A. Nicole Boulevard Subdivision Preliminary & Final Subdivision Plan-,
Project No(s): LS-2018-004. (Advertised in the West Orange Thanes oii Thursday, August
2,2018) (City Planner Rumer)
City Planner Runner presented a brief overview of this proposed Preliminary & Finial
Subdivision Plan, which is located within the Twin Lake Forest Subdivision. Access to
the site is from Nicole Boulevard. This is on a 6.184 acre remnant property that is
wooded with no structures and has a zoning designation of R-1. The R-1 zoning
designation permits single-family lots with a minimum width of 70 feet and an overall lot
size of 7,000 square feet. The Future Land Use designation for this subject site is "Low -
Density Residential" which allows up to four (4) dwelling units per acre. The surrounding
future land uses are "Low -Density Residential" on all sides. A stormwater pond, which
has been reviewed and approved by staff and the St. Johns River Water Management
District, will be maintained by the City.
The Nicole Boulevard Subdivision will be developed as a one -phase subdivision, and
this proposed project consists of 19 lots meeting: or exceeding the iminimum lot size
requirement of the R-1 zoning district with construction of a new public road entailing
sidewalks and a cul-de-sac. This road will be maintained by the City. There is a
significant elevation change from Nicole Boulevard to the rear of the property. The
elevation of the property adjacent to Nicole Boulevard is 117 feet whereas the rear of
the property sits at 147 feet. There currently is not a homebuilder associated with this
project. School capacity determination will need to be submitted to which a Capacity
Enhancement Agreement will be required prior to being heard before the City
Commission. All Iproposed lots will be on city water and sewer.
Development Review Committee (DRC) Recommendation:
The Development Review Committee (DRC) reviewed the Nicole Subdivision Preliminary &
Final Subdivision Plan on May 24, 2018. There were several technical issues to be addressed
by the Engineering Department regarding the stormwater pond and piping. All of the issues
were discussed, and changes to the plans were agreed upon.
When the discussion was finished, the Committee voted unanimously to recommend approval
of the Preliminary & Final Subdivision Plan. The applicant has made the modifications to the
plan and is now ready to be presented to the Planning and Zoning Commission.
Staff Recommendation:
Based on the recommendation of the DRC, Staff respectfully recommends that the Planning
and Zoning Commission recommend approval of the Nicole Subdivision Preliminary & Final
Subdivision Plan.

Discussion:
Member Wunderlich stated he is unfamiliar with this area and asked for location
landmarks. City Planner Rumer explained Wurst Road/AD Mims is to the south and
Clarke Road is to the east with Vignetti Park to the west. Member Wunderlich inquired
if a perimeter wall is planned for this development. City Planner Rumer stated there is
no requirement for a buffer when residential is adjacent to residential.
Brian Denham, Applicant, Denham Engineering, 5212 Timberview Terrace, Orlando, is
present for questions to which no questions were asked.
Chair Keller opened the public hearing and asked if there is anyone present who
wishes to speak on this proposed project. As no one wished to speak, the public
hearing was closed.

B. Land Development Code (LDC) Amendment Concerning Collection Bins
and Collection Trailers. (Advertised in the West Orange Times on Thursda)� August 2,
2018) (City Planner Rumer) (6:47pm)
City Planner Rumer presented a brief overview of this proposed amendment relative to
Article 11, Section 2-4 Definitions and Article VI, Section(s) 6-14, Commercial and
Industrial Development Regulations, and 6-15 Multi -family Development Standards
concerning Collection Bins and Collection Trailers. The City currently regulates the
location of storage containers or dumpsters by requiring them to only be located on a
parcel within a fufly-screened, masonry enclosure designed for that purpose.
City Planner Rumer explained what the clothes donation bins are and what they look
like; and further, he stated the City has removed such bins when they would show up on
commercial property. The City has also determined that clothes and other recyclable or
donation bins are regulated under those same criteria. In order to more clearly define
how clothes collection bins and collection trailers are regulated, an amendment to the
Land Development Code defining the terms and regulations is being proposed.

Below is the revised definition to the Land Development Code:
"Collection bin or Collection trailer: Anv stationary or free-standing container,
receptacle or similar device that is located outdoors on anv property within the Citv and
is used for the collection of donated items, such as, clothina, books, shoes or other non-
perishable personal property, and which includes a mobile trailer used for the collection
of donated items. This term does not include any of the following: (1) a bin used for the
collection of donated items, associated with a special event, provided the bin is removed
when the special event ends, but in no event later than forty-eight (48) hours after being
placed at the special event site; and (2) a container for the collection of recyclable
materials associated with the City of Ocoee or the Orange County Solid Waste
Division."
Staff is also proposing to amend the requirements of dumpsters and storage containers
with the following language:
"No long-term storage containers, compactors, collection bins, collection trailers, or
dumpsters will be located on a parcel except within fully -screened masonry enclosures
designed for that purpose."
"No outside freestanding vending machines, video games, propane stations, electric
rides, newspaper boxes, collection bins, collection trailers, or similar equipment shall
be permitted unless substantially screened from view from adjacent roads or parking
areas."
Staff Recommendation:
Staff recommends that the Planning and Zoning Commission recommend approval of
amendments to the Land Development Code (LDC) relative to Article 11, Section 2-4 Definitions
and Article VI, Sections) 6-14, Commercial and Industrial Development Regulations and 6-15,
Multi -family Development Standards concerning Collection Bins and Collection Trailers,
Discussion:
Member Mellen mentioned he is not a big fan of the collection trailers, because they are
big and unsightly. He stated it seems like a big jump from a trailer to a bin. City Planner
Rumer stated a lot of times there will be a couple of bins inside of the trailers; and
further, stated that this is a code enforcement issue.
Chair Keller opened the public hearing and asked if there is anyone present who
wishes to speak on this proposed amendment. As no one wished to speak, the public
hearing was closed.

A. Prqiect Status Report
City Planner Rumer updated the Board about the next meeting in September
where Development Services staff will be introduced and an update will be given
regarding the downtown redevelopment area along with the projects within the
CRA. He stated Old Winter Garden Road has had new landscaping installed,
and the work has begun on the roundabout located at the intersection of
Windermere Road and Stoneybrook West Parkway. Further, Legacy Life Styles
ALF/Memory Care Facility and Arya will be breaking ground soon.
Member Wunderlich inquired about the old Colony Plaza site, City Planner
Rumer stated there currently is work being done such as installing a stormwater
pond for the two (2) 14,000 sq. ft. retail buildings, and the rest of the property is
being cleared for marketing.

Annexation: With respect to State annexation criteria, Chapter 171.044 of the Florida Statutes
grants municipalities the authority to annex contiguous, compact, non -circuitous territory so long
as it does not create an enclave, The subject property is considered contiguous to the City of
Ocoee since it bordered by property located within the City limits on the western boundary,

County Joint Planning Area (JPA) and is being considered for annexation as outlined in the JPA

171.044(6) FS and Subsection 13-A of the City of Ocoee -Orange County Joint Planning Area
Agreement,
Rezoning:
: The Applicant has requested a City of Ocoee zoning designation of A-1 "Agriculture",
which is consistent with the zoning of the properties to the north, east and west. According to
the Land Development Code, the A-1 zoning designation is intended for areas shown on the
Future Land Use Map as "Low Density Residential". The A-1 zoning designation is consistent
with the adopted future land use designation of Low Density Residential, as shown on the City
of Ocoee & Orange County Joint Planning! Area (JPA) future land use map.
Comprehensive Plan: The annexation is consistent with the Future Land Use Element Policy 2.5
that states in part, "The City shall consider requests for voluntary annexation into the City when
those lands are logical extensions of the existing City limits, when services can be properly
provided, and when proposed uses are comoatible with the Citv's Comprehensive Plan, the JPA
(Joint Planninq Area) Agreement, and the Citv's Annexation Policy....". The rezoning is
consistent with Future Land Use Element Policy 1.15 that states in part, "The City may assign
an initial zoning, after annexation, which is consistent with both the Future Land Use Map and
the JPA Agreement...
DISCUSSION:
Annexation Feasibilitv & Pub,lic Facilities Analvsis Report (See attached): The proposed site
plan will require connection to City of Ocoee potable water and sewer.
Summary: The proposed annexation is a logical extension of the City limits, urban services can
be provided, and the annexation meets state and local regulations. The land use and initial
zoning are also consistent and compatible with surrounding properties.

On September 5, 2018, the DRC met to determine if the proposed annexation and rezoning was
consistent with the City's regulations and policies. When the discussion was finished, the DRC
voted unanimously to recommend approval of the annexation and rezoning for the Innovation
Montessori property,
Based on the feasibility report and recommendation of the DRC, Staff recommends that the
Planning and Zoning Commission, acting as the Local Planning Agency, recommend approval
of the Annexation and Rezoning to A-1 "Agriculture" of the property known as the Innovation
Montessori property located at 2336 Fullers Cross Road.
