SUBJECT: CONCURRENCY APPLICATION FORMS
ISSUE
Should the Honorable Mayor and Board of City Commissioners approve
Resolution 94- 32 which adopts additional forms for the
implementation of Article IX of the Land Development Code?
BACKGROUND AND DISCUSSION
In April of this year, the City adopted a new Article IX of the Land
Development Code (LDC) . The revisions to the Concurrency section
of the LDC were made to formally adopt new requirements and
procedures, as well as to clarify the process for developers . Prior
-to the revisions, there was only one form incorporating all the
different stages of the concurrency process, and applicants had
difficulty determining which parts of the application were
applicable for their current situation. Following the adoption,
separate application forms were made for each phase of the
development review process .
Staff has devised these separate forms for use in the concurrency
management system:
- Preliminary Certificate of Concurrency Application
- Final Certificate of Concurrency Application
- Transportation Capacity Reservation Certificate Application
- Application to Shift Transportation Capacity to a Subsequent Year
- Application to Transfer Transportation Capacity to a New Owner
These forms are attached to the Resolution and are outlined on
Exhibit "A" . The form numbers are in keeping with the sequence of
forms that have been developed for use with the LDC. The list of
forms is maintained by the Planning Department . The City Attorney
has reviewed these applications for both form and legality.
RECOMMENDATION
Staff respectfully requests that the Honorable Mayor and Board of
City Commissioners adopt Resolution 94- 32 .

RESOLUTION NO. 94- 32
A RESOLUTION OF THE CITY OF OCOEE, FLORIDA,
ADOPTING ADDITIONAL FORMS FOR THE IMPLEMENTATION OF
THE LAND DEVELOPMENT CODE PURSUANT TO SECTION 1-13
OF CHAPTER 180 OF THE OCOEE CITY CODE; PROVIDING
THAT THIS RESOLUTION IS SUPPLEMENTAL TO PREVIOUS
RESOLUTIONS ADOPTING LAND DEVELOPMENT CODE FORMS;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 1-13 of Chapter 180 of the Code of
Ordinances for the City of Ocoee authorizes the City Commission of
the City of Ocoee to from time to time adopt by resolution forms
for the implementation of the Land Development Code; and
WHEREAS, forms for the implementation of the Land
Development Code have been prepared by the staff of the City of
Ocoee, and the City Commission of the City of Ocoee, after
reviewing the forms, desires to adopt and approve such forms .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF OCOEE, FLORIDA:
SECTION ONE: Authority. The City Commission of the
City of Ocoee has the authority to adopt this Resolution pursuant
to Section 1-13 of Chapter 180 of Code of Ordinances of the City of
Ocoee, Article VIII of the Constitution of the State of Florida and
Chapter 166 , Florida Statutes .
SECTION TWO: Additional Land Development Code Forms.
The City Commission of the City of Ocoee hereby adopts and approves
the additional CITY OF OCOEE LAND DEVELOPMENT CODE FORMS as set
forth in Exhibit "A" attached hereto and by this reference made a
part hereof .
SECTION THREE: Resolution Supplemental. This Resolution
is supplemental to Resolution Nos . 92-12 , 92-18, and all
resolutions adopting Land Development Code Forms which may have
heretofore been or may be hereafter adopted by the City Commission
of the City of Ocoee.
SECTION FOUR: Severability. If any section, subsection,
sentences, clause, phrase or portion of this Resolution is for any
reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct and
independent provision and such holding shall not affect the
validity of the remaining portion hereto.
SECTION FIVE: Conflicts. All resolutions, parts of
resolutions or acts of the City Commission of the City of Ocoee in
conflict herewith are hereby repealed and rescinded.
SECTION SIX: Effective Date. This Resolution shall
become effective immediately upon passage and adoption.

AUTHORIZED SIGNATURE:

- A Final Certificate of Concurrency (FCC) encumbers transportation
capacity for ninety (90) days . Within the 90 day period, I must obtain
a one-time renewal of my FCC for traffic circulation or receive a
building permit or a Transportation Capacity Reservation Certificate
(TCRC) ; otherwise the FCC expires for transportation capacity. I
understand that only one additional FCC (two total for each project for
a total of 180 days) may be obtained before I must obtain a TCRC or a
building permit and that I must apply for a TCRC by the 70th day of my
90-day transportation reservation (or any 90-day extension thereof) .
- A FCC reserves both solid waste capacity and recreation capacity for one
(1) year from the date of issuance of the FCC.
- A FCC reserves stormwater drainage capacity for one (1) year from the
date of issuance of the FCC, subject to obtaining final engineering, if
applicable, in compliance with the Land Development Code and other such
stormwater drainage approvals as may be required by the Land Development
Code and other applicable laws, statutes, ordinances, rules and
regulations .
- Sanitary sewer and potable water reservation capacity is done in
accordance with the terms of independent developer agreements to be
entered into with the City of Ocoee . A Final Certificate of Concurrency
does not modify any such developer agreements .
- My building permit will not be approved if the proposed use (s) , square
footage and/or number of units listed on the permit application are
greater than those submitted on this application and for which a Final
Certificate of Concurrency (FCC) has been issued. I understand that I
will need to apply for a separate FCC for any proposed use (s) , square
footage and/or number of units not included in my FCC.
- The Development Administrator may require additional information in
order for an accurate assessment to be conducted. I understand that the

for traffic circulation, a Final Certificate of Concurrency must be
maintained to keep the project concurrent in all other areas . In the

agreements . Transportation capacity under the TCRC may only be used if
the project remains concurrent for water, sewer, solid waste,
stormwater drainage, and recreation and open space (the latter two
being for residential projects only) .
- A TCRC reserves capacity for a set period of time . If I do not use the
capacity within that time, I lose my reserved capacity and up to 30% of
my reservation fee . A TCRC is valid only for the specific real
property described in the TCRC application.
- My building permit will not be approved if the proposed use (s) , square
footage and/or number of units listed on the permit application are
greater than those submitted on this application.
- A transportation capacity reservation fee must be paid no later than
(1) the date of expiration of my Final Certificate of Concurrency with
respect to traffic circulation, or (2) 10 working days from receipt of
notice from the Development Administrator.
- A TCRC allows me to use the transportation capacity reserved only
during the one-year period requested on my application. I must apply
to shift the capacity to use the reserved capacity at any other time.
- The City of Ocoee may require additional information in order for an
accurate assessment to be conducted. I understand that the City of
Ocoee cannot conduct special studies such as traffic counts on roads
not regularly monitored and that I may be required to submit a traffic
study obtained at my own expense . I understand that review and
approval of proposed development may be postponed for a reasonable time

capacity within that time, I lose my reserved capacity and up to 30% of my

footage and/or number of units listed on the permit application are greater
than those submitted on this application.
- The Development Administrator may require additional information in order
for an accurate assessment to be conducted. I understand that the City of
Ocoee cannot conduct special studies such as traffic counts on roads not
regularly monitored and that I may be required to submit a traffic study
obtained at my own expense . I also understand that review and approval of
proposed development may be postponed for a reasonable time period in order
for me to gather additional information. I also understand that proposed
development may be denied approval for my failure to provide adequate
information on the projected impacts created by the development .
- All Transportation Capacity Reservation Certificates (TCRCs) are valid only
for the specific real property described in the original application.
Transportation capacity may be reassigned or allocated within the
boundaries set forth in the original TCRC by application to the City. At
no time may transportation capacity or any TCRC be sold or transferred to
another party or entity separate from the real property described in the
original application and set forth in the TCRC. All TCRC' s run with the
