APPLICATION FOR SPECIAL EXCEPTION
FOR A SCHOOL IN AN R-3 ZONE
ISSUE:
Should The Honorable Mayor and Board of City Commissioners approve
an Application for a Special Exception to allow a permanent school
use in an R-3 Zone?
BACKGROUND:
On September 15, 1992 , the Central Florida Community School
received a Special Exception for one-year to operate a school with
enrollment limited to forty ( 40 ) students (see attached minutes of
City Commission Meeting of September 15 , 1992) .
On August 30 , 1993 , Rev. Bryan Stamper, Pastor of St . Paul ' s
Presbyterian Church, submitted a Special Exception Application for
their lessee, Central Florida Community School , to operate a
permanent "private school for children not reaching their potential
in traditional education setting" (see attached letter and
application) .
On September 7 , 1993 , the one-year time period for the Special
Exception for the school was extended by the City Commission until
November 15 , 1993 .
On September 30 , 1993 , the Development Review Committee met and
unanimously approved with conditions the Application for Special
Exception.

On October 12 , 1993, the Planning and Zoning Commission met and
reviewed the Application for Special Exception. Their
recommendation included two of the three conditions made by the
DRC. The Planning and Zoning Commission was against the first
condition which was as follows : "1) that the School shall be
directly related to the Church and that the ministry shall have
some kind of control or input of the curriculum, and that there
shall be at least two members of any governing board that may be
implemented at a later date; " .
DISCUSSION:
The school now wishes to locate permanently at the church. The
school has applied for non-profit status (see attached letter from
Attorney Lynn Wright) . If the school achieves non-profit status ,
one of the major concerns of the City Commission would be solved.
The New Land Development Code, adopted July, 1992 , pg . 18091 , calls
for the Director of Planning (or the Development Review Committee)
to "make a report containing a recommended determination of facts
which are relevant to consideration of the proposal and a
recommended determination of the consistency of the proposal with
the adopted Comprehensive Plan. "
The proposal shall be considered by the Planning and Zoning
Commission at a public hearing after due public notice, along with
the report of the Director of Planning . Following completion of
the public hearing, the Planning and Zoning Commission or
Development Review Committee shall make a report of its findings
and recommendations to the City Commission.

Commission shall approve, disapprove, amend and approve the
proposal , or approve the proposal with conditions . Any action
taken shall be accompanied by the findings of the City Commission
upon which the action was based.

In approving a proposal , the City Commission may attach appropriate
conditions to ensure compliance with the provisions of this Code .
Such conditions may limit the uses , size of uses or structure, or
characteristics of the operation of a use , or may require buffers ,
landscaping, or other improvements not normally required.
Conditions may also require the periodic review of the use and may
provide for the expiration of the special exception on a date
certain.
Both the Planning and Zoning Commission and City Commission public
hearings must be advertised in a newspaper at least seven (7 ) days
before each hearing .
Standards for Action by the City Commission:
Approval of a special exception application shall be granted by the
City Commission only upon finding that :
(1) The proposed uses and structures would not violate the land
uses , densities , or other directives of the adopted
Comprehensive Plan or of this Code.
( 2) The proposed uses and structures would be compatible with the
uses , structures and activities on adjacent and nearby lands .
(3) The proposed uses and structures would not violate the health,
safety, welfare, and/or convenience of those residing, working
or owning land in the vicinity of the proposed use or
structure, specifically with respect to:
(a) The use or structure would not exceed the applicable
density or bulk regulations except as specifically
authorized, nor shall the use or structure result in
overcrowding of land or buildings ;
(b) The use or structure would not impair pedestrian or
vehicular movement in adjoining streets so as to violate
adopted level of service standards ;
(c) The use or structure would not create a fire hazard;

(d) The use or structure would not result in noise, odor,
glare, vibration, or other similar characteristic which
is detectable at the property line and which exceeds the
level which will result from permitted uses ;
(e) The use or structure would not prevent an adjoining
landowner from the legal use of his property pursuant to
this Code;
( f) The use or structure would not violate a requirement of
limitation of any applicable state or federal law or
regulation, and;
(g) The use or structure would not result in the inadequacy
or inability of any public facility or service to meet
adopted standards .
DRC RECOMMENDATION
The Development Review Committee voted to recommend the Board of
City Commissioners approve the Special Exception Application
allowing a permanent school use in an R-3 Zone subject to: 1) The
School shall be directly related to the Church and that the
ministry shall have some kind of control or input of the
curriculum, and that there shall be at least two members of any
governing board that may be implemented at a later date; 2) The
School enrollment shall not exceed a total of 190 full and/or part-

PLANNING AND ZONING COMMISSION RECOMMENDATION

allowing a permanent school use in an R-3 Zone subject to : 1) The
School enrollment shall not exceed a total of 190 full and/or part-
time students; and 2 ) All school activities conducted on the
premises shall be concluded by 10 P .M. Sunday through Thursday
nights and by 11 P .M. on Friday and Saturday nights . The motion
carried unanimously.

PUBLIC HEARINGS
Second Reading: Ordinance No. 92-21, relating to Interim Services Fees.
This ordinance was presented by title only for the second reading and public
hearing. Administrative Services Director Beamer explained that this ordinance
updates the fees established in Ordinance No. 91-26 and is in keeping with the
intent adopted last year for interim services fees based on the budget for demand
services provided. The public hearing was opened and, no one wishing to speak,
was closed. Commissioner Woodson, seconded by Commissioner Combs, moved to adopt
Ordinance No. 92-26 as presented. On roll call Commissioner Combs voted "aye,"
Commissioner Foster "aye," Commissioner Johnson "aye," Commissioner Woodson
"aye," and Mayor Dabbs "aye." Motion carried.
Request for One Year Special Exception - Central Florida Community School at St.
Paul's Presbyterian Church (Case No. 2-285E-92:St. Paul's) .
Planning Director Behrens presented the staff report. The public hearing was
opened and Mr. Bob Flanders, 2220 Hempel Avenue, Winter Garden, owner of Central
Florida Community School in Gotha said that he has 36 students with learning
style differences and is currently looking for a home for the school. Mr.
Flanders is requesting permission to place his school at St. Paul's Presbyterian
Church for a period of one year. Mr. Flanders said he recognized that one of the
problems the City had with issuing the permit is that the school is a for-profit
corporation but that he is applying for 501(C)3 corporation status which will put
them into a non-profit status. Although the audience was full of parents who
were present . to support Mr. Flanders in his request, no one else wished to
address Commission at this time. Commissioner Combs, seconded by Commissioner
Woodson, moved that the City Commission has found that the requested application
for special exception meets the criteria of Section 4-8(B) of Article IV of the
Land Development Code and to approve the Planning and Zoning Commission
recommendation to grant a special exception for one year with enrollment limited
to 40 students. Commissioner Woodson said he had visited St. Paul's on Sunday
and found it to be very nice but he objected to the fact that it was necessary
to show on their printed material their address as Winter Garden when they are
in fact located in Ocoee. Mayor Dabbs said that he also visited St. Paul's on
Sunday and had the same feelings about the facility. Mayor Dabbs said that he
had no problem with the church but he had a problem with the City providing a
for-profit situation for a for-profit institution to be in business in a not-for-
profit location. On roll call Commissioner Combs voted "aye," Commissioner
Foster "aye," Commissioner Johnson "aye," Commissioner Woodson "aye," and Mayor
Dabbs "no." Motion carried. Pastor Stamper expressed his appreciation to

Planning Director Behrens for his sensitive handling of a matter which at times
was a sticky wicket.

OTHER BUSINESS
Discussion on Placement of Insurance for FY 92-93.
Personnel Director Psaledal s advised that she had determined to find better
rates for the City's insurance coverage when the budget was reduced midyear and
found that placing the automobile coverage with Florida League of Cities rather
than with Brown and Brown Agency would result in a savings of $63,522. Ms.
Psaledalds recommended placing General Liability, Police Professional Liability,
Public Officials Liability, Emergency Medical Services Liability, Property Damage
(Building and Contents) , Boiler & Machinery (arching, mechanical break down) ,
Electronic Data Processing Equipment, Inland Marine (Miscellaneous Equipment) and
•
Crime with Brown and Brown as in the past, and to place Automobile Liability and
Physical Damage with Florida League of Cities. Ren Enlow, Brown and Brown,
explained the difference between "claims made" and "occurrence" coverage.
Commissioner Woodson, seconded by Commissioner Johnson, moved to adopt the
placement of the insurance coverage as recommended by Ms. Psaledakis. Motion
carried with unanimous vote in favor.
Resolution No. 92-17, relating to the Revision of Fire Captain's Job Description.
Resolution No. 92-17 was presented by title and City Manager Shapiro explained
that this description more accurately details the Fire Captain's job.
Commissioner Foster, seconded by Commissioner Combs, moved to adopt Resolution
No. 92-17 as presented. Motion carried with unanimous vote in favor.
Concurrency Management.
Resolution No. 92-18, adopting Concurrency Management Forms.
Resolution No. 92-18 was presented by title and Administrative Services Director
Beamer explained that the concurrency management application and certificate
forms are a part of the requirements of 9J5. Mayor Dabbs, seconded by
Commissioner Combs, moved to adopt Resolution No. 92-18 as presented. Motion
carried with unanimous vote in favor.

Commissioner Foster, moved to adopt Resolution No. 92-19 as presented. Motion
, carried with unanimous vote in favor.
Discussion on Street Name/Numbering System for State Road 50.
Planning Director Behrens recommended that the name West Colonial Drive be used
for the entire segment of State Road 50 located within the Ocoee City Limits, and
the street numbering system continue in a westerly direction from Good Homes Road
Plaza west to our city limits, because of the confusion caused by the existing

non-system. Mr. Bill Phillips, 1607 Ison Lane, said he wanted the addresses
nailed down for 911. Mr. R.P. Mohnacky, 1820 Prairie Lake Boulevard, suggested
having Congress and' the Post Officeproblem.get together and fix the address problem.
Mayor Dabbs advised that he has been to Washington and is working on it still.
Commissioner Woodson seconded by Commissioner Combs moved to accept the
Planning Director's recommendation. Motion carried with unanimous vote in favor.

re: Allowable Student Population at Central Florida Christian
School.
Based on our meeting with officials of Central Florida
Christian School and St. Paul 's Presbyterian Church on Friday,
September 24, I have calculated the allowable student population
to be 194 pupils .
This number was derived by using the Life Safety Code 1991
edition which is currently mandated for use by the Code of the
City of Ocoee.
Chapter 10 of the Life Safety Code deals with Educational
Facilities, and it requires at least 20 square feet of space per
student based on the net square footage of spaces used for
classrooms .
All other aspects of the proposed classroom areas are
compliant with applicable fire codes .

Dear Bruce:
This letter comes on behalf of our client, Central Florida Community School, Inc., for the
purpose of giving the Developmental Review Board for the City of Ocoee a status of the School's
Application for 501(cX3) exemption.
This letter should serve to confirm that the School's Application for Recognition of
Exemption Under Section(501)(c)(3) of the Internal Revenue Code has been filed. Please also
be advised that the School has converted from a for—profit corporation to a non—profit status in
accordance with Chapter 617.1805 Florida Statutes (1991). For your information, the Internal
Revenue Service advises that if a corporation falls within the criteria of a non—profit, tax—exempt
organization, it may operate as one, and the determination from the IRS as to the Application
filed is only a matter of formality. Central Florida Community School does fall within the
criteria used by the Internal Revenue Service as a non—profit, tax exempt organization. As soon
as we receive formal notification from the Internal Revenue Service to this effect, I will
immediately notify the City of same and forward a copy of the formal determination letter from
the IRS.

NOTICE OF PUBLIC HEARING TO CONSIDER
APPLICATION FOR SPECIAL EXCEPTION
(CASE NO. 1-5SE-93 : ST. PAULS)
NOTICE IS HEREBY GIVEN pursuant to Section 4-8 (A) (2) of Chapter
180 of the Land Development Code, that on October 12 , 1993 at 7 : 30
p .m. , or as soon thereafter as practical , the Ocoee PLANNING AND
ZONING COMMISSION will hold a Public Hearing at a regular session
at the Ocoee Community Center, 125 North Lakeshore Drive, Ocoee,
Florida and on November 2 , 1993 at 7 : 30 p.m. , or as soon thereafter
as practical , the OCOEE CITY COMMISSION will hold a PUBLIC HEARING
at a regular session at the Ocoee Community Center, 125 North
Lakeshore Drive, Ocoee, Florida, to consider the application filed
by St. Pauls Presbyterian Church and Central Florida Community
School , for a SPECIAL EXCEPTION to operate a private school in an
"R-3, Multi-family Residential District" .
The subject property is located at 1450 Citrus Oaks Avenue on the
west side of the street at St . Paul 's Presbyterian Church, south of
West Colonial Drive.
The complete case file, including a legal description of the
subject property, may be inspected at the Ocoee Planning
Department, 150 North Lakeshore Drive, between the hours of 8 :00
a.m. and 5 :00 p.m. , Monday through Friday.
Interested parties may appear at the meeting and be heard with
respect to the application. Any person who desires to appeal any
decision made during the public hearing may need a record of the
proceeding and for this purpose will need to ensure that a verbatim
record of the proceedings is made which includes the testimony and
evidence upon which the appeal is based.
