NO. 93-06, ZONING CODE REVISIONS INCLUDING DEFINITIONS OF AUTOMOBILE REPAIR, AUTOMOTIVE BODY REPAIR, AUTOMOTIVE WRECKING SALVAGE YARDS AND AMENDING TABLE 5-1 ENTITLED "USE REGULATIONS" ISSUE: Should the Honorable Mayor and Board of City Commissioners approve the proposed Zoning Code revisions as set out in Ordinance No. 93-06? BACKGROUND DISCUSSION: When the City of Ocoee adopted the Land Development Code on July 21, 1992, it was known that certain unspecified zoning clarifications would inevitably manifest themselves over time and after day to day code administration. Experience gathered over the last ten months has shown that in order to avoid heavy commercial and industrial encroachments into the City's C-1 and C-2 zones that are predominately adjacent to residential neighborhoods the following proposed changes are needed. They are summarized as follows: 1. Section 2-4 (C) (18) of Article II: Clarify language as to what constitutes "Automotive Repair" by excluding Tire Recapping and Body Shops from permitted uses in all three commercial zones and re-establishing them as I-2, General Industrial District. 2 . Section 2-4 (C) (20) of Article II: Adds amplification and clarification to #1 above, by re-defining "Automotive Body Repair" as a distinct use from a Automotive Repair" and assigning auto body to an I-2, General Industrial District. 6t L STAFF REPORT PROPOSED ORDINANCE 93-06 June 9, 1993 PAGE TWO 3. Section 2-4 (C) (21) of Article II: Specifically enumerates that a automotive wrecking or salvage yard shall be assigned to an I-2 District. 4. Section 5-3 (B) (14) of Article V: Revised to provide that automotive body repair and automotive wrecking or salvage yards shall be I-2 permitted uses only. 5. "Automobile repair" will be eliminated as a permitted use in a C-1 District. It will continue to be a special exception in a C-2 District and a permitted use in C-3, I-1 and I-2 Districts. "Automobile Service Station" will be eliminated as a permitted use in both C-1 and C-2 Districts; however, it will be a special exception use in a C-2 District and will continue to be a permited use in C-3, I-1 and I-2 Districts. 6. Table 5-1 entitled "Use Regulations of Article V: Is reorganized to reflect the above recommendations. STAFF RECOMMENDATION: Staff recommends that the Honorable Mayor and City Commission adopt Ordinance No. 93-06 with the revisions suggested in the attached memo from the City Attorney dated June 10, 1993 . PLANNING AND ZONING COMMSSION RECOMMENDATION: The Planning and Zoning Commission met on June 8, 1993 and recommended approval of Ordinance No. 93-06. The vote was 5-2. Rosenthal, Esq., City Attorney Pick., DATE: June 10, 1993 RE: PROPOSED ORDINANCE NO. 93-06, ZONING CODE REVISIONS INCLUDING DEFINITIONS OF AUTOMOBILE REPAIR,AUTOMOTIVE BODY REPAIR,AUTOMOTIVE WRECKING SALVAGE YARDS, AND AMENDING TABLE 5-1 ENTITLED "USE REGULATIONS" Pursuant to the direction of the Planning Department, we have made two revisions to the above-referenced Ordinance. Attached hereto is the revised Ordinance. In order to adopt the revised Ordinance, it will be necessary to take the following actions: 1. Move to amend Section 6 of Ordinance 93-06 to delete the phrase "and Commercial Convenience with Gas Sales". 2. Move to amend Table 5-1 Entitled "Use Regulations" attached as Exhibit "A" to Ordinance No. 93-06 to insert the commercial use of "Automobile Parking Lot", which use is permitted in C-2, C-3, I-1, and I-2 zoning districts and prohibited in all other zoning districts. The above motion will allow for the adoption of Ordinance No. 93-06 as attached. BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: SECTION 1. The City Commission of the City of Ocoee has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapters 163 and 166, Florida Statutes. SECTION 2 . Section 2-4 (C) (18) of Article II of Chapter 180 of the Code of Ordinances of the City of Ocoee, Florida, is hereby amended to read as follows: Automobile Repair: A use providing for major repairs to automobiles such as major mechanical repairs, and may include towing services, and long term storage of operable or inoperable vehicles, but excluding automotive body repair and automotive wrecking or salvage yards. All automobile repair operations shall be conducted in an enclosed building except in an I-1 Restricted Manufacturing and Warehousing District and I-2 General Industrial District. Repairs to large trucks or heavy mechanical equipment shall be permitted only in an I-2 General Industrial District. SECTION 3. Section 2-4 (C) (20) of Article II of Chapter 180 of the Code of Ordinances of the City of Ocoee, Florida, is hereby amended to read as follows: Automotive Body Repair: The repair, rebuilding or reconditioning of the body framework or chassis of motor vehicles, or parts thereof, including collision service, painting and steam cleaning of vehicles, and wherein an automobile service station may also operate. Automotive Body Repair shall be permitted only in an I-2 General Industrial District. SECTION 4 . Section 2-4 (C) (21) of Article II of Chapter 180 of the Code of Ordinances of the City of Ocoee, Florida, is hereby amended to read as follows: Automotive Wrecking or Salvage Yards: The dismantling or wrecking of used motor vehicles, mobile homes or other vehicles, or the storage, sale or dumping of such wrecked or dismantled vehicles or parts, which shall be permitted only in an I-2 General Industrial District. SECTION 5. Section 5-3 (B) (14) of Article V of Chapter 180 of the Code of Ordinances of the City of Ocoee, Florida, is hereby amended to read as follows: I-2 General Industrial District. This district is primarily intended for wholesale, storage, warehousing, manufacturing, assembling, automotive body repair, automotive wrecking or salvage yards, and fabrication. These uses do not depend primarily on frequent personal visits of customers or clients, but usually require good accessibility to major rail, air or street transportation facilities. This district is primarily intended for areas shown on the Future Land Use Map as "Heavy Industrial" . 2 SECTION 6. Table 5-1 entitled "Use Regulations" of Article V of Chapter 180 of the Code of Ordinances of the City of Ocoee, Florida, is hereby amended to read as set forth on Exhibit "A" attached hereto and incorporated herein by this reference, which amended Table 5-1 changes the zoning districts in which uses for Automotive Body Repair, Automobile Repair, Automobile Service Station and Automotive Wrecking and Salvage Yards are permitted. SECTION 7. Conflicts. All ordinances, resolutions, parts of ordinances or parts of resolutions of the City of Ocoee in conflict herewith are hereby repealed and rescinded. SECTION 8. Severability. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. SECTION 9. Codification. It is the intention of the City Commission of the City that the provisions of this ordinance shall become and be made a part of the Code of Ordinances of the City; and that sections of this ordinance may be renumbered or relettered and the word "ordinance" may be changed to "chapter", "section" , "article" , or such other appropriate word or phrase in order to accomplish such intentions; and regardless of whether such inclusion in the code is accomplished, sections of this ordinance may be renumbered or relettered and the correction of typographical errors which do not affect the intent may be authorized by the City 3 Manager, without need of public hearing, by filing a corrected or recodified copy of same with the City Clerk. SECTION 10. Effective Date. This Ordinance shall become effective immediately upon passage and adoption. PASSED AND ADOPTED this day of , 1993 .
