ORDINANCE NOS. 92-50 AND 92-51
ISSUE:
Should the Honorable Mayor and Board of City Commissioners approve
this application to Annex and Initially Zone the subject parcel
from Orange County, "A-1, Agricultural" , to City of Ocoee, "R-1-A,
Single Family Dwelling"?
BACKGROUND DISCUSSION:
The 256. 5 acres subject parcel is located on the East side of
Ingram Road and 1, 500 feet North of Ocoee-Clarcona Road, (see
attached location map) . Site access is provided by Ingram Road.
The owners of the subject parcel are:
Richard G. Byrd & Ted L. Byrd Wolf Investments, Inc.
Berndt Holthusen Carl-Heinz Willems
Peter Jurs Carola Jurs
Klaus Wolf
The Planning Director has examined this application and has
determined that it is in compliance with the City of Ocoee's
Comprehensive Plan and Future Land Use Map.
The property proposed for annexation is designated Low Density
Residential on the Future Land Use Map.
A thorough impact study as called for in the Comprehensive Plan,
has been completed on this proposed annexation.
The City cannot currently provide urban services to this property.
Urban services are currently not planned to be extended to this
area for a minimum of seven years. Only rural services, supporting
agricultural uses will be provided in the interim.
An Annexation Agreement concerning the annexation of this property
will be required by the City. Under separate cover, the City
Attorney is providing a proposed Annexation Agreement between the
City and the Owner of the subject parcel . The proposed Annexation
Agreement has been prepared by the City Attorney pursuant to the
direction of the Planning Director and has been agreed to by the
property owner.
The property is in the County sewer territory.
The property is in the County water territory.
Both Orange County and adjacent municipalities have been informed
of this proposed annexation, as required by the Comprehensive Plan
and the CAMP Agreement. A copy of this Staff Report and the
proposed Ordinances has been provided to Orange County.
PLANNING AND ZONING COMMISSION RECOMMENDATION:
With a 6 to 1 vote, the Planning and Zoning Commission took the
following action with respect to the petition in CASE NO. 2-21AR-
92 : Van Wormer. The Planning and Zoning Commission found the
requested annexation to be consistent with the Ocoee Comprehensive
Plan and Future Land Use Map and, in compliance with all applicable
requirements of the Ocoee Land Development Code and in the best
interest of the City and recommended to the City Commission
approval of the annexation petition in CASE NO. 2-21AR-92 : Van
Wormer, and that the property described therein be annexed as
requested by the petitioner and that the City Commission find the
proposed annexation to be consistent with the Ocoee Comprehensive
Plan; the Planning and Zoning Commission recommended DENIAL of the
R-1-A, Single Family Dwelling initial zoning requested by the
Petitioner; and the Planning and Zoning Commission further
recommends that the City Commission grant an initial zoning of RCE-
2 , Rural Country Estate:
RCE-2 , Rural Country Estates zoning: calls for a minimum lot size
of one (1) acre, a minimum lot with of one hundred twenty-five
(125) feet, and a minimum living area of two thousand (2 , 000) feet.
STAFF RECOMMENDATION:
ANNEXATION AND INITIAL ZONING CONSISTENT WITH COMPREHENSIVE PLAN:
"The Planning Department recommends that the City Commission, in
separate votes, take the following actions with respect to the
petition in Case number 2-21AR-92 : Van Wormer :
(1) Approve Ordinance No. 92-50 annexing the subject
parcel, subject to the adoption of Ordinance No.
92-51 establishing an initial zoning for the
subject parcel as requested by the applicant and
further subject to the approval of an annexation
agreement;
(2) Approve the proposed Annexation Agreement between
the City of Ocoee and the owner of the subject
parcel, such approval being in satisfaction of the
condition of approval for Ordinance No. 92-50; and
(3) Approve Ordinance No. 92-51 establishing an initial
zoning for the subject parcel, such approval being
in satisfaction of the condition of approval for
Ordinance No. 92-50 and find that all conditions
subsequent to the adoption of Ordinance No. 92-50
have been fully satisfied. "
