ISSUE :
Should the Honorable Mayor and Board of City Commissioners approve
the Maguire Road Corporation application to vacate the City of
Ocoee' s interest in a 60 ' access easement (see Site Location Map
#1 ) within the Cross Creek Subdivision?
BACKGROUND DISCUSSION :
The subject 60 ' easement is located in the NE 1/4 of the NW 1/4 of
Section 32 , Township 22 South, Range 28 East . The easement was
granted by Raymer F. Maguire , Jr . and Sara C. Maguire to James V .
Ferdinand, Trustee on November 30 , 1987 as part of a Warranty Deed
recorded in Orange County Official Records Book 3939 , Pages 3870-
3871 (see "Note" on attached photocopy) .
The subject deed formed the bulk of the land constituting
Plantation Grove PUD situated east of Maguire Road, containing 150
+\- acres . A portion of the residential component of Plantation
Grove was sold to Pizzuti Development , Inc . , and is now being
developed as Cross Creek Subdivision. The subject easement
presently encumbers approximately the eastern one-half of lots 55-
62 (see Site Location Map #2 ) .
The City of Ocoee is being asked to vacate its interest in the 60 '
easement because Raymer and Sara Maguire as "Grantors reserve to
themselves , their successors and assign, an ingress/egress
easement , both pedestrian and vehicular, over the east sixty ( 60)
feet of the parcel conveyed herein, for the benefit of and
appurtenant to Grantor' s lands north of and adjacent to the parcel
conveyed herein" (see Site Location Map #3) . The City obtained

this property ( the South Water Plant site) in 1990 as the
successors-in-title to the Maguires (see attached Special Warranty
Deed OR 4263 , PG 1584-1585 , University of Florida to City of
Ocoee) . Consequently , the City became a party to this easement by
virtue of this acquisition. The City now has access to this
property directly from Maguire Road via a separate access easement
and no longer requires the subject easement leading from the south.
It should be noted, however , that this vacation only pertains to
the City ' s interest in the easement and does not affect any other
party' s potential rights . As indicated on the attached letter,
Florida Power Corporation wishes to retain 10 ' of this easement for
some of its existing facilities .
STAFF RECOMMENDATION:
There being no staff opposition to the Vacation Application and no
adverse utility comments , staff recommends that the Honorable Mayor
and Board of City Commissioners adopt Resolution No . 94-15 which
abandons the City' s interest in the easement described in Exhibit
"A"

COUNTY, FLORIDA; PROVIDING FOR RECORDATION; PROVIDING FOR
SEVERABILITY; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Ocoee is the successor beneficiary
of that certain ingress/egress easement, both pedestrian and
vehicular, reserved over the east sixty feet of the parcel
described in that certain Warranty Deed dated November 30, 1987 and
recorded in Official Records Book 3939, Page 3870 to 3871,
inclusive, of the Public Records of Orange County, Florida, a legal
description of such easement to be abandoned and vacated is
attached hereto as Exhibit "A" and by reference made a part hereof
(the "Easement" ) ; and,
WHEREAS, the City of Ocoee does not require the Easement
for ingress/egress to the City owned property benefitted by the
Easement as the City has access to such property directly from
Maguire Road pursuant to a separate access easement; and,
WHEREAS, the City Commission of the City of Ocoee desires
to abandon and vacate the City of Ocoee' s right of ingress/egress
across, over, and through the Easement in order to allow for the
platting and development of a particular subdivision commonly known
as "Cross Creek" ; and,
WHEREAS, the Maguire Road Corporation (the "Applicant")
was the owner of the land underlying the easement at the time of
the filing of the application and that said land is presently owned
by Cross Creek Development Company and that Cross Creek Development
Company has consented in writing to the application and has
authorized the Applicant to take such actions on its behalf as may
be necessary to vacate the Easement; and,

WHEREAS, pursuant to Article II of Chapter 153 of the
Code of the City of Ocoee, an application has been filed by the
Applicant to abandon and vacate the easement; and,
WHEREAS, the Applicant has complied with the provisions
of Section 153-10 regarding the provision of certain information in
connection with the application; and,
WHEREAS, the Easement is located within the corporate
limits of the City of Ocoee; and,
WHEREAS, pursuant to Section 153-13 (D) (1) of the Code of
the City Ocoee notice of the public hearing before the City
Commission was provided by regular mail to owners of real property
abutting the Streets and all owners of the property within three
hundred (300) feet in all directions of the Easement; and,
WHEREAS, pursuant to Section 153-13 (D) (2) of the Code of
the City of Ocoee a Notice of Public Hearings was published one (1)
time in a newspaper of general circulation in the City of Ocoee;
and,
WHEREAS, pursuant to Section 153-13 (D) (3) of the Code of
the City of Ocoee, a sign setting forth notice of the public
hearing before the City Commission was posted upon the land
underlying the Easement; and
WHEREAS, the City Commission of the City of Ocoee finds
that said application and supporting documents are in accordance
with the requirements of Article II of Chapter 153 of the Code of
the City of Ocoee and that the requested action is consistent with
the City of Ocoee Comprehensive Plan;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF OCOEE, FLORIDA, AS FOLLOWS:
SECTION ONE. Authority. The City Commission of the City
of Ocoee has the authority to adopt this Resolution pursuant to
Article VIII of the Constitution of the State of Florida, Chapter
166, Florida Statutes, and Article II of Chapter 153 of the Code of
the City of Ocoee.
SECTION TWO. Abandonment and Vacation of the Easement.
The City Commission of the City of Ocoee, Florida hereby abandons,
vacates and renounces any rights in and to those portions of that
certain ingress/egress easement located in the City of Ocoee
reserved in that certain Warranty Deed dated November 30, 1987 and
recorded in the Official Records Book 3939, Pages 3870 to 3871,
inclusive, of Orange County, Florida, a legal description of such
easement to be abandoned and vacated being attached hereto as
Exhibit "A" and by this reference made as part hereof (the
"Easement" ) .

SECTION THREE. Recordation. A certified copy of this
Resolution shall be filed with the Orange County Comptroller and
duly recorded among the Public Records of Orange County, Florida.
SECTION FOUR. Severability. If any section, subsection,
sentence, clause, phrase or portion of this ordinance is for any
reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct and
independent provision and such holding shall not affect the
validity of the remaining portion hereto.
SECTION FIVE. Effective Date. This Resolution shall
become effective immediately upon passage and adoption.
