Shira, P.E.A City Engineer/Utilities Director SUBJECT: Clarke Road During the design phase of Clarke Road, it was brought to our attention that the signs on the existing dirt road between White Road and Silver Star Road were spelled "Clark". Since the road was named for Arthur Clarke, it was decided that the new signs should spell his name correctly. The project is complete, and the signs are installed with the correct spelling. To officially change the name of the road, a resolution is attached for your consideration. This resolution was prepared by the City Attorney in accordance with his memorandum of February 18, 1992, a copy of which is attached. I recommend that the City Commission pass Resolution 93- 04 , officially renaming "Clark Road" to "Clarke Road". JWS/jbw Attachments — THE PRIDE OF WEST ORANGE as,L 2 RESOLUTION NO. 93- 04 A RESOLUTION OF THE CITY OF OCOEE, FLORIDA CHANGING THE NAME OF CLARK ROAD TO CLARKE ROAD; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. WHEREAS, the name Clark Road is the legal name of a portion of that certain street in the City of Ocoee, Florida located between Silver Star Road and White Road ("Clark Road") ; and WHEREAS, the City of Ocoee constructed a roadway over the existing Clark Road and other lands in the City of Ocoee, Florida located between West Colonial Drive (State Route 50) and A.D. Mims Road; and WHEREAS, the City desires to designate the name of such roadway over the existing Clark Road and other lands as "Clarke Road" . NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: SECTION 1. The City Commission of the City of Ocoee has the authority to adopt this Resolution pursuant to Article VIII of the Constitution of the State of Florida and Chapter 166, Florida Statutes. SECTION 2. The name of that certain street in the City of Ocoee, Florida located between West Colonial Drive (State Route 50) and A.D. Mims Road, as generally depicted on Exhibit "A" attached hereto and made a part hereof, is hereby designated as "CLARKE ROAD. " SECTION 3. The City Commission of the City of Ocoee authorizes the Mayor and the City Clerk to execute such documents as may be necessary to designate the name of that certain street in the City of Ocoee, Florida located between West Colonial Drive (State Route 50) and A.D. Mims Road as generally depicted on Exhibit "A" attached hereto and made a part hereof. SECTION 4. Severability. If any section, subsection, sentence, clause, phrase or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. SECTION 5. Effective Date. This Ordinance shall become effective immediately upon passage and adoption. PASSED AND ADOPTED this day of , 1993 . Rosenthal, Esq. , City Attorney RE Name Change: Clarke Road This is in response to your memorandum of November 19 , 1991 regarding the proper action to legally effect the spelling change of the name of "Clark Road" to "Clarke Road" . Please be advised that the portion of Clark Road located within the City of Ocoee can be named in ac- cordance with such procedures as the City may es- tablish. The adoption of a Resolution designating the new roadway as "Clarke Road" would be sufficient. The portion of the existing Clark Road located between White Road and Silver Star Road is located within un- incorporated Orange County. Attached hereto is a memorandum from Brian Lower dated February 18 , 1992 which addresses the procedure for changing the name of a roadway located in Orange County. The County requires a petition signed by at least 50% of the property owners. As you are aware the agreement between the City and the County calls for the County portion of Clark Road to be redesignated as a City road following completion of the overall project. At that time, the roadway would be under City control and the City could in accordance with applicable City procedures change the name of that portion of Clark Road located between White Road and Silver Star Road. Again, this could be undertaken by the adoption of a Resolution by the City Commission. It is my recommendation that no effort be made to change the name of the County portion of Clark Road until such time as it comes under the control of the City. In summary, at such time as the County portion of Clark Road is properly transferred to the City of Ocoee, the City Commission should pass a Resolution designating the A • • Mr. James W. Upon adoption of the Resolution, a notice should be sent to all property owners along Clarke Road advising them of their addresses. Appro- priate notices should also be sent to the tax collector, tax assessor and the Planning Department of Orange County. Notices should additionally be sent to appro- priate emergency response agencies. For your informa- tion, attached hereto is a notice which a client of oursreceived advising of a change in a property address.
