Final Subdivision Plans

ISSUE:
Should the Honorable Mayor and Board of City Commissioners approve
the West End Professional Park Final Subdivision Plans?
BACKGROUND:
The Preliminary Subdivision Plans were approved by the City
Commission on February 16 , 1993 .
DISCUSSION:
The Development Review Committee met July 21 , 1993 and unanimously
approved to recommend to the Planning & Zoning Commission that the
West End Professional Park, Final Subdivision Plans be approved
with the provision that the term "unless other-wise determined" be
stricken from the Sidewalk Comments of the plans .
CONCURRENCY MANAGEMENT:
The Developer has been informed that prior to Final Subdivision
Plan approval the applicant/owner will need to apply for and obtain
a Final Certificate of Concurrency pursuant to Article IX of the
Ocoee Land Development Code. Attached is a report from Janet
Resnik addressing concurrency .
PLANNING AND ZONING COMMISSION :
The Planning and Zoning Commission met August 10 , 1993 and
unanimously recommended approval of the Final Subdivision Plans for
West End Professional Park with the stipulation that only Lots 2-7
may be issued building permits and that the developer must apply
for and receive a Final Certificate of Concurrency on the remaining
lots before they may be issued any permits at this time .

STAFF RECOMMENDATION :

BACKGROUND
West End Professional Park is zoned I-1 and has a total of 29 lots . The
Preliminary Subdivision Plan was approved this past February. Because the
plan was submitted to the City before the concurrency management system was
in place, the Preliminary Subdivision Plan did not go through a concurrency
review; however, the Preliminary Plan did contain a note requiring the
developer to apply for and obtain a Final Certificate of Concurrency in
conjunction with Final Subdivision Plan review.
DISCUSSION
In June the developer applied for a Final Certificate of Concurrency for Lots
2-7 . On July 21 , 1993 the Development Review Committee recommended approval
of the Final Subdivision Plans . A concurrency determination has been made
and the Final Certificate of Concurrency is in the process of being issued.
The Certificate will be for Phase One only which consists of Lots 2-7 . There
is a note on the Final Subdivision Plans which stipulates that the developer
must apply for an additional Final Certificate of Concurrency for all other
lots within the subdivision .
RECOMMENDATION
Staff respectfully recommends that the Honorable Mayor and City Commission
approve the Final Subdivision Plans for West End Professional Park with the
stipulation that only Lots 2-7 may be issued building permits and that the
developer must apply for and receive a Final Certificate of Concurrency on
the remaining lots before they may be issued any permits .

7. CONTRACTOR SHALL FURNISH OWNER WITH ACCURATE RECORD DRAWINGS
SHOWING AS -CONSTRUCTED HORIZONTAL AND VERTICAL DIMENSIONING OF THE
WORK. THE SUBMITTAL COPY OF THE RECORD DRAWINGS WILL NOT BE
RETURNED. THE RECORD DRAWING OR A REPRODUCIBLE COPY PREPARED BY
ENGINEER SHALL BE CERTIFIED BY THE CONTRACTOR AS CORRECT. ALL
INFORMATION WHICH IS UNCHANGED AND CURRENT SHALL BE NOTED BY
CHECKING OFF OR CIRCLING. ALL REVISED INFORMATION SHALL BE CROSSED
THROUGH AND NEW DATA ADDED.
8. THE LOCATIONS OF EXISTING UTILITIES AND STORM DRAINAGE SHOWN ON THE
PLANS HAVE BEEN DETERMINED FROM THE BEST INFORMATION AVAILABLE AND
ARE GIVEN FOR THE CONVENIENCE OF THE CONTRACTOR. ENGINEER ASSUMES
NO RESPONSIBILITY FOR INACCURACY. PRIOR TO THE START OF ANY
CONSTRUCTION ACTIVITY, IT SHALL BE THE CONTRACTOR'S RESPONSIBILITY TO
MAKE ARRANGEMENTS FOR FIELD LOCATIONS AND FOR ANY RELOCATIONS OF
THE VARIOUS EXISTING UTILITIES WITH THE UTILITY OWNERS, WHICH SHALL BE

CONTRACT AND NO EXTRA COMPENSATION WILL BE ALLOWED.
9. THE CONTRACTOR SHALL IMMEDIATELY NOTIFY THE ENGINEER OF ANY
DISCREPANCIES FOUND BETWEEN DRAWINGS AND THE FIELD CONDITIONS PRIOR
TO CONSTRUCTION IN THE AREA IMPACTED BY THE CONFLICT.
10. FLORIDA LAW (553.851) REQUIRES THAT PERSONS MAKING EXCAVATIONS IN
PUBLIC OR PRIVATE STREETS, ALLEYS, RIGHTS-OF-WAY, OR UTILITY EASEMENTS
WITH HAND TOOLS OR POWER EQUIPMENT MUST FIRST OBTAIN INFORMATION ON
THE LOCATION OF UNDERGROUND GAS PIPELINES. THIS INCLUDES ANY
OPERATION WHICH MOVES OR REMOVES ANY STRUCTURE, EARTH, ROCK, OR
OTHER MASS OF MATERIAL BY SUCH METHODS AS DIGGING, BACKFILLING,
DEMOLITION, GRADING, DITCHING, DRILLING, BORING AND CABLE PLOWING. THE
EXCAVATOR MUST NOTIFY THE GAS UTILITY A MINIMUM OF 48 HOURS AND A
MAXIMUM OF 5 DAYS PRIOR TO EXCAVATING (EXCLUDING SATURDAYS, SUNDAYS,
AND LEGAL HOLIDAYS).
11. ALL RECOMMENDATIONS AND REQUIREMENTS OF INSPECTION PERSONNEL
OTHER THAN OWNER'S SHALL BE REPORTED TO ENGINEER/OWNER PRIOR TO
IMPLEMENTATION. COMPENSATION WILL NOT BE ALLOWED FOR WORK WHICH IS
NOT AUTHORIZED BY ENGINEER/OWNER.
12. CONTRACTOR SHALL PROTECT LAKE LILLY, ADJACENT WETLAND
CONSERVATION AREAS AND ALL ADJACENT PROPERTIES FROM DAMAGE BY
SEDIMENTATION OR OTHER POTENTIAL CONSTRUCTION RELATED CAUSES.
13. ALL WORK SHALL BE OPEN TO AND SUBJECT TO INSPECTION BY AUTHORIZED
PERSONNEL OF THE CITY, COUNTY, OWNER, INVOLVED UTILITY COMPANIES,
PROJECT ENGINEER AND REGULATORY AGENCIES.
14. CONTRACTOR SHALL NOTIFY ALL APPROPRIATE UTILITY COMPANIES OF
PROPOSED START OF WORK IN ACCORDANCE WITH THEIR STANDARD
REQUIREMENTS; INCLUDING BUT NOT LIMITED TO WATER, SEWER, POWER,
TELEPHONE, GAS AND CABLE TV COMPANIES.
15. CONTRACTOR SHALL BE EXTREMELY CAUTIOUS WHEN WORKING NEAR TREES
WHICH ARE TO BE SAVED, WHETHER SHOWN IN THE PLANS OR DESIGNATED IN
THE FIELD.
16. CONTRACTOR SHALL STAKE ALL IMPROVEMENTS USING THE PLAT.
CONTRACTOR SHALL CONFIRM WITH THE ENGINEER THAT THE PLAT IS CURRENT
PRIOR TO CONSTRUCTION. IT IS THE CONTRACTOR'S SOLE RESPONSIBILITY TO
COMPLETELY STAKE AND CHECK ALL IMPROVEMENTS TO ENSURE ADEQUATE
POSITIONING, BOTH HORIZONTAL AND VERTICAL.
17. CONTRACTOR SHALL CONFIRM COMPATIBILITY OF PIPE SLOPES AND INVERTS
DURING SHOP DRAWING AND MATERIALS ORDERING PHASE OF PROJECT AND
ADVISE ENGINEER OF ANY DISCREPANCIES.
STORMWATER MANAGEMENT:
1. 100 YEAR FLOOD ELEVATION FOR LAKES LILLY & PEARL IS 120.5.
2. LOTS 1, 2, 3, 6, 7, 8, 9 &10 SHALL PROVIDE ON SITE STORMWATER RETENTION TO MEET
THE WEKIVA RIVER HYDROLOGIC BASIN RECHARGE STANDARD PER THE SJRWMD
APPLICANTS HANDBOOK SECTION 11.31. SYSTEMS ON INDIVIDUAL LOTS TO BE OWNED
AND MAINTAINED BY LOT OWNERS. APPROPRIATE PERMITTING BY THE SJRWMD SHALL
BE THE RESPONSIBILITY OF INDIVIDUAL LOT DEVELOPERS.
3. MASTER STORMWATER SYSTEM AND CONSERVATION AREA IN TRACTS A & B TO BE
OWNED AND MAINTAINED BY PROPERTY OWNER'S ASSOCIATION.
4. COMPENSATING STORAGE HAS BEEN PROVIDED WITHIN THE EXISTING STORMWATER
FACILITY TO ALLOW FILLING OF ALL FLOOD PLAIN AREAS ON THE PROPOSED LOTS.
