SUBJECT: Sovereign Submerged Lands Easement
DNR Dredge Permit - Oaks at Starke Lake Subdivision

On December 21, 1990 the City Commission approved the final
engineering plans for the Oaks at Starke Lake subdivision project,
with the stipulation that the developer, Starke Lake Joint Venture,
devise a plan to enhance boater's safety through an existing
channel between Starke Lake and a closed cove north of, and
adjacent to the project.
The developer determined that the channel could be widened and
deepened by dredging to provide the needed safety improvements by
increasing sight distance, and providing room for two boats to pass
without running aground.
In July of 1991 the Department of Environmental Regulation issued
a dredge permit for this work. In addition to this permit, the
developer determined that a joint Department of Natural
Resources/U.S. Army Corps of Engineers dredge permit ( the DNR
permit ) would also be required. In November of 1991 the City
Commission passed a resolution in support of the dredging operation
as required by DNR in order for the project to be considered by DNR
to be a public safety improvement project as opposed to a private
project. This distinction reduced both the time and cost of
obtaining the permit.
In July of 1992 the developer requested that the city act as co-
applicant on the DNR dredge permit to further satisfy DNR's
requirements for consideration of the project as a public project.
In August of 1992 the city received an Indemnification and Hold
Harmless Agreement executed by the developer and approved by the
City Attorney, which allowed the city to act as co-applicant on the
DNR dredge permit.

On August 25, 1992 the dredge permit was submitted to DNR for
processing.
The material to be removed from the channel bottom by the dredging
operation is considered by the State of Florida to be Sovereign
Submerged Land. In order for the applicants to remove the material,
once a dredge permit is issued, the Board of Trustees of the
Internal Improvement Trust Fund must grant to the applicants a
Sovereign Submerged Lands Easement.
So. . . attached to this memorandum are two originals of a Sovereign
Submerged Lands Easement granting the developer and the city ". . .a
nonexclusive easement on, under and across. . . " the parcel of
submerged land in question, for use as a public access channel. The
City Attorney reviewed the documents and made some modifications as
outlined in his attached memorandum. The easement has been executed
on behalf of Starke Lake Joint Venture by Robert L. Ferdinand,
Trustee.
I recommend that the City Commission authorize the Mayor to execute
the Sovereign Submerged Lands Easement on behalf of the City of
Ocoee.

Please find enclosed duplicate originals of the Sovereign
Submerged Lands Easement. The page 3 signature page has been
corrected for execution by the Mayor.
Additionally, please note that Paragraph 7 on page 1 includes
an unlimited indemnification by the City. As we have previously
discussed, the City cannot lawfully sign such an indemnification.
Accordingly, I have inserted the following notation: "*to the
extent permitted by law" .
Finally, please note that both the City and Robert L.
Ferdinand, Trustee are jointly liable to the Board of Trustees of
the Internal Improvement Trust Fund with respect to the obligations
imposed under the terms of the Easement. However, the City has
been indemnified by Mr. Ferdinand under the terms of the
Indemnification and Hold Harmless Agreement dated August 6, 1992 .

SOVEREIGN SUBMERGED LANDS EASEMENT
NO. 28912
THIS EASEMENT is hereby granted by the Board of Trustees of the
Internal Improvement Trust Fund of the State of Florida, hereinafter referred
to as the Grantor.
WITNESSETH: That for the faithful and timely performance of and
compliance with the terms and conditions stated herein, the Grantor does
hereby grant to City of Ocoee and Robert L. Ferdinand, Trustee ,
hereinafter referred to as the Grantee, a nonexclusive easement on, under and
across the sovereign lands, if any, contained in the following legal
description:
A parcel of submerged land in Section 17 ,
Township 22 South , Range 28 East , in Starke Lake ,
Orange County, as is more particularly described
and shown on Attachment A, dated December 31, 1991 .
TO HAVE THE USE OF the hereinabove described premises for a period
of 30 years from December 13, 1992 , the effective date of this
easement. The terms and conditions of and for which this easement is granted
are as follows:
1. The above described parcel of land shall be used solely for a
public access channel and Grantee shall not engage in any activity except
as described in the Florida Department of Environmental Regulation Permit No.
481929174 dated July 16, 1991 , attached hereto as Attachment B,
and made a part hereof.
2. Grantor neither warrants title to the lands described herein nor
guarantees the suitability of any of the lands for any particular use.
3. The rights hereby granted shall be subject to any and all prior
rights of the United States and any and all prior grants by the Grantor in and
to the submerged lands situated within the limits of this easement.
4. Grantee shall not damage the easement lands or unduly interfere with
public or private rights therein.
5. This easement is nonexclusive, and the Grantor, or its duly
authorized agent, shall retain the right to enter the property or to engage in
management activities not inconsistent with the use herein provided for and
shall retain the right to grant compatible uses of the property to third
parties during the term of this easement.
6. Grantor, or its duly authorized agent, shall have the right at any
time to inspect the works and operations of the Grantee in any matter
pertaining to this easement.
7. The Grantee shall investigate all claims of every nature at its
expense, and shall*indemnify, defend and save and hold harmless the Grantor
and the State of Florida from all claims, actions, lawsuits and demands
arising out of this easement.
8. Grantee waives venue as to any litigation arising from matters
relating to this easement and any such litigation between Grantor and Grantee
shall be initiated and maintained only in Leon County, Florida.
9. This easement shall not be assigned or otherwise transferred without
prior written consent of the Grantor or its duly authorized agent. Any
assignment or other transfer without prior written consent of the Grantor
shall be null and void and without legal effect.

10. The Grantee, by acceptance of this easement, binds itself,its
successors and assigns, to abide by the provisions and conditions herein set
forth, and said provisions and conditions shall be deemed covenants of the
Grantee, its successors and assigns. In the event the Grantee fails or
refuses to comply with the provisions and conditions herein set forth or in
the event the Grantee violates any of the provisions and conditions herein,
this easement may be terminated by the Grantor upon 30 days written notice to
Grantee. If terminated, all of the above-described parcel of land shall
revert to the Grantor. All costs, including attorneys' fees, incurred by the
Grantor to enforce the provisions of this easement shall be paid by the
Grantee. All notices required to be given to Grantee by this easement or
applicable law or administrative rules shall be sufficient if sent by U.S.
Mail to the following address:

The Grantee agrees to notify the Grantor by certified mail of any
changes to this address at least ten (10) days before the change is effective.
11. The Grantee shall assume all responsibility for liabilities that
accrue to the subject property or to the improvements thereon, including any
and all drainage or special assessments or taxes of every kind and description
which are now or may be hereafter lawfully assessed and levied against the
subject property during the effective period of this easement which result
from the grant of this easement or the activities of Grantee hereunder.
12. Renewal of this easement is at the sole option of the Grantor. Such
renewal shall be subject to the terms, conditions and provisions of current
management standards and applicable laws, rules and regulations in effect at
that time. In the event that Grantee is in full compliance with the terms of
this easement, the Grantee shall be allowed a 30-day grace period after
expiration of this easement to apply in writing for a renewal. If the Grantee
fails to apply for a renewal within the grace period, or in the event the
Grantor does not grant a renewal, the Grantee shall vacate the premises and
remove all structures and equipment occupying and erected thereon at its
expense.
13. If the Grantee does not remove said structures and equipment
occupying and erected upon the premises after expiration or cancellation of
this easement, such structures and equipment will be deemed forfeited to the
Grantor, and the Grantor may authorize removal and may sell such forfeited
structures and equipment after ten (10) days written notice by certified mail
addressed to the Grantee at the address specified in Item 11 or at such
address on record as provided to the Grantor by the Grantee. However, such
remedy shall be in addition to all other remedies available to Grantor under
applicable laws, rules and regulations including the right to compel removal
of all structures and the right to impose administrative fines.
14. No failure, or successive failures, on the part of the Grantor to
enforce any provision, nor any waiver or successive waivers on its part of any
provision herein, shall operate as a discharge thereof or render the same
inoperative or impair the right of the Grantor to enforce the same upon any
renewal thereof or in the event of subsequent breach or breaches.
15. The Grantee, at its own expense, shall record this easement and any
subsequent approved renewal and/or modified easements in the official records
of the county within which the easement site is located within ten (10) days
after receipt of a fully executed copy of this easement, and shall provide the
Grantor with a copy of the recorded easement indicating the book and page at
which the easement is recorded.
16. This easement is the entire and only agreement between the parties.
Its provisions are not severable. Any amendment or modification to this
easement must be in writing and must be accepted, acknowledged and executed by
the Grantee and Grantor.
17. SPECIAL EASEMENT CONDITIONS:
a. The Grantee shall ensure that no maintenance dredging activities
shall occur within the easement area without obtaining prior written consent
form the Grantor and without paying for the severed dredge materials at the
rate per cubic yard in effect at the time of the Grantor's authorization.
Unless specifically authorized in writing by the Grantor, such activities and
removal of sovereignty submerged materials shall be considered unauthorized
and a violation of Chapter 253, Florida Statutes, and shall subject the
Grantee to administrative fines under Rule 18-14, Florida Administrative Code.
b. All spoil material is to be deposited on public land and used for
public purposes.

GENERAL CONDITIONS:
1. The terns, conditions, requirements, limitations and restrictions set forth in this permit are
The
conditions" an4 are binding and enforceable pursuant to Sections 403.141, 403.72'7, or
403.859 through ;403.866,1, F.S. The permittee is placed on notice that the Department will
ri
review this permit peodimcally and may initiate enforcement action for any violation of these
conditions.
2. This permit is valid only for the specific processes and operations applied for and indicated in
the approved drawings or exhibits. Any unauthorized deviation from the approved drawings
exhibits, specifications, or conditions of this permit may constitute grounds for revocation and
enforcement action by the Department.
3. As provided in subsections 403.087(6) and 403.722(5), F.S., the issuance of this permit does not
convey any vested rights or any exclusive privileges. Neither does it authorize any injury to
n
public or vate property or any invasion of personal rights,,nor any infringement of federal,
state, or Focal laws or regulations. This permit is not a waiver of or approval of any other
Department permit that may be required for other aspects of the total project which are not
addressed in this permit.
4. This permit conveys no title to land or water, does not constitute State recognition or
acknowledgement otitle, and does not constitute authority for the use of submerged lands
unless hereinrovided and the necessary title or leasehold interests have been obtained from
the State. Only the Trustees of the Internal Improvement Trust Fund may express State opinion
as to title.

5. This permit does not relieve the permittee from liability for harm or injury to human health or
welfare, animal, orlant life,,or property caused by the construction or operation of this
permitted source, or from penalties there ore;nor does it allow the permittee to cause pollution
in contravention of Florida Statutes and Department rules, unless specifically authorized by an
order from the Department. . ,
6. The permittee shall properly operate and maintain the facility and systems of treatment and
• control (and related appurtenances) that are installed and used by the pertmttee to achieve
compliance with the conditions of this permit, as required by, Department rules. This provision •
includes the operation of backup or auxiliary facilities or similar,systems when necessary to
achieve compliance with the conditions of the permit and when required by Department rules.
7. The permittee, by accepting this permit, specificaIIy agrees to allow authorized Department
personnel, upon presentation of credentials or other documents as may be required by law and
at reasonable times, access to the premises where the permitted activity is located or
conducted to: •
•
(a) Have access to and copy any records that must be kept under conditions of the permit;
(Ii) Inspect the facility, equipment, practices, or operations regulated or required under this
permit;and
(c) Sample or monitor any substa.ices or parameters at any location reasonably necessary to
assure compliance with this permit or Department rules.
Reasonable time may depend on the nature of the concern being investigated.
8. If, for any reason, the permittee does not comply with or will be unable to comply with any
condition or limitation specified in this permit, the permittee shall immediately provide the
Department with the following information
(a) A description of and cause of noncompliance;and if
(b) The time the noncompliincluding
nce is a anddates times;

reduce,eliminate,and prevent recurrence offthe noncompliance.
The permittee shall be responsible for any and all damages which may result and may,be subject
to enforcement action byte Department for penalties or for revocation of this permit.

GENERAL CONDITIONS:
•
9. In accepting this permit, the permittee understands and agreesthat all records, notes,
ri
moniton data and other information relatin to the construction or operation of this
permitted source which are submitted to the IJepartment may be used by the Department as
evidence in any enforcement case involving the permitted source arisin under theFlorida
Statutes or Department rules, except where such use is prescribed by-Section 403.11I and
403.73, F.� Such evidence shall only be used to the extent it is onsistent with the Florida
Rules of Civil Procedure and appropriate evidentiary rules.
10. The permittee agrees to comply with changes in Department rules and Florida Statutes after a
reasonable time for compliance; provided, however, the permittee does not waive any other
rights granted by Florida Statutes or Department rules.
11. This permit is transferable only upon Department approval in accordance with Rule 17-4.120
and 17-30.300, F.A. , as applicable. The permittee shall be liable for any non-compliance of
the permitted activity until the transfer is approved by the Department.
I2. This permit or a copy thereof shall be kept at the work site of the permitted activity.
13. This permit also constitutes:
() Determination of Best Available Control Technology(BACT)
() Determination of Prevention of Significant Deterioration(PSD)
(x, Certification of compliance with state Water Quality Standards(Section 401, PL 92-500)
() Compliance with New Source Performance Standards
14. The permittee shall comply with the following:
(a) Upon request, the permittee shall furnish all records andlans required under Department
rules. During enforcement actions, the retention period for all records will be extended
automatically unless otherwise stipulated by the Department.
(b) The permittee shall hold at the facility or other location designated by this permit records
of all monitoring information (including all calibration and maintenance records and all
original strip chart recordings for continuous monitoring instrumentation) required by the
permit, copies of all reports required b this permif, and records of all data used to
complete the application for this permit. These materials shall be retained at least three
year. from the date of the sample, measurement,report, or application unless otherwise
specified by Department rule.
(c) Records of monitoring information shall include:
1. the date, exact place,and time of sampling or measurements;
2. the person responsible for performing the sampling or measurements;
3. the dates analyses were performed;
4. the person responsible for performing the analyses;
5. the analytical techniques or methods used;
6. the results of such analyses.
15. When requested by the Department,,the permittee shall within a reasonable time furnish any
information required by law which is needed to determine compliance with the permit. If the
permittee becomes aware the relevant facts were not submitted or were incorrect in the permit
application or in any report to the Department, such facts or information shall be corrected
promptly.

SPECIFIC CONDITIONS:
1. Prior to construction of work authorized by this permit, the permittee
shall provide written notification of the date of commencement , of
construction to the Central District Office of the Department of
Environmental Regulation, 3319 Maguire Boulevard, Suite 232, Orlando,
Florida 32803-3767.
2. Turbidity must be controlled to prevent violations of water quality
pursuant to Rule 17-302.510(3)(r), Florida Administrative Code.
Turbidity shall not exceed 29 Nephelometric Turbidity Units above natural
background conditions.
3. Within 30 days of completion of work authorized by. this permit, the
permittee shall provide written notification of the date of completion of
construction to the Central District Office of the Department of
Environmental Regulation, 3319 Maguire Boulevard, Suite 232, Orlando,
Florida 32803-3767.
4. Anchored turbidity barriers shall be installed around the entire
construction area and remain until all work is complete and background
conditions have returned.
5. The applicant will be responsible for installing standard navigational
signs displaying "No Wake" on both sides of the channel.
6. All spoil material shall be disposed of in the upland bermed disposal
site. The spoil site shall be built so no water will be able to escape
out of the site and ultimately into waters of the state.
7. All dredging within the access channel shall be performed by suction
dredge method to prevent violations of state water quality standards.
8. Prior to any work commencement, a signed and sealed planview and
cross-sectional view drawing showing the spoil disposal site must be
submitted to the Central District office. Also, please provide a
narrative explaining in detail how the spoil will get to the spoil area
from Starke Lake.
9. The permittee is hereby advised that Florida law states: "No person
shall commence any excavation, construction, or other activity involving
the use of sovereign or other lands of the state, title to which is
vested in the Board of Trustees of the Internal Improvement Trust Fund
or the Department of Natural Resources under Chapter 253, until such
person has received from the Board of Trustees of the Internal
Improvement Trust Fund the required lease, license, easement, or other
form of consent authorizing the proposed use." Pursuant to Florida
Administrative Code Rule 16Q-14, if such work is done without consent, or
if a person otherwise damages state land or products of state land, the
Board of Trustees may level administrative fines of up to $10,000 per
offense.

10. If historic and/or archaeological cultural materials are discovered, at
any time within the project site, the permittee shall 'immediately stop
all operations and notify the DER district office and James Miller, State
Archaeologist, Division of Historical Resources, Bureau of Archaeological
Research, R. A. Gray Building, 500 South Bronough Street, Tallahassee,
Florida 32399-0250.
11. The project shall comply with applicable state water quality standards,
including:
A. 17-302.500 - minimum' criteria for all surface waters at all places
and at all times,
B. 17-302.510 - Surface waters: general criteria, and
C. 17-302.560 - Class : III Waters - Recreation - Propagation and
maintenance of a healthy, well-balanced population of Fish and
Wildlife.
