SUBJECT: ADDRESSES DISPLAYED ON THE REAR OF COMMERCIAL BUILDINGS
ISSUE
Should the Honorable Mayor and Board of City Commissioners amend
Section 5-59 (C) (1) of Ordinance No. 90-12 to require commercial
businesses that are located in multi-tenented buildings to display
their addresses on the rear exit of their business as well as on
the front of their business?
BACKGROUND
Buildings such as shopping centers have a large amount of
businesses within them and a subsequent large amount of rear exit
doors . In most cases these door have no indication of the business
to which they lead to. In the case of a fire or police emergency
this can cause timely delays due to the fact that emergency workers
do not know which door to go through if entry through the rear of
a building to a certain business is warranted.
DISCUSSION
Business addresses permanently affixed to the respective rear exit
doors of said businesses would allow fire and police personnel to
gain entry at the right location immediately when called upon to do
so. Also, it would save the needless damage of forcing entry to a
door that does not lead to the correct business in time of an
emergency.
RECOMMENDATION
It is respectfully recommended that the Honorable Mayor and City
Board of Commissioners amend Section 5-59 (C) (1) of Ordinance No.
90-12 for the increased protection of Ocoee businesses and safety
to City of Ocoee Emergency Personnel .
ORDINANCE NO. 91- 12
AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA,
RELATING TO THE UNIFORM BUILDING NUMBERING
SYSTEM; AMENDING SECTION 5-59 OF ARTICLE II
OF CHAPTER 5 OF THE CODE OF ORDINANCES BY
REQUIRING A COMMERCIAL BUSINESS TO DISPLAY
ASSIGNED BUILDING NUMBERS; PROVIDING FOR
SEVERABILITY; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Ocoee finds
that it may be necessary for fire, police and emergency personnel
to quickly and correctly identify a business from the rear of the
building during an emergency situation; and
WHEREAS, the City Commission of the City of Ocoee has
determined that the display of the business name and its des-
ignated number on the rear exit door of a business will assist
fire, police and emergency personnel in identifying a business
from the rear, which will protect the health, safety and welfare
of the citizens of the City of Ocoee.
NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF
THE CITY OF OCOEE, FLORIDA:
SECTION 1. The City Commission of the City of Ocoee has
the authority to adopt this Ordinance pursuant to Article VIII of
the Constitution of the State of Florida and Chapter 166, Florida
Statutes.
SECTION 2. Section 5-59 of Article II of Chapter 5 of
the Code of Ordinances of the City of Ocoee, is hereby amended to
read as follows:
Section 5-59 BUILDING NUMBERING
(a) The purpose of this Section shall be to create a
uniform numbering system for the display of address numbers on
buildings and structures located within the City of Ocoee, and
to provide for easier identification of locations by emergency
response personnel.
(b) The building official shall assign numbers to all
buildings in the City other than accessory buildings. Accessory
buildings are structures which are clearly incidental or
subordinate to and customarily utilized adjacent to and in
connection with a principal building located on the same lot.
(c) All buildings shall have the assigned building num-
ber properly displayed, whether or not mail is delivered to the
building. The posting of the building number shall be the
responsibility of both the owner and occupant of the building and
shall comply with the following requirements:
(1) BUILDING NUMBERS
(a) Residential Buildings - The building number
shall be affixed to the front of the building,
such as a mailbox, post, wall or fence, so
that it is visible and legible from the public
or private street on which the building fronts. •
(b)• Commercial Buildings - Each business within a
commercial building shall have its designated
number affixed to the front of the building
so that it is visible and legible from the
public or private street on which the building
fronts. Additionally, the business name and
designated number of each business shall be � .
affixed to at least one (1) rear exterior exit
door.
(2) The number shall be in Arabic numerals unless
otherwise approved by the zoning administrator.
Decorative numbers or other numbers that are
difficult to read will not be approved.
(3) The numbering shall be of a weather-resistant
material permanently affixed to the front of the
building or structure.
(4) The building numbers shall not be less than
three (3) inches in height and shall be of a
color that will contrast with the immediate back-
ground material.
(5) A property owner or his agent shall have the
responsibility for contacting the city zoning
department to determine the correct building
number or numbers to be assigned to all buildings
located or constructed on his property in the City
after the effective date of this article. The
owner or his agent shall post the building number
in accordance with this Section prior to the
building's occupancy. A certificate of occupancy
shall not be issued until the zoning administrator
has verified that the building has been properly
numbered in accordance with this article.
(d) This Section shall be enforceable pursuant to
Chapter 7.5 and Section 1.8 of the Code of Ordinances. Existing
buildings shall be brought into compliance with building
numbering requirements within 90 days from the effective date of
this Section.
Section 3. Severability. If any section, subsection,
sentence, clause, phrase or portion of this Ordinance is for any
reason held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not
affect the validity of the remaining portion hereto.
Section 4. Effective Date. This Ordinance shall
become effective immediately upon passage and adoption.
