Approximately 500 Feet of 8-Inch Water Main from the Southwest Development Utility
Improvements Phase II.
Background Summary:
The Southwest Development Area (SWDA) is comprised of five (5) parcels of land located in the
southwest corner of the City of Ocoee, more specifically adjacent to Tomyn Boulevard/Windermere
Road and Roberson Road between Patriots Point Drive and Wesmere Parkway. Each parcel on its own
would not be large enough (developmental density) to extend utilities to support the parcels'
development. Therefore, the City initiated a "Southwest Development Utility Project" causing the needed
utilities to be designed and permitted; and the construction of Phase 1 and the North Phase of the
project. Phase II of the project was planned to be constructed by the first of the developing parcels
along Roberson Road. To cover the construction costs of the project, each of the parcels upon
development shall reimburse the City their fair share. Legacy Lifestyle of Ocoee, that appears to be the
first developing parcel, has agreed to construct Phase II. Legacy will be allowed to use their fair share
obligation and their Water/sewer capital fees to offset construction costs. Legacy must provide needed
funds over their fair share and capital fees if construction costs are more than the combined share and
fee; and further, reimburse the difference if the construction costs are less than their total obligation. At
the time of this action, Legacy has not begun any work on the needed utilities.
On June 19, 2018, City Commission approved Winter Garden's Contractor, Atlantic Civil, to construct
780 feet of 8-inch water main from Phase II, which coincides with the construction limits of Winter
Garden's roundabout project. The City of Winter Garden has begun reconstruction of the Roberson
Road & Windermere Road intersection, and the plan set for the project shows the 780 feet of 8-inch
water main left unpressurized and unconnected from the surrounding Ocoee water mains. City staff
reached out to Atlantic Civil to add approximately 500 feet of 8-inch water main along Windermere Road
to connect to the nearest charged water main north of the roundabout.
Atlantic Civil issued the City a proposal in the amount of $72,574.44 for all the work needed to construct
the water main extension. The remaining portion of the Phase II project will remain the responsibility of
the Legacy Lifestyle of Ocoee.
City staff at the Utilities Department shall be available for questions.
Issue:
Should the City Commission approve Atlantic Civil as the best source to construct approximately 500
feet of 8-inch water main from the Southwest Development Utility Improvements Phase II?
Recommendations:
Motion to authorize City Manager to accept Atlantic Civil's proposal to construct approximately 500 feet
of 8-inch Water Main in the amount of$72,574.44.

Financial Impact:
The total Southwest Project construction cost was estimated at $636,266.50 in October of 2014, but
was increased by $126,117.64 to $762,390.00 (Commission action — Feb. 17, 2015). The Engineer's
Estimate of the Probable Cost for Phase II construction in 2015 was $440,000 with a present day
adjusted amount of $394,167.00. Legacy's total commitment to the City for its fair share and capacity
fees is $597,358.44, requiring Legacy to make an estimated cash payment to the City of $203,191.44.
All the work done by Atlantic Civil will decrease the amount Legacy will need to construct for Phase II.
This segment will not be required in the developer's construction, but remain part of their Utility
contribution. This will cover the expenses the City will have to pay Atlantic Civil for their work on the
portion of Phase II. Finally, funding for the extension of the 8-inch water main will come from the Carry
Over Project Funding (408-531-00-6302) and shall be replaced upon receipt from Legacy or other
developers along Roberson Rd.

Dear Mr. Densberger:
This letter serves as an addendum to the quote provided to the City of Ocoee for the
additional 8"ductile iron water main section that will connect the 8"water main in our
contract with the City of Winter Garden to the existing water main approximately 500'
north of our construction limits on Windermere Rd. The work will be completed in
accordance with City of Ocoee Utility Standards and the Ocoee Contract Administration
and inspection. Atlantic Civil Constructors will complete the work within the contract
conditions and requirements of the Winter Garden project. Payment for this work will be
through a direct agreement with the City of Ocoee and not subject to a Change Order
under the existing contract agreement.

Legacy Lifestyles Ocoee Property,LLC as the owner/developer of Legacy Lifestyles of Ocoee is
providing a letter of understanding in regard to the mythology,calculations and payment obligations agreed
to with the City for the Water and Sewer Capital Charges fees.
Whereas stated in the Developers Agreement,the Developer is required to pay a prorated portion of the
Southwest Development Utility Improvements Phase I construction and manage and construct the City's
Southwest Development Utility Improvements Phase II project.
The developer was provided by the City,the Southwest Development Utility Improvements Phase II
prepared by Pegasus Engineering.
Legacy Lifestyles Ocoee Property,LLC acknowledges and agrees the following methodology,calculations
and payment agreement.
Calculations of Water and Sewer Capital Charges Fees:
a. Prorated portion of the Southwest Development Utility Improvements Phase I=$211,500.00
b. City Water and Sewer Capital Charges fees=.$385,858.44
c. Developers total Water and Sewer obligations=$597,358.44
Calculations of Developers Water and Sewer Credits:
a. Final construction cost of the Southwest Development Utility Improvements Phase II=TBD*'

b. Development/Management Fee of 5%on the final agreed Phase II construction cost.
