SUBJECT: SILVER BEND SUBDIVISION, FEINSTEIN REQUEST FOR TIME
EXTENSION ON ONE-YEAR PRECONSTRUCTION CONFERENCE
ISSUE
Should the Honorable Mayor and Board of City Commissioners approve
the developer's request for an extension to the one-year deadline
in which a preconstruction conference shall be held (photocopy of
request letter attached) ?
BACKGROUND AND DISCUSSION
The Silver Bend subdivision consists of 58 acres and 182 building
lots and is located on the south side of Silver Star Road at the
"S" curve (site location map attached) . The Board of City
Commissioners granted Final Engineering approval on February 20,
1990.
Article IV, Section 4 . 3 . 3 of the Subdivision Code prescribes that
"the final subdivision plans shall be automatically voided if a
preconstruction conference. . . has not commenced within one year
from the date of final subdivision plan approval. The Board. . .
may grant a time extension. . . provided that the plans still
comply with current regulations. "
Staff has reviewed the ordinances adopted since the subject
subdivision was granted Final Engineering approval on February 20,
1990 and could find no regulations that would, in any way, negate
or impact said approval. Of course, the economic climate has
worsened since February 1990 for the development community.
RECOMMENDATION
Staff recommends that the Honorable Mayor and Board of City
Commissioners approve the developer's request and grant a one-year
time extension to February 20, 1992, in which to hold a
preconstruction conference with City staff.

TIME EXTENSION PRECONSTRUCTION CONFERENCE
Per your January 29, 1991 inquiry, we are attaching a staff report
regarding Mr. Feinstein's request for a time extension to the time
limit in which the developer has one-year from the date of final
subdivision plan approval to hold a preconstruction conference,
pursuant to the Subdivision Code Article IV, Section 4. 3 . 3 "Time
Limit on Approval" .
The Board may grant a time extension for a specified period of
time, provided that the subdivision plans still comply with current
regulations. Since the City Commission granted "Final Engineering
Approval" to Silver Bend on February 20, 1990, this time extension
request is timely.
