Boyd, Chief of Police P DATE: January 18 , 1993 SUBJECT: TRAFFIC VIOLATION SURCHARGE ORDINANCE I 've previously spoken with Orange County Sheriff ' s representative regarding the above subject , and I feel that we would benefit via this Ordinance and that we should expedite by getting this into our next Commission Agenda. If we fail to participate, we ( the Ocoee Police Department ) will be left in the "dark" with the other agencies in the County with direct lines of communication , and too, we would benefit internally. Dear Mayor Vandergrift: As you may be aware, the Florida legislature passed the Florida Mutual Aid Plan in the 1992 session. This legislation authorizes counties to assess up to $12.50 as a surcharge on each moving traffic violation. The revenues realized through this surcharge may only be used to support "an intergovernmental radio program. " During the next sixty days, the Orange County Board of County Commissioners will consider the establishment of the enclosed traffic violation surcharge ordinance which will have a major impact on regional public safety support. We want you to be aware of this effort, and hope that you will agree that its enactment will be beneficial to all public safety and local government agencies within Orange County. The surcharge provides an equitable source of funding since it recovers payment from traffic violators to support the law enforcement radio systems used in enforcing traffic violations. We intend to establish a method for the distribution of revenues to support the capital and operational needs of your public radio communications system. Toward that end, we are inviting your participation in this development process. AN ORDINANCE PERTAINING TO ORANGE COUNTY'S RADIO COMMUNICATION PROGRAM; ASSESSING A SURCHARGE OF $12 . 50 FOR EACH MOVING TRAFFIC VIOLATION, IN ADDITION TO ANY OTHER PENALTY PROVIDED FOR IN THE STATE UNIFORM TRAFFIC CONTROL LAW, CHAPTER 316, FLORIDA STATUTES; PROVIDING FOR THE DISPOSITION OF SAID SURCHARGES BY THE CLERK OF THE COUNTY COURT; PROVIDING THAT THE FUNDS GENERATED BY SAID SURCHARGE SHALL BE USED TO FUND THE ORANGE COUNTY INTERGOVERNMENT RADIO COMMUNICATION PROGRAM APPROVED BY THE DIVISION OF COMMUNICATIONS OF THE DEPARTMENT OF GENERAL SERVICES; PROVIDING FOR RENUMBERING; PROVIDING FOR SEVERABILITY; PROVIDING FOR RELATED MATTERS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Orange County Fire and Rescue, Orange County Emergency Medical Services, and the Orange County Sheriff' s Office provide dispatching services, mutual aid relay services, and access to radio frequencies to several municipalities within and adjacent to Orange County; WHEREAS, the Mutual Aid Act adopted by the Florida legislature authorizes a county which participates in an intergovernment radio communication program approved by the Division of Communication of the Department of General Services to assess a surcharge of up to $12. 50 for each moving traffic violation which is penalized as provided for in Section 316 . 655, Florida Statutes; WHEREAS, the Mutual Aid Act provides that any such surcharge shall be used by a county to fund the county's participation in an intergovernment radio communication program; WHEREAS, Orange County' s intergovernment radio communication program was approved by the Division of Communications of the Department of General Services on May 27, 1992; WHEREAS, the Board of County Commissioners finds it to be in the public interest to adopt the assessment of a surcharge of $12. 50 for each moving traffic violation to further such intergovernment radio communication program. ACCORDINGLY, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ORANGE COUNTY, FLORIDA: Section 1. Assessment of Surcharge. In addition to any other penalty authorized by the State Uniform Traffic Control Law, Chapter 316, Florida Statutes, a $12.50 surcharge shall be assessed for every moving traffic violation in Orange County, Florida. Section 2 . Collection and Disposition of Funds. The Clerk of the Court of Orange County is authorized to collect said surcharge and shall distribute such funds monthly to the Orange County Comptroller. Section 3 . Use of Funds . The funds generated by the assessment under Section 316 . 655(6) , Florida Statutes, shall be used to fund Orange County' s participation in Orange County' s Intergovernment Radio Communication Program approved by the Division of Communications of the Department of General Services. -2- Section 4 . Clerk' s Administrative Fee. The Clerk of the Court shall retain fifty cents ($.50) from each assessed surcharge to cover administrative processing expenses . Section 5. Implementation. The Board of County Commissioners may adopt resolutions, administrative regulations and guidelines from time to time to implement this ordinance. Section 6 . Scope. This ordinance shall be effective throughout the unincorporated area of Orange County and within the boundaries of any municipality. Section 7. Renumbering. The provision of this ordinance shall be included in the Code of Laws of Orange County, Florida, as an amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 8 . Conflict. All ordinances and resolutions 'or parts of ordinances or resolutions in conflict herewith are hereby superseded by this Ordinance to the extent of their inconsistency. Section 9 . Effective Date. A certified copy of this Ordinance shall be filed in the office of the Secretary of State by the Clerk of the Board of County Commissioners within ten (10) days after enactment and this Ordinance will take effect upon receipt of official acknowledgement from that office that said Ordinance has been filed.
