As part of this approval process a road was planned for the ingress and egress for Mr. Coffman, a neighbor to the south of Sawmill in unincorporated Orange County. During the construction phase it appears that Mr. Coffman may have objected to this road and continued to use his access road to Apopka Vineland road just south of the Sawmill entrance. Further, both the developer and a member of my staff advised that a high ranking political official of Ocoee asked that the road not be finished. To this end, Mr. Coffman has sent through his attorney on a yearly or bi-yearly basis a letter now stating that his access to Apopka Vineland road is dangerous and that he wished access to Sawmill Boulevard. Since this notice, Mr. Coffman has been able to use this platted public access for his ingress and egress. Now, the homeowners' association of Sawmill is concerned that without a formal, safe roadway, Mr. Coffman's use of this right-of-way is dangerous to vehicles along Sawmill Boulevard as well as children at play in the area, who will not anticipate a vehicle approaching the roadway from this location. To this end, I met with our City Attorney, some staff and the original developer on this subject. As a result of the information obtained. It is our City Attorney's position that we should probably have the stump road built to ease our possible liability. As a result of the information above, I am hard pressed to make the developer pay for this road since it was constructed by him at one time and asked to be removed. To this end, I am reluctantly requesting that approximately $15,000 be allocated from Contingency for the purpose of the construction of this road. Per our discussion, I advised Bob Taylor, Vice President of the Sawmill Homeowners Association of the status of the Stump Road, i .e. that Mr. Coffman was entitled to the road and it appeared that the developer, Mr. Gary Russell was responsible in providing said road. I received the attached letter on Monday 12/20/93 from Florida Management services requesting that a final determination be made to 1) complete the road as originally planned or 2) abandon the road altogether. Please advise the final disposition from the City Attorney so we can resolve this matter. I thank you for your attention in this matter. I have included a copy of the site plan of the affected area, marked for your information. This "stump road", which would lead to the property directly to the south of Sawmill Subdivision, has never been built. The owner of the property to the south, Mr. Ken Coffman, has been driving up the grassed hill on common area property, where the stump road would be "placed _ if completed. This has resulted in considerable damage to the grass, and has damaged the appearance of the entrance area to the subdivision. The Homeowners' Association is asking that a determination be made, either to complete the road as originally planned, or to abandon the road altogether. This will allow the. Association to make a decision as to the maintenance and landscaping of this area. We would appreciate your assistance in this matter. If you require further information, or an appearance at a Commission meeting to resolve this, please let me know. I will immediately bring it to the attention of the Board. Thank you. Please find enclosed a memorandum prepared by Brian Lower which outlines the potential problems and includes our recommendations. In summary, the developer of the sawmill Subdivision remains obligated to complete the stubout to Mr. Coffman's property. In the event the developer refuses to complete the stubout, then the City should deny the issuance of further building permits for the project. The actions previously taken by the Developer did not release it from the obligations under the terms of the Developer's Agreement. DATE: April 24, 1992 RE: Entry problem at Sawmill Subdivision As you may recall, Ellis Shapiro asked that we find a way to remedy the entry problem at the Sawmill Subdivision. An adjacent property owner 'has contacted the City on a regular basis and alleged the existence of a dangerous condition at the intersection - of Sawmill Boulevard and Apopka Vineland Road. Although the adjacent property owner who has lodged the complaints resides in the County, the intersection allegedly poses a danger to the City residents living in the Sawmill subdivision. The following is a summary of my fact findings and a conclusion as to how the City should proceed. FACTS Sawmill Boulevard is the single entrance into the Sawmill subdivision and is located off of Apopka Vineland Road. Because Sawmill Boulevard is the only entrance and because the entrance is on Apopka Vineland Road, the intersection appears to handle a great deal of 'vehicular traffic. The entrance is also located on a slight curve. Located immediately adjacent to Sawmill Boulevard is a driveway to property owned by a Mr. Coffman. The driveway is 10 feet from Sawmill Boulevard. Mr. Coffman's property is located in unincorporated Orange County. Mr. Coffman has complained to both the County and the City on a number of occasions that he is unable to safely enter or exit his driveway (which pre-existed Sawmill Boulevard) _ Because of the close proximity of the two entrances, traffic may assume Mr. Coffman is entering or exiting Sawmill Boulevard. Jim Shiro has inspected the_location, and agrees that some action is required. According to Jim Shira and correspondence contained in the file, Uniwes, the developer of Sawmill, had offered to construct a stub out along Sawmill Boulevard for the sole purpose of providing u9 01, 93' 11:3:a OL%s c i.14tDNE.t 904/004 Mr. Coffman with a safe means of ingress and egress to his property. In fact, the plat for Sawmill Phase 1 shows this stub out. After platting, however, Mr. Coffman asked Uniwes to pave his driveway in lieu of paving the stub out, which Uniwes did. The construction plans for Sawmill Phase 1 have a note stating that Mr. Coffman's driveway will be abandoned once the stub out is completed. Although such a note is not binding on Mr. Coffman, it does indicate that the proximity of the two entrances was considered a problem at the time. Mr. Coffman now appears to have undergone a change in thinking and would like to have Uniwes complete the stub out. According to Jim Shiro, Mr. Coffman's real goal may be to subdivide his adjacent property. His current driveway and access is insufficient for that purpose and therefore he is seeking to gain better access from Sawmill. RECOXMENDATIOR Uniwes is obligated to complete the stub out as shown on the approved plat for Sawmill Phase 1 by virtue of the developers Agreement which states that Uniwes will complete all subdivision improvements (see form Developer Agreement located in Appendix A, Section 5.3 of Subdivision Regulations for Developers Agreement executed by Uniwes) . The City has only accepted those improvements which have been completed_ Accordingly, Uniwes' argument that the City has accepted the subdivision without the stub out is incorrect. Once thestub out is completed Mr. Coffman will have safe access to his property. It is recommended that the City notify Uniwes that it must complete the stubout within a specified time period and that no further building permits will be issued if the stubout is not completed by that date. After the work has been completed by Uniwes, then the City should notify Mr. Coffman that the stub out has been completed and that safe access is available. If Mr. Coffman continues to utilize the existing driveway, the City should notify the County of the problem and request that the County take action to require Mr. Coffman to utilize the alternative access. A meeting should be arranged with the County engineer and Jim Shira. Since Mr. Coffman's attorney proposes that the stub out be completed to remedy the situation, Mr. Coffman is apparently in agreement with this remedy._ Since Mr. Coffman's property is not located in the City, other than providing him with alternative access and requesting the County to intervene, there does not appear to be anything else that can be done. -2- • .__ o 0 S. Lakeshore Dr. Ocoee, FL 34760 Dear Sir: The following information is being sent to you per our conversation. The stub-out that is under discussion is in Orange County Plat Book 23 , Page 33 and is now located in your Sawmill file under Phase I . During the building phase of Sawmill Mr. Russell showed me three different designs of the entrance way for Sawmill . After the final plat map was complete, he showed me the drawing where the stub-out was to go in. I did not contest the stub-out at the time is was platted. However, during the building phase of the main entrance I discovered that Mr. Russell had told Orange County and City of Ocoee that my dirt road was to go away after the stub-out was built. I then contacted Mr. Russell and Mr. Stimpson and told them that my road was not going away. This drive is deeded property and will remain, they asked me if I wanted the stub-out, I told them at that time that I didn' t care what they did as they were not going to do away with my property because of the stub-out. I have since found out through Orange County and your city planning and zoning board that this road is platted and should be installed . I have tried to contact Mr. Shapiro several times to discuss this problem, which has been compounded due to all the traffic exiting Sawmill Subdivision onto Apopka-Vineland Rd . This sub- division was completed without the addition of the road to the south and west of Sawmill which now requires all estimated 410 homeowners to exit onto Apopka-Vineland Road .. This has created an extreme hazard for my family and guests entering my drive. When driving north on Apopka-vineland Rd and turning our left turn signal on to turn into our driveway, cars that are exiting Sawmill Blvd onto Apopka-Vineland Rd do not yield to cars turning left into our drive, (90%) of the time most drivers do not stop since they have looked to the north and see no cars coming and have seen car approaching from the south with its turn signal on and assuming the car is turning onto Sawmill Blvd which is not always the case. The same occurs when going south on Apopka-Vineland Rd and turning right onto driveway just past Sawmill Blvd . After several near accidents I contacted my lawyer and he sent several letters to the City of Ocoee with no response to those letters . Due to this problem our lawyer had advised us to use the approved stub-out even though it was nevel installed, to protect ourselves against an accident with possible serious injuries . My family uses this stub-out driving across the grass. Each of my family members carry a copy of the stub-out in their car as per our lawyers request to insure when stopped for driving on the grass by homeowners that they will understand that this is a legal road and not a violation of the law. I understand that the homeowners are upset and I understand their feelings . However, since they do not use the stop sign and do not give us the right of way to turn onto our driveway we had to resort to using the grassed stub-out to insure our safety. I would like you to look at these documents I am sending and would like to discuss the stub-out road. I know that this will take some time to correct and I am not in a hurry. I have been working on this for over 5 years and I know it will take time . I would also like to state that I have never been contacted by the City of Ocoee on this stub-out and the paving of my driveway by Uniwes which I did not request. I had given Uniwes a license to use my drive to bring equipment onto their project and they were required by this license to return my driveway back into same or better condition as it was when they started to use it . I did ask Mr. Russell if he could spray a light coat of oil or tar onto the driveway to protect it until it stabilized after the contractor left. He said not to worry he would take care of it . The next thing I knew he had paved the drive . All letters sent by myself or my lawyer to Mr. Shapiro with the City of Ocoee were never acknowledged, all phone calls to Mr. Shapiro were never returned . I can only assume that Ocoee is not interested in this problem until a major accident occurs , which is a shame. The legal description is attached. to this letter. On November 12 , 1987 , Mr. Massaro recommended against an ' entrance way to the Sawmill subdivision adjacent to our client's property. Notwithstanding, the roadway was approved and built and is now known as Sawmill Blvd. Directly parallel to this road is our client's 15 foot roadway which has been in existence for 12 years . Sawmill Blvd. is now causing an extreme safety problem. Regardless which direction our client travels on Apopka Vineland Road, he cannot safely enter his roadway. Traffic exiting the subdivision onto Apopka Vineland are confused where he will turn. Page 2 October 26, 1990 They assume hs is going to turn into Sawmill Blvd. If he is going north and he is in the left hand turn lane, the drivers assume he is going to turn onto Sawmill Blvd. and cut in front of him. If he is going south, they assume he is going to turn right onto Sawmill Blvd. .and again dart out in front of him. I am told Mr. Coffman was never consulted or noticed about the road construction. He has constantly, both during and since the road construction, been contesting the road being built. Notwithstanding, his concerns have been ignored. Mr. Coffman has tried to talk to Mr. Swann, Mr. Larry Dunn, Mark Massaro, as well as to each of you about these problems prior to road construction, but his calls were ignored. Now that the County and City of Ocoee have created this problem and created the dangerous conditions, demand is hereby made to correct this dangerous situation for our client, his invitees and the residents of Sawmill subdivision. Coffman ) property which runs parallel to Sawmill Blvd . I have talked to the City of Ocoee several times , Ocoee Police Dept . , City Administrator, and most recently Mr . Buddy Elmore of Ocoee Engineering. All of them directed me to Orange County. I contracted Orange County and they put me in contact with your office . Sawmill Blvd runs parallel to my Dad ' s private drive . This creates an accident waiting to happen . The people in Sawmill totally ignore our presence when we use the driveway . When we are turning left off Apopka- Vineland Rd onto my Dad ' s drive, the people in Sawmill will pull out in front of us , thinking we are turning onto Sawmill Blvd . On July 23rd , I was traveling north on Apopka-Vineland Rd , I was stopped in front of my Dad ' s drive , after traffic was clear I proceeded to turn onto my Dad ' s drive and a car from Sawmill Blvd turned right onto Apopka-Vineland in front of me . I had to stop quickly or an accident would have happened . I have enclosed a drawing as requested showing the Coffman driveway in relation to Sawmill Blvd . This type of near accident happens daily to anyone who uses the Coffman drive . This potential accident waiting to happen needs to be corrected . Sawmill subdivision needs to build the access road from Sawmill Blvd to my Dad ' s driveway . Also some signs letting people know there is a hidden driveway would help this matter . Massaro, P.E. , County Traffic Engineer SUBJ: United Associates Subdivision Main Entrance: Apopka Vineland Road Civil Design Group Consultants Recently, this department was requested to evaluate the location and design of an entrance way into a proposed subdivision, just north of Hackney Prairie Road on the west side of Apopka Vineland Road. The following data was compiled, with results as noted: 1 . The intersection is located in Section 3, Township 22, Range 28 . 2 . The proposed subdivision lies in the City of Ocoee. 3 . Apopka Vineland Road is with a dedicated Orange County right of way, 60 feet in width. 4. A sinkhole/pond abuts the intersection in the northwest quadrant. , 5 . A "No Passing" zone exists throughout this section of roadway. 6 . The posted speed limit is 45 mph, both north and southbound, not 30 mph as the plans indicate. 7 . There are 30 mph post-advisory speed limits mounted to advance-warning signage, in advance of the curve. Chevron signage has also been installed. A speed study was conducted on 11-3-87, and the 85th percentile speed was found to be 40 mph in the southbound direction and 41 mph in the northbound direction through this curve. 8 . The intersection lies in a super-elevated "S" curved section • - of roadway. 9 . The center line of the proposed intersection will intersect Apopka Vineland Road at a skewed angle, approximately 12 degrees, at the beginning of the curve on the south. November 12, 1987 George W. At 45 mph, 388 feet is the desirable stopping distance for approaches to "stop" conditions per FDOT "Greenbook. " Southbound, the sight distance is approximately 1500 feet. 11. The proposed storage left-turn lane is 200 feet in length. The storage length required for peak left-turn volume of 239 vehicles is 200 feet per FDOT "Greenbook. " 12. The existing clear zone recovery area is approximately 14 feet. The Greenbook requires 14 feet at 45 mph, as this is a rural section of roadway. 13 . There exists a large tree that impairs sight distance slightly, on the west side of Apopka Vineland Road, 225 ' north of the intersection. 14. The intersection lies at the beginning of a 2. 2% grade. 15. Erosion is evident along the east edge of roadway. 16. On the west side of Apopka Vineland Road, the right of way drops quickly off the edge of the roadway, approximately at a 3 : 1 slope, with very little shoulder. 17. The projected volume is 541 vehicles at peak hour, 341 ingressing and 200 egressing the subdivision. The peak-hour volume on Apopka Vineland Road is 509 vehicles. 18. We have analyzed the intersection, using the Highway Capacity Manual and have found service levels as follows: a. Apopka Vineland Road northbound left-turn lanes are L.O. S . B. b. Minor street approaches shared right/left turn lane are L.O. S . E. These figures represent today' s background traffic volumes on Apopka Vineland Road, not projected volumes that will exist at buildout time. We estimate 80% of the trips will use the primary drive and 20% are going to use the secondary drive. 19 . Critical gaps ranged from 6 . 10 to 8 .4 seconds. 20. The taper length proposed is 190 ' , not 210 ' as recommended by the FDOT Greenbook. Summary and Conclusion: In analysing all of the data, using sound engineering judgment, the entranceway for this subdivision as proposed by United Associates cannot be recommended. This department foresees con- flicts with the design and location for this entranceway as de- scribed below: 1 . The access road is on a curved section of roadway, which is superelevated. The right-turn lane (southbound) will require a break in the cross-slope, which has the potential of throwing a vehicle. 2. Placing a skewed intersection on a curve is poor practice. 3 . The complexity of the intersection location, coupled with the curve, the grade, vehicles accelerating to make the grade, and the requirement to negotiate curves immediately beyond the intersection, reduces the capability of a motorist to adequately keep his vehicle under control. 4. There is inadequate recovery area available after the intersection is widened within the existing right of way. 5 . The construction of the additional lanes will require shoulders to be placed. It is questionable if there is enough right of way to install the shoulders and slopes on fill sections. 6. Even though 500 feet of sight distance exists to the north, it is questionable whether a motorist will have enough time to react to the lane changes required of him. 7. We feel that the geometrics of the intersection would not permit it to be signalized easily, should future traffic volumes necessitate a signal . There would have to be a , considerable amount of advance warning in the southbound direction to alert motorists of the signal ahead. 8 . We foresee a problem with drainage. There are no provisions that would permit the runoff to be adequately treated. At a minimum, curbs and inlets would be required with retention, prior to discharging into the sinkhole/pond. The design of this intersection would require an acceleration lane in the southbound direction to permit vehicles to climb the grade easily. 10. The visibility at night presents a problem. This intersection would require highway lighting, as it is somewhat hidden when approaching it in a southbound direction. 11 . According to the Highway Capacity Manual, adequate gaps in future traffic will not exist. We used current background information and received a level E for left-turn movements coming out of the subdivision. We foresee extensive delays for those motorists wishing to go northbound from the subdivision approach. These motorists will probably tolerate only so much delay before they risk making the northbound turn. As it exists now, during the peak hour, there is one vehicle passing this location every 7 seconds on the average, traveling along Apopka Vineland Road. Therefore, signalization will be imminent. Of paramount importance in our review was to , preserve the integrity of Apopka-Vineland Road and minimize any potential hazard to traffic safety. After several discussions, we finally reached the conclusion that we could recommend a design to the County Commission which we felt perserved the safety requirements along Apopka-Vineland Road as well as provide access to the subdivision. The conceptual design was presented and approved by the County Commission on February 22, 1988. This design does not incorporate a southbound right turn movement and is essentially the same as that submitted to the City of Ocoee on the construction plans.
