SUBJECT: Quit Claim Deed Approval at Ocoee Industrial Park
Background
A 30' x 60' parcel at the corner of Enterprise Street and L.F. Roper Parkway was purportedly
conveyed to the City by Yusuf Mohamad Excavation, Inc. Though recorded, this parcel was not
the property of Mohamad Excavation thus making the conveyance to the City a moot point. This
Quit Claim Deed is to remove any questions regarding the City's responsibilities to this property.
Recommendation
Staff recommends that the Honorable Mayor and Board of City Commissioners approve the Quit
Claim Deed as submitted.

QUIT CLAIM DEED
THIS QUIT CLAIM DEED made and executed as of this day
of August, 1994, by the CITY OF OCOEE, a Florida municipal
corporation, whose post office address is 150 N. Lakeshore Drive,
Ocoee, Florida 34761 (hereinafter referred to as the "Grantor") to
AMSOUTH BANK OF FLORIDA, successor by merger to Orange Bank, a
Florida corporation, whose post office address is 65 N. Orange
Avenue, Orlando, Florida 32801 (hereinafter referred to as the
"Grantee") :
(Whenever used herein the terms "Grantor" and "Grantee" include all
the parties to this instrument and the heirs, legal representatives
and assigns of individuals, and the successors and assigns of
corporations, public bodies and quasi-public bodies.)
WITNESSET H:
THE GRANTOR, for and in consideration of the sum of
$10.00 and other valuable considerations, receipt whereof is hereby
acknowledged, by these presents does hereby remise, release, and
quit-claim unto the Grantee forever, all of the right, title,
interest claim and demand which the Grantor has in and to that
certain land, situate, lying and being in Orange County, Florida,
more particularly described in Exhibit "A" attached hereto and by
this reference made a part hereof (hereinafter referred to as the
"Property" or "said Land") .
TO HAVE AND TO HOLD, the same together with all and
singular the appurtenances thereunto belonging or in anywise
appertaining, and all the estate, right, title, interest, lien,
equity and claim whatsoever of the Grantor, either in law or in
equity, to the only proper use, benefit and behoof of the Grantee
forever.
BY EXECUTION OF THIS QUIT-CLAIM DEED GRANTOR IS RELEASING
AND QUIT CLAIMING UNTO GRANTEE ALL OF GRANTOR'S RIGHT, TITLE,
INTEREST, CLAIM AND DEMAND WHICH GRANTOR HAS OR MAY HAVE ARISING
OUT OF THAT CERTAIN WARRANTY DEED, DATED FEBRUARY 27, 1990, FROM
YUSUF MOHAMAD EXCAVATION, INC. TO THE CITY OF OCOEE, AS RECORDED IN
OFFICIAL RECORDS BOOK 4162, PAGE 353 OF THE PUBLIC RECORDS OF
ORANGE COUNTY, FLORIDA WHICH DEED PURPORTED TO CONVEY THE PROPERTY
TO THE CITY OF OCOEE, FLORIDA.

LEGAL DESCRIPTION
That certain land located in Orange County, Florida,
being more particularly described as follows:
A part of the NW 1/4 of the NW 1/4, Section 19, Township
22 South, Range 28 East, Orange County, Florida, more
particularly described as follows:
Begin at the intersection of the North right-
of-way line of Enterprise Street and the west
right-of-way line of L.F. Roper Parkway as
shown on the plat of West Orange Industrial
Park UNIT TWO, Plat Book 5, Pages 84 and 85,
Public Records of Orange County, Florida;
thence W. 00° 29' 47" E. (Bearings based on
Plat of West Orange Industrial Park, Unit I,
Plat Book 3, Page 118, Public Records of
Orange County, Florida) along the west right-
of-way line of L.F. Roper Parkway for 60.00
feet; thence S. 86° 52' 44" W. along the north
line of Lot A6, said plat of West Orange
Industrial Park, Unit two for 30.03 feet,
thence N. 00° 29' 47" W. (Bearings based on
Plat of West Orange Industrial Park Unit I,
Plat Book 3, Page 118, Public Records of
Orange County, Florida) for 60.00 feet; thence
N. 86° 52' 49" E. for 30.03 feet to the point
of beginning.
