BACKGROUND SUMMARY:

Fountains West PUD property is located on the northeast corner of the intersection of West Road and Ocoee-
Apopka Road. The property encompasses approximately 43.03 acres of land of which approximately 4.73 acres
was designated as wetland/conservation and was dedicated to the City. Additionally, as part of the onsite wetland
mitigation, 1.1 acres was dedicated to the City as a Public Trail (Tract G). The approved PUD created eight (8)
commercial lots of which one (1) lot is designated as a shopping center (Lot 6-Publix) and another as a large
church facility (Lot 8-Living Waters Church). The permitted uses are indicated on a development matrix chart on
sheet C-10 with revised uses on LUP-2 of the Land Use Plan.
The applicant, Summit Construction is requesting a Substantial Amendment to the PUD to change the permitted
uses of Lot 8, from a Church use to include Commercial, Self-storage, and daycare uses. The revision to the
PUD also includes phasing in two separate phases. Phase 1 will include a 102,600 square foot three-story indoor
self-storage facility and possible 18,000 square feet of retail space or Day Care. The self-storage is proposed to
be accessed via internally drive isles within the building. The applicant is working on providing a future location for
the Ocoee Fire Department in phase 2.
The original PUD approved a maximum trip count for Lot 8 of 519 Daily Trips and 38 PM Peak Hour Trips. A Trip
Generation Impact analysis of the existing use and proposed uses was required by staff to understand the
difference in traffic generations based on the new uses. The trip analysis assumed a 102,600 square foot Self-
Storage facility in Phase 1 and 20,000 square feet of Day Care and 10,000 square feet of Fire Station.
As shown in the attached analysis, the Daily and PM Peak Hour Trips anticipated from the proposed land uses
will increase to 1,155 Daily Trips (> 519 Daily Trips Allowed) and 244 PM Peak Hour Trips (> 38 PM Peak Hour
Trips allowed). The phase 1 (Self-Storage) only generates 155 Daily Trips with 17 in the Peak Hour. To mitigate
the increase in traffic generations and increases in the PM Peak Hour Trips, a proportionate share mitigation
payment for a traffic signal at the intersection of Fountains West Blvd and West Road will be worked out.

ISSUE:
Should the Honorable Mayor and City Commission approve an ordinance for a Substantial Amendment to the
Fountains West PUD and the PUD Land Use Plan for Lot 8?
DEVELOPMENT REVIEW RECOMMENDATION:
The Development Review Committee (DRC) met on May 17, 2018, and reviewed the Amendment to the PUD
Land Use Plan for Lot 8, Fountains West PUD. According to the City's Land Development Code, alterations to an
approved PUD Land Use Plan shall be classified as either substantial or nonsubstantial by the DRC. The
Committee determined that the proposed amendment was considered a substantial amendment due to the
criteria established in the City's Land Development Code. Accordingly, the proposed substantial amendment will
be presented at a public hearing before the Planning and Zoning Commission and a public hearing before the City
Commission.
When the discussion was finished, the DRC voted unanimously to recommend approval of the Substantial
Amendment to Lot 8.
PLANNING AND ZONING COMMISSION RECOMMENDATION:
The Planning and Zoning Commission reviewed the request at the Wednesday, May 30, 2018, Planning and
Zoning Commission meeting. Discussion from the Planning and Zoning Commission centered on why the use of
self-storage is appropriate in this location. Member Keethler mentioned a site was located less than a mile away
to the north. Member McKey felt the traffic was still an issue with Member Keethler agreeing. Discussion on the
Interchange Village Character area was also made. After deliberations, the Planning and Zoning Commission
voted 3-2 in favor of recommending approval of the amendment (Members Keethler and Frommer opposing).
RECOMMENDATION:
Staff recommends that the Honorable Mayor and City Commission approve an ordinance for a Substantial
Amendment to the Fountains West PUD and the PUD Land Use Plan for Lot 8.

Trip Generation Impact
Purpose
The following analysis was prepared to determine the anticipated trip generation impact
for Fountains West PUD Lot 8 to supplement a rezoning application for the property.
The anticipated trips were compared to the Maximum ADT allowed for Lot 8.
Existing PUD Trips
The existing Fountains West PUD allows for the following maximum trip totals for Lot 8:
• 519 Daily Trips
• 38 PM Peak Hour Trips
Proposed Land Use
The proposed land use for Fountains West PUD Lot 8 consist of two (2) development
phases, as follows:
Phase 1:
• 102,600 square feet of Mini-Warehouse (Self-Storage)
Phase 2:
• 20,000 square feet of Day Care
• 10,000 square feet of Fire Station
• Possible expansion by the Fire Department to add training facilities on the
northern portion of the property

latest edition (10th) of the Institute of Transportation Engineer's (ITE) Trip Generation

Conclusions
The comparison of anticipated trips for the proposed Fountains West PUD rezoning
versus the current approved trip allowance in the existing PUD shows the following:
• The proposed rezoning of Lot 8 will result in more Daily and PM Peak Hour
trips than allowed for in the existing PUD.
• The anticipated Lot 8 Phase 1 development(102,600 square feet of Mini-
Warehouse)will result in less Daily and PM Peak Hour trips than allowed for
in the existing PUD.
Recommendation
Condition to rezoning of Lot 8 to allow for development of the Mini-Warehouse. Impacts
from any development beyond the Mini-Warehouse should be assessed with a traffic
impact study and mitigated for as appropriate.

AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA,
APPROVING AN AMENDMENT TO THE FOUNTAINS
WEST PUD AND PUD LAND USE PLAN FOR LOT 8
CERTAIN REAL PROPERTY GENERALLY LOCATED AT
THE NORTHEAST CORNER OF THE INTERSECTION OF
WEST ROAD AND OCOEE APOPKA ROAD; AMENDING
THE FOUNTAINS WEST PUD AND PUD LAND USE PLAN
TO ALLOW USES OTHER THAN A CHURCH ON LOT 8;
REPEALING INCONSISTENT ORDINANCES;
PROVIDING FOR SEVERABILITY; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the owner or owners (the "Applicant") of certain real property
located within the corporate limits of the City of Ocoee, Florida, as described in the Exhibit "A"
attached hereto has petitioned the City Commission of the City of Ocoee, Florida (the "Ocoee
City Commission") to approve an amendment (the "Amendment") to the Fountains West PUD
and PUD Land Use Plan, as approved by the Ocoee City Commission on December 19, 2006, (the
"Land Use Plan");
WHEREAS, the Amendment was scheduled for study and recommendation and
was reviewed by the Development Review Committee ("DRC") on May 17, 2018;
WHEREAS, the DRC voted unanimously to confer with the determination of
Substantial Change to the Fountains West PUD and PUD Land Use Plan;
WHEREAS, the Amendment was scheduled for study and recommendation by
the Planning and Zoning Commission of the City of Ocoee, Florida (the "Planning and Zoning
Commission"); and
WHEREAS, on May 30, 2018, the Planning and Zoning Commission held an
advertised public hearing on the Application and recommended approval of the Amendment; and
WHEREAS, on , the Ocoee City Commission held a de novo
advertised public hearing with respect to the proposed Amendment and this Ordinance and
determined that the Amendment and this Ordinance are consistent with the 1991 City of Ocoee
Comprehensive Plan as set forth in Ordinance No. 91-28, adopted September 18, 1991, as
amended; and
WHEREAS, the Ocoee City Commission considered this Ordinance in
accordance with the procedures set forth in Section 166.041(3), Florida Statutes.
NOW, THEREFORE,BE IT ENACTED BY THE CITY COMMISSION OF
THE CITY OF OCOEE, FLORIDA,AS FOLLOWS:
SECTION 1. Authority. The City Commission of the City of Ocoee has
the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of
Florida and Chapters 163 and 166, Florida Statutes.
SECTION 2. Amendment to the Land Use Plan. The Amended PUD
Land Use Plans, prepared by Kimley-Horn, dated April 12, 2018, and date stamped as received
by the City of Ocoee on May 30, 2018, with such additional revisions thereto, if any, as may be
reflected in the minutes of the City Commission of the City of Ocoee meeting approving same is
hereby approved. The Amended Land Use Plan is attached hereto as Exhibit "B" and by this
reference made a part hereof Said Amended Land Use Plan is included with the previous
approved Land Use Plans for Fountains West PUD and PUD Land Use Plan. All references to
the Land Use Plan or the Amended Land Use Plan for Fountains West PUD and PUD Land Use
Plan.
SECTION 3. Ocoee Comprehensive Plan. The Ocoee City
Commission hereby finds that this Ordinance is consistent with the Ocoee Comprehensive Plan.
SECTION 4. Conflicting Ordinances. All ordinances or parts of
ordinances in conflict or inconsistent herewith are hereby repealed and rescinded.
SECTION 5. Severability. If any section, subsection, sentence, clause,
phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any
court of competent jurisdiction, such portion shall be deemed a separate, distinct, and
independent provision and such holding shall not affect the validity of the remaining portion
hereto.
SECTION 6. Effective Date. This Ordinance shall become effective ten
(10) days after its passage and adoption.

NOTICE IS HEREBY GIVEN,pursuant to Subsection 1-10 and 5-9,of the City
of Ocoee Land Development Code,that on TUESDAY,JUNE 19,2018,AT 6:15
P.M.or as soon thereafter as practical,the OCOEE CITY COMMISSION will
hold a PUBLIC HEARING at the City of Ocoee Commission Chambers,150 North
Lakeshore Drive,Ocoee,Florida,to consider the Rezoning to PUD for a property
identified as parcel number 06-22-28-2856-08-000.The subject property is ap-
proximately 11.73 acres in size and is generally located on the north side of Foun-
tains West Blvd.and 413 feet north of the intersection of West Rd.and Fountains
West Blvd.

AN ORDINANCE OF THE CITY OF OCOEE,FLORIDA,APPROVING AN
AMENDMENT TO THE FOUNTAINS WEST PUD AND PUD LAND USE
PLAN FOR LOT 8 CERTAIN REAL PROPERTY GENERALLY LOCATED AT
THE NORTHEAST CORNER OF THE INTERSECTION OF WEST ROAD
AND OCOEE APOPKA ROAD;AMENDING THE FOUNTAINS WEST PUD
AND PUD LAND USE PLAN TO ALLOW USES OTHER THAN A CHURCH
ON LOT 8; REPEALING INCONSISTENT ORDINANCES; PROVIDING
FOR SEVERABILITY;PROVIDING AN EFFECTIVE DATE.
Interested parties may appear at the public hearingand be heard with respect to
the proposed actions.The complete case file,including a complete legal descrip-
tion by metes and bounds,may be inspected at the Ocoee Planning Department
located at 150 North Lakeshore Drive,Ocoee,Florida between the hours of 8:00
a.m.and 5:00 p.m.,Monday through Friday,except legal holidays.The Ocoee
City Commission may continue the public hearing to other dates and times,as
it deems necessary. Any interested party shall be advised of the dates,times,
and places of any continuation of these or continued public hearings shall be
announced during the hearing and no further notices regarding these matters
will be published.You are advised that any person who desires to appeal any
decision made at the public hearings will need a record of the proceedings and
for this purpose may need to ensure that a verbatim record of the proceedings
is made which includes the testimony and evidence upon which the appeal is
based. In accordance with the Americans with Disabilities Act,persons need-
ing a special accommodation or an interpreter to participate in this proceeding
