SUBJECT: BURNDEN PARK SUBDIVISION - TIME EXTENSION
ISSUE
Should the Honorable Mayor and City Commission approve the attached
request for a time extension to allow the owners of Burnden Park
Subdivision, Hargreaves Construction and Development , Inc. , more
time to hold a preconstruction conference, pursuant to Article IV,
Section 4. 3 . 3 of the Subdivision Code (copy of regulation
attached)?
BACKGROUND DISCUSSION
Burnden Park is located on Hackney-Prairie Road, 4,000 feet west of
Apopka-Vineland Road, or 1, 300 feet east of the proposed alignment
of the Clark Road Corridor. It consists of 38 . 4 acres , is zoned
R-1-A, Single-Family Residential District , and will have 93
building lots .
Hackney-Prairie Road shall be paved per the Developer' s Agreement
to provide access to the project prior to any Certificate of
Occupancy being issued. The roadways shall be designed according
to Orange County standards . Sidewalks will be constructed by the
Developer along the Hackney-Prairie Road frontage of the
Development .
The proposed subdivision received Final Engineering approval on
October 17 , 1989. Section 4. 3. 3 of the Subdivision Code states
that "Approval of the Preliminary Subdivision Plan and the Final
Subdivision Plans shall be automatically voided if a
Preconstruction Conference, per Section 6.5 . 3 . , has not commenced
within one year from the date of Final Subdivision Plan approval . "
The Code goes on to say, "the Board or their designate may grant a
time extension upon written request to the Planning Director,
provided the plans still comply with current regulations . " We have
received a written request for a time extension and it is attached
for your review. The approved Final Engineering Plans still
substantially comply with current regulations .

A check of the City Ordinances adopted since October 1989 has
revealed that Ordinances #89-56--"Screening"; #90-11--"Arbor
Ordinance"; #90-82--"Surety For Improvements"; and, #91-82--"FEMA
100-Year Flood Damage Prevention" will marginally affect the
developer and are not sufficient grounds to compel a complete
resubmittal and DRC review. These and subsequent Ordinances will ,
however, have to be addressed prior to platting.
RECOMMENDATION
Staff recommends that the Honorable Mayor and City Commission grant
the Developer's request for a time extension until June 18, 1992 to
complete a preconstruction conference and checklist .

Request for Time Extension
Dear Mr. Behrens:
This letter is to serve as formal request for a one year
extension from this date for Burnden Park Subdivision, formerly
approved by the City Commission on October 17, 1989.
Resolving access to the project has been one chief cause for the
project's delay, but I believe issues are now satisfactory to be able
to proceed.
Pursuant to City Code 4.3.3, please therefore slate this request
for the next available meeting of the Board of City Commissioners.
Please call should you have any questions, and thank you in advance
for your help.
