(SINGLE-FAMILY PORTION) PRELIMINARY SUBDIVISION PLANS (PIZZUTI) ISSUE: Should the Honorable Mayor and City Commission approve the Preliminary Subdivision Plans for the Single Family portion of the Plantation Grove P.U.D. ? BACKGROUND: Plantation Grove P .U.D. is a vested (322 single family units and 110 ,000 square feet of commercial ) mixed use P.U.D. located on the east side of Maguire Road, directly north of Moore Road. The original Land Use Plan was approved in November 1988 . A Revised Land Use Plan covering the entire P .U .D. was approved on May 5 , 1992 . This proposed Preliminary Subdivision Plan calls for 322 single family lots on 90 . 77 acres resulting in a gross density of 3 . 547 units per acre. The Developer is Pizzuti Development , Inc . This proposal is consistent with both the Future Land Use Map of the Comprehensive Plan and the approved Revised Land Use Plan of May 5 , 1992 . Typical lot size would be 60 ' x 115 ' , with a 6, 800 sq . ft . minimum; setbacks would be 25 ' front , 25 ' rear and 7 . 5 ' side' ; and minimum living area would be 1200 sq . ft . . . . all consistent with the approved Revised Land Use Plan. Private recreational amenities would be provided in a 2 . 3 area recreation area and would include a tennis court , basketball court , community pool , barbecue area and tot lot . Parking for cars and bicycles would also be provided. c Staff Report - Plantation Grove PUD (Pizzuti ) May 14, 1993 Page 2 DISCUSSION: The Development Review Committee reviewed and recommended approval of the Preliminary Subdivision Plans on April 29, 1993 , with the condition that prior to City Commission approval of the Preliminary Subdivision Plans the required rights-of-way of Moore and Maguire Roads shall be conveyed to the City per the R. L .U. P. CONCURRENCY MANAGEMENT: A staff report on concurrency by Planner Resnik is attached. PLANNING AND ZONING COMMISSION RECOMMENDATION : The Planning and Zoning Commission on May 11 , 1993 voted 5-0 , to recommend that the City Commission approve the Preliminary Subdivision Plans for Plantation Grove PUD (Single Family - Pizzuti ) with the condition that prior to City Commission approval of the Preliminary Subdivision Plans the required rights-of-way of Moore and Maguire Roads shall be conveyed to the City per the Revised Land Use Plan. STAFF RECOMMENDATION: Staff recommends that the Honorable Mayor and City Commission approve the Preliminary Subdivision Plans for Plantation Grove PUD (Single Family - Pizzuti ) , if the required rights-of-way for Moore and Maguire Roads have been conveyed to the City per the Revised Land Use Plan (May 5 , 1993) , prior to City Commission approval . RESNIK, DEVELOPMENT ADMINISTRATOR, CONCURRENCY MANAGEMENT DATE: MAY 12, 1993 SUBJECT: CONCURRENCY REVIEW FOR PLANTATION GROVE PUD (SINGLE FAMILY PORTION) PRELIMINARY SUBDIVISION PLAN ISSUE Should the Honorable Mayor and Board of City Commissioners approve the Preliminary Subdivision Plan for the single family portion of the Plantation Grove PUD? BACKGROUND AND DISCUSSION The Plantation Grove (East) PUD received a vested rights certificate on September 1, 1992 . Under this certificate, the landowner is entitled to vested rights for traffic circulation, solid waste, and recreation and open space for 322 single family residential units. There is a note on the plans that they are being processed pursuant to that vesting certificate. There is also a note on the plans that before Final Subdivision Plans are approved, the developer must apply for and receive a Final Certificate of Concurrency for those portions of the project that did not receive vested rights. In this case, developer agreements for water and sewer capacity must be approved and the necessary capacity reservation fees must be paid before Final Subdivision Plans may be approved. Rosenthal, Esq. , City Attorne1KA ) DATE: May 14, 1993 RE: Pizzutl Development, Inc. : Plantation Grove PUD/Development Plan and Revised Preliminary Subdivision Plan Review for Parcels B, C, D, G and I; Right-of Way Dedications for Maguire and Moore Roads In connection with the above referenced subdivision, we are proceeding to resolve the issues regarding the right-of-way dedications for Moore and Maguire Roads. In this regard, CCL Consultants, Inc. ("CCL") has reviewed certain documents and provided this office with a revised legal description for the right-of-way dedication for Moore Road. Additionally, CCL is currently working with Maguire Road Corporation regarding the preparation of the required Warranty Deeds, Partial Release of Mortgage and related title opinion. Our preliminary review of the revised legal description indicates that the legal description correctly describes the land to be dedicated for the Moore Road right-of-way. The legal description is also being forwarded to Jim Shirai City Engineer, for review and approval. It is our recommendation, based upon the progress we have made in resolving this issue, that, in the event the Warranty Deeds, partial Release of Mortgage, related title opinion are not received by the City prior to the City Commission meeting on May 18, 1993 , any approval of the Preliminary Subdivision Plan at such meeting be conditioned upon receipt of the Warranty Deeds, Partial • ^ -0405/14/93 14:11 FOLEY & L4RDNER fiD 003/003 Release of Mortgage and related title opinion within thirty (30) days of the date of such meeting (i.e. June 18, 1993) .
