RE: Florida Department of Corrections and the City of Ocoee
Community Labor Agreement - Lake Correctional Institution
ISSUE:
Should The Honorable Mayor and Board of City Commissioners approve
the attached subject agreement to provide prison labor to the City
of Ocoee?
BACKGROUND AND DISCUSSION:
The City of Ocoee , for the past several years, has been using Lake
Correctional Institution inmates to perform public works functions
throughout the community. The prison provides seven to eight
inmates to the city along with a guard to insure community
protection. We are fortunate to have this labor and their
equipment provided to the city free of charge once or twice weekly.
I met with Mr. Don M. Dean, Superintendent, Lake Correctional
Institution, to discuss the possibility of increasing the labor
currently provided to the city. He is presently providing the
maximum to our city available , however as soon as funding from the
state increases, he will , hopefully, be in a position to provide
additional work crews. Since Lake Correctional Institution has
provided these services to the city there has not been one incident
reported and the savings to the taxpayers is in excess of $60 ,000
annually.
There have been two minor additions to last year' s agreement; 1 )
under section I , #2 , the words "as scheduled" are added because
inmate scheduling is somewhat flexible, 2 ) in section II , #4 , the
words "unless needed" are added in the event a piece of equipment
out of the ordinary ( i .e. chain saw) might be needed for a special
project.

RECOMMENDATION:
Therefore, based on the above background and discussion, it is
respectfully requested that The Honorable Mayor and Board of City
Commissioners approve the agreement with Florida Department of
Corrections and Lake Correctional Institution.

and Rules of the Department of Corrections, Chapter 33 - 3.003 and 33 - 3.017, •

V 1. Properly screen the inmates for the work to be performed and to
provide a reasonable basis to believe that none present

3. Provide 1 vehicles and 1 . Correctional Officers each

1 ' 5. Be responsible for the apprehension of an escapee and handling of

problem inmates. Corrections shall provide transportation from the
work site to the correctional facility 'for inmates who refuse to .
work, become unable to work, or cause a disruption in. the work . i

V 6. Be responsible for administering all disciplinary action taken
against an inmate for infractions committed while under the
supervision of the Agency.
V 7. Provide for medical treatment for ill or injured inmates and shall
provide for transpol7tation of such inmates. '

Corrections personnel prior to their assuming subervisory
:• responsibility of an inmate squad. Training will be in accordance
with Corrections' guidelines for non-departmental personnel .

_V 10. Provide inmates with all personal items of clothing appropriate for

times regardless of temperature or inclement weather,. ; unless
notified by the Agency of suspended work operations. ' The only
exception may be conditions which would breach good security
practices, in which case Corrections shall notify the Agency. i '

Al/n 1. Provide the Department with a schedule of hours which inmates will -
be worked in accordance with the established workday for the Agency
and the transportation time required. Any deviation from the
established schedule must be reported to and approved by
Corrections. .
•ft4/e 2. Provide supervision of inmates in accordance with DC rules and •
regulations. Non-DC employees may supervise minimum and medium
custody inmates. Each person who is to supervise inmate labor must !:
have a criminal record check completed by Corrections prior to
supervising inmates. Based on the findings, the Superintendent or
his designee shall approve or disapprove, in his discretion, .all .
• non-DC employees prior to being allowed to supervise inmates. •..

In cases of emergency, first aid, within the scope of the •
supervisor's medical training, shall be provided and assistance
rendered to Corrections. •
8. Provide inmates with•a fifteen minute rest'break in the morning and ,
a fifteen minute rest break in the afternoon. Lunch breaks shall be
30 minutes. fram 12 noon to 12:30 p.m. .
/_$ 9. Provide an employee of the same sex as the inmate(s) to be .
immediately available to render assistance in cases•where the squad '
supervisor is of the opposite sex as the itmtiate. • , •• ;: ;
