HomeMy WebLinkAbout04-24-2018 Minutes CODE ENFORCEMENT BOARD MINUTES April 24, 2018 Chairman Lowery called the regular meeting of the Ocoee Code Enforcement Board to order at 7:00pm in the Commission Chambers at City Hall. Member Odom initiated the moment of silence, and Member Murray led the Pledge of Allegiance to the Flag. The roll was called and a quorum was declared present. PRESENT: Chairman Lowery, Member Odom, Member Lomneck, Member Lewis and Member Murray. Also present were Board Attorney Mary Sneed, Asst. Support Services Director - Code Enforcement Manager Doug Gaines, Code Enforcement Officers Edward Loeffler, Theresa Rodriguez and Robert Siegrist; Administrative Assistant Bridgett Coffey, and Recording Clerk Amber Landry. ABSENT: Vice-Chairman Carrington Administrative Assistant Coffey administered the oath to the Code Enforcement Officers and to anyone intending to speak regarding a case. CONSENT AGENDA ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT BOARD AND WILL BE ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS UNLESS DISCUSSION IS DESIRED BY A MEMBER OF THE BOARD, IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE BOARD CLERK TO REMOVE THE ITEM FROM THE CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED SEPARATELY. Officer Rodriguez further explained that as of April 24, 2018, the property is still in non- compliance. Member Odom, seconded by Member Lomneck, moved that in Case# 18-030, the respondent be found in violation as cited as of March 8, 2018, and be given until May 1, 2018, to come into compliance or be fined $50.00 per day per violation until found in compliance. Officer Rodriguez further explained that as of April 24, 2018, the property is still in non- compliance. The City is requesting an order of compliance within 15 days or be fined $50.00 per day thereafter that the violation remains in non-compliance. Markley and Evelyn Cesar, property owners who reside at 335 Sterling Lake Drive Ocoee, FL, stated that they have been trying to resolve the situation even prior to being cited by the City. The fence was damaged during the last hurricane and unfortunately the price received to replace the fence was out of their budget. They also stated that they have another fence company, Datson Fence Co., scheduled for Friday, April 27, 2018, at 11:00am, to assess the damage and provide a quote. If the price is still outside of their budget, they have decided they will do it themselves. Further discussion ensued. Member Lomneck, seconded by Member Odom, moved that in Case #18-033, the respondent be found in violation as cited as of March 25, 2018, and be given until May 9, 2018, to come into compliance or be fined$50.00 per day until found in compliance. Motion carried unanimously. Officer Loeffler further explained that as of April 24, 2018, the property is still in non- compliance. The City is requesting an order of compliance within 7 days or be fined $70.00 per day thereafter that the violation remains in non-compliance. Member Odom, seconded by Member Lomneck, moved that in Case #18-035, the respondent be found in violation as cited as of March 20, 2018, and be given until May 1, 2018, to come into compliance or be fined$70.00 per day per violation until found in compliance. Motion carried unanimously. No. 18-038 Eleuterio Polanco Officer Siegrist 434 Lake Johio Drive Violation Cited: 165-3(a), 168-4(a) Observation: Mercedes convertible parked upon / blocking pedestrian sidewalk. Officer Siegrist explained that as of April 24, 2018, the property is in compliance. Member Odom, seconded by Member Lewis, moved that in Case #18-038, the respondent be found in violation as cited as of April 9 2018, and be found in compliance as of April 24, 2018, and that no fines be assessed at this time. Motion carried 4- 1 with Member Lomneck opposing. Officer Rodriguez further explained that as of April 24, 2018, the property is in full compliance. She explained she has been following this case since January 2018. Officer Rodriguez clarified that she is bringing it before the Board for future repeat violation. Member Lomneck, seconded by Member Murray, moved that in Case #18-039, the respondent be found in violation as cited as of April 8, 2018, and be found in compliance as of April 24, 2018, and that no fines be assessed at this time. Motion carried unanimously. Officer Loeffler reported the property is in non-compliance, and requested an order imposing fine and lien. Member Lomneck, second by Member Lewis, moved that in Case #18-018 to impose fines as of April 13, 2018, as previously set by this board. Motion carried unanimously. Case No. 18-028 Ronald Ward Officer Loeffler 910 Ursula Street Mathew Ward Violation Cited: 115-3A, LDC6-4(b), 108-35, 108-24D SIPage Observation: Un-tagged, In-operable large boat trailer with inoperable large boat back yard not screened from view. Cargo trailer prohibited location not screened from view. Misc. junk, debris, tools, rubbish, equipment, rubble littering property. Officer Loeffler reported the property owner is working hard and is making progress, unfortunately due to one large obstacle they are still not in full compliance. Officer Loeffler recommended extending the compliance date for 30 days. Member Lomneck, seconded by Member Odom, moved that in Case #18-028, the compliance date be extended from April 11, 2018, to May 21, 2018. Motion carried unanimously. Case No. 18-032 Duane L Harris Officer Loeffler 1500 Lady Ave Dea M Harris Violation Cited: 115-3B, 115-3A, 165-3 Observation: Misc. junk, parts, debris stacked in-front of house, side yard. Tall weeds and grass. No further action was required by the Board. 61 Page COMMENTS Member Odom requested that for future meetings to have the air conditioning be turned up a little as she was freezing. Asst. Support Services Director- Code Enforcement Manager Doug Gaines, Code Enforcement reminded the Board that tomorrow night is the Volunteer Appreciation Dinner located at the Tom Isom Center. He expressed his gratitude to the Board, and noted Western Wear is encouraged. He looks forward to seeing everyone, and suggested all should be ready to do some boot scootin' boogie! Chairman Lowery announced that the Board is looking great, and that he is very pleased with the current members; however, for those watching from home there is room for additional members.
