Background Summary:
At the May 15, 2018 Commission meeting, the FY 2018 asphalt paving projects bid was awarded to
Hubbard Construction Company (HCC). The City had allocated funding for the resurfacing of Marshall
Farms Road in previous fiscal years, yet deferred moving forward with the work until such time as the
parallel State Road 50 widening project was completed. The State completed their project about the
same time the City awarded the resurfacing projects. Public Works approached HCC to extend the
awarded bid pricing to incorporate the work on Marshall Farms Road as this heavily traveled access
road for commercial traffic is long overdue for resurfacing. The $288,465.39 cost to mill and resurface
approximately 3,000 linear feet of roadway is adequately funded with the carry-forward funds allocated
for this project in previous fiscal years. Public Works recommends approval of the change order to
incorporate Marshall Farms Road resurfacing in the FY 2018 asphalt paving program.
Issue:
Request the City Commission approval of Change Order #1 with Hubbard Construction Company to
incorporate Marshall Farms Road resurfacing into the FY 2018 asphalt paving program.
Recommendations:
Recommend the City Commission approve Change Order #1 in the amount of $288,465.39 with
Hubbard Construction Company, Winter Park, Florida, to incorporate the Marshall Farms Road
resurfacing into the awarded Asphalt Paving Projects for FY 2018.

Financial Impact:
The $288,465.39 cost for the change order is adequately funded in the FY 2018 paving program with
the carry-forward funds allocated for this project in previous fiscal years.

B 18-02 Asphalt Paving Projects
CHANGES ORDERED:
I.
REQUIRED CHANGES: Public Works requests contract changes to include the milling and
resurfacing of Marshall Farms Road at the unit costs presented by Hubbard Construction.
Capital Improvements for this asphalt project was approved in prior fiscal year; however Public
Works postponed the project due to the FDOT reconstruction of SR 50. In evaluating the unit
costs submitted by Hubbard Construction,Public Works believes it is cost effective to include the
asphalt repairs at this time.
II. JUSTIFICATION: Marshall Farms Road milling and resurfacing is justified due to current
pavement condition. Pursuant to the Pavement Survey and Evaluation Report prepared by
Universal Engineering Sciences,Inc.,the pavement is in poor condition with severe rutting,
raveling,shoving and cracking.
III. NARRATIVE OF NEGOTIATIONS:Current unit are cost effective. Refer to attached Bid Form
IV. PAYMENT: Total Change Order is$288,465.39
V. APPROVAL AND CHANGE AUTHORIZATION
This proposed change to the Contract requires approval by the Ocoee City Commission or the City Manager,
dependent upon project approval authority, in order to supplement the project budget to fund the changes.It is
expressly understood and agreed that the approval of the Change Order shall have no effect on the original
contract other than matters expressly provided herein.
CONTRACTOR acknowledges,by its execution and acceptance of this Change Order,that the adjustments in
Contract Price and Time shown hereon constitute full and complete compensation and satisfaction for all costs
and modifications of performance time incurred by the CONTRACTOR as a result of this Change Order. No
other claim for increased costs of performance or modifications of time will be granted by the OWNER for the
Work covered by this Change Order. The CON TRACTOR hereby waives and releases any further claims for
cost or time against the OWNER arising from or relating to the matters or Work set forth or contemplated by
this Change Order.
