Beamer, Director may, Administrative Services SUBJECT: Ordinance 93-17 Interim Services Fee Update Ordinance No. 91-26 created Interim Services Fees effective October 1, 1991. With the adoption of the Budget for FY93-94 including the increase in staffing for Police, Fire, Parks, Parkways, Trees and Drainage, and Recreation— there exists the need to update the information as established in the original study (FY91) and to review the resultant fees. For FY94, General Fund Revenues are split $1,616,700.00 (19.6%) Property Tax and $6,617,400.00 (80.4%) Other Sources. For Police, residential increased from 39% to 46% and non-residential decreased from 61% to 54%; for fire, the shift was 76% to 62% and 24% to 38% respectively and code enforcement showed 84% to 90% and 16% to 10% for the residential/non-residential categories. Unit costs to provide demand services by type of land use and to consider the appropriate credit for ad valorem payment on vacant land and the discount for advanced payments include: Unna >,:: `t Inst; sitlential* ,; Non;�eaid�ntfal*� Cost of Services Per Unit 115.51 148.54 Credit for Payment on Vacant Land @ 10% 103.96 133.69 Discount for Payment @ 4.5% 99.28 127.67 * per dwelling unit ** per thousand square feet These adjusted annual residential and non-residential costs are $99.28 and $127.67 respectively which represents an increase of 9.5% and 10.7% to their respective categories. The recommended fee schedule for collection of the interim services fee is attached. Hotel/Motel because of its transient characteristic is a land use that may be argued to be in either the residential or non-residential categories; it has again been charged by the residential calculation but adjusted by an average occupancy rate of 74.7%. No reliable rates were available for this update; therefore, the 1991 rates continue to be utilized. Fees vary by month with the total cost charged in January since these fees follow the tax year calendar. However, because the budget is adopted in October with these new costs for service delivery the new rate is effective October 1. The minimum fee of $10.00 is still in place. In conclusion this year, as in the original calculation and the first update, the fees are 1) Based upon actual expenditures for service provision related directly to population and type of land uses, not on value of property or improvements. 2) Based upon the specific identifiable municipal service needs created by improvements, not including general government service expenditures or capital facilities need; 3) Charged to all improved properties which receive City services where offsetting revenues are inadequate; 4) Credited for future payments of other revenue sources such as franchise fees, utility taxes, charges for services, fines and forfeitures, sales taxes, and other revenues from user-based fees; 5) Credited for those improved properties which are evaluated as not having created an expenditure shortfall as a result of service provision; 6) Deposited into a special fund, not in the general fund. Action Requested The Mayor and City Commission (1) accept the new unit cost for demand services, (2) approve Ordinance 93-17, and (3) authorize the Mayor and City Clerk to execute. BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: SECTION 1. The City Commission of the City of Ocoee has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapter 166, Florida Statutes. SECTION 2. Exhibit A of Section 90-5.A of the Code of Ordinances of the City of Ocoee, Florida, is hereby deleted in its entirety. SECTION 3. Severability. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. SECTION 5. Codification. It is the intention of the City Commission of the City that the provisions of this ordinance shall become and be made a part of the Code of Ordinances of the City; and that sections of this ordinance may be renumbered or relettered and the word "ordinance" may be changed to "chapter", "section", "article", or such other appropriate word or phrase in order to accomplish such intentions; and regardless of whether such inclusion in the code is accomplished, sections of this ordinance may be renumbered or relettered and the correction of typographical errors which do not affect the intent may be authorized by the City Manager, without need of public hearing, by filing a corrected or recodified copy of same with the City Clerk. SECTION 6. Effective Date. This Ordinance shall become effective immediately upon passage and adoption. PASSED AND ADOPTED this _ day of , 1993.
