as prescribed and has submitted proposal to comply with other bidding requirements and we believe that this bid proposal is in conformance in all material respects to the invitation for bids and is therefore a responsive bid. The City of Ocoee's utility work was included in the bid documents as Additive Alternate 1, and the bid price for this work came in at $49,464.70. The Engineer's Estimate for this work was $57,060.00. It's our understanding that the City of Ocoee has elected to accept this bid price and has elected to have Atlantic Civil Constructors Corporation perform the work. Whereas stated in the Developers Agreement,the Developer is required to pay a prorated portion of the Southwest Development Utility Improvements Phase I construction and manage and construct the City's Southwest Development Utility Improvements Phase H project. Legacy Lifestyles Ocoee Property,LLC acknowledges and agrees the following methodology,calculations and payment agreement. Calculations of Water and Sewer Capital Charges Fees: a. Prorated portion of the Southwest Development Utility Improvements Phase I=$211,500.00 b. City Water and Sewer Capital Charges fees=$385,858.44 c. Developers total Water and Sewer obligations=$597,358.44 Calculations of Developers Water and Sewer Credits: a. Final construction cost of the Southwest Development Utility Improvements Phase II=TBD** **(cost to be the actual cost to construct Phase II project including any and all City/County requested changes and revisions) b. Development/Management Fee of 5%on the final agreed Phase II construction cost. Developers Final Water and Sewer Capital Charges Fees Obligations and Costs: The total sum of the Water and Sewer Fees defined above=$597,358.44 Less the total sum of the Developers Water and Sewer Credits as defined above=TBD.
