CROSS CREEK - SINGLE FAMILY SUBDIVISION PHASE I FINAL SUBDIVISION PLANS APPROVAL ISSUE: Should the Honorable Mayor and Board of City Commissioners approve Phase I (158 lots) of the Final Subdivision Plans for the Single Family portion of the Plantation Grove P.U.D. named "Cross Creek"? BACKGROUND: Plantation Grove P.U.D. is a multi use project located on the east side of Maguire Road, directly north of Moore Road. It has certain vested rights as outlined in Certificate of Vesting CV-92-1 . The City Commission approved the Preliminary Subdivision Plans for the project on May 18 , 1993 . The proposed Final Subdivision Plans call for a total of 322 single family lots on approximately 90 acres resulting in a gross density of 3 . 6 units per acre . The Owner is Maguire Road Corporation, and Pizzuti Development , Inc . is the Developer for the single-family portion of the project . Even though the Final Subdivision Plans cover the entire development , only Phase I , totaling 158 lots , is requested for approval . All development standards are consistent with the approved Revised Land Use Plan. Typical lot size is 60 ' x 115 ' , with a 6, 800 sq. ft . minimum area. Setbacks are 25 ' front , 25 ' rear and 7 . 5 ' side. Minimum living area is 1200 sq. ft . Private recreational amenities are provided in a 2 . 3 acre recreation area and include a tennis court , basketball court , community pool , barbecue area and tot lot . Parking for cars and bicycles is also provided. Staff Report - Cross Creek Phase I , Final Subdivision Plans December 2 , 1993 Page 2 DISCUSSION: The Development Review Committee reviewed and recommended approval of Phase I of the Final Subdivision Plans on June 30 , 1993 with the following conditions : (1) No building permits will be issued until all rights-of-way have been conveyed to and accepted by the City as required by Condition of Approval No. 20 of the Revised Land Use Plan; (2) All concurrency issues for Phase I , including water and sewer capacity are resolved prior to the Subdivision Plans being placed on the City Commission Agenda; (3) All required changes to the Final Subdivision Plan, as stipulated in the DRC meeting of June 30 , 1993 be included in the Revised Plan. PLANNING AND ZONING COMMISSION RECOMMENDATION: The Planning and Zoning Commission reviewed and Recommended Approval of the Final Subdivision Plans on July 13 , 1993 . DRC RECONSIDERATION: On August 10 , 1993 , the DRC was requested to review proposed modifications to the Final Subdivision Plans . These changes were determined to be non-substantial . As such, the revised Plans were only subject to staff technical review prior to being brought before the City Commission for approval . STAFF RECOMMENDATION: After review and acceptance of all technical modifications to the Plans , staff respectfully recommends that Phase I Final Subdivision Plans for "Cross Creek" Subdivision, (Plantation Grove P.U.D. - East - Single Family Portion) be approved subject to the following conditions : A. That no building permits will be issued until all rights-of- way along Maguire and Moore Roads have been conveyed to and accepted by the City as required by Conditions of Approval for the Revised PUD Land Use Plan. That all outstanding Concurrency issues for Phase I (158 lots) be resolved prior to the Pre-Construction Conference by payment of water and sewer impact fees . C. That an amended Development Agreement be approved by the City prior to submission of the Final Plat outlining the respective responsibilities of Pizzuti Development , Inc . and Maguire Road Corporation that are necessary to implement the overall project .
